HomeMy WebLinkAboutR-90-0645RESOLUTION NO. 90f 45 A RESOLUTION ACCEPTING THE BID OF XEROX CORPORATION FOR FURNISHING FIVE (5) COPIERS TYPE D CATEGORIES ON A CONTRACT BASIS FOR THREE (3) YEARS AT A FIRST YEAR COST OF $105,390.00 FOR A TOTAL PROPOSED THREE-YEAR COST OF $316,170.00; ALLOCATING FUNDS THEREFOR FROM THE OPERATING BUDGETS OF THE USING DEPARTMENTS FOR THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION/GRAPHIC REPRODUCTION DIVISION FOR USE BY ALL CITY. DEPARTMENTS; AND APPROVING THE CHIEF PROCUREMENT OFFICER'S DECISION TO REJECT THE PROTEST RECEIVED FROM EASTMAN KODAK COMPANY; AND AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE PURCHASE ORDERS FOR THIS EQUIPMENT SUBJECT TO THE AVAILABILITY OF FUNDS. WHEREAS, pursuant to public notice, sealed bids were received May 11, 1990 for the furnishing of copiers type D category on a contract basis for three (3) years to the Department of General Services Administration/Graphic Reproduction Division for use by all City Departments; and WHEREAS, invitations were mailed to forty-one (41) potential suppliers and four (4) bids were received; and WHEREAS, funds for this purchase will be available from the Operating Budgets of the using departments; and WHEREAS, this equipment will be used by the Department of General Services Administration to replace copiers that are currently utilized by departments throughout the City; and WHEREAS, it has been determined by the Chief Procurement 3 Officer, in his role as the arbiter of bid protests pursuant to ;' Section 18-56.11 that the bid protest filed by Eastman Kodak Company be rejected due to its lack of merit; and WHEREAS, the City Manager and the City Attorney concur with the finding of the Chief Procurement Officer and recommend rejection of the bid protest filed by Eastman Kodak Company; and 1 f i -t 1 a 'MMIUM th* pity Manager and the Director of the bapart"ftt ; of denaral Services Administration recommend that the gird received frm Xerox Corporation for five (5) copiers type D be adeopt+ed as the lowest responsible and responsive bid for this category; NOWT TfSREFORRI BE IT RESOLVED BY THE COMMISSION OF THE CITY OP MIAMi, FLORIDAt Section 1. The recitals and findings contained in the * Preamble to this Resolution are hereby adopted by reference f thereto and incorporated herein as if fully set forth in this Section. Section 2. The May 11, 1990 bid of Xerox Corporation for furnishing five (5) copiers type D category on a contract basis for three (3) years for the Department of General Services Administration at a first year cost of $105,390.00 for a total proposed three-year cost of $316,170.00 is hereby accepted with funds to be allocated from the Operating Budgets of the using department. Section 3. Upon the approval and recommendations of the City Manager and City Attorney, the Chief Procurement Officer's decision to reject the protest filed by Eastman Kodak Company is hereby approved. Section 4. The City Manager is hereby authorized to f instruct the Chief Procurement Officer to issue Purchase Orders it for this equipment subject to the availability of funds. Y. Section 5. If the bid. had been structured differently, (I.e., no trade-in) Kodak would have responded with a different cost structure to follow the terms and conditions of the bid. However, the bottomline Cost to the City would have been the same, $ l 243.54/month due to our special incentive pricing (see item y (pricing) under special conditions). 2. The City of Miami Purchasing Department informed us that they will not be awarding the purchase section of the copier Type D bid, because they feel that it is not in the best interest of the City. In reality, the opposite is true. The purchase option for the EK 235 is by far the best financial alternative for the City, for the following reasons: , A. The EK 235 is a copier -duplicator, with a guaranteed service availability of seven years. Most customers keep this type of equipment at least five' fi years. `The enclosed spreadsheet (see attachment) clearly shows the significant financial advantages the City would enjoy with the purchase option, especially in .the;:. ' 4 and 5 year cost period. B. The copy charges in the purchase option are about half the cast of the copy charges of the rental copy charges from either vendor. This fact becomes significant for any department making more than 65,000 copies/month. For eatample, a department making 100,000 capies/month would save $5M in copy charges over ; _ three years vs. the Xerox rental bid. r t �t� C. The EK 235 is a copier -duplicator, similar in ma financial j many characteristics to the Xerox 9900 which u purchased for your Print Shop. A conservative estimate would value the 235 at about $10,000-515,000 in three years. Compare this tothc.value of either S g is machine on rental at the end of the three year contract. "'r> l 3. The bid's special conditions on page 2 of 6 state that the equipment must lm —� new. It is widely known in the copier industry that the Xerox Corporation no IQngctc makes new model 1090's.
