AN EMERGENCY ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "ORANGE BLOSSOM CLASSIC" (1990-1991), APPROPRIATING FUNDS FOR THE SAME IN THE AMOUNT OF $250,000 FROM THE STATE OF FLORIDA, DEPARTMENT OF COMMERCE, DIVISION OF ECONOMIC DEVELOPMENT, TO PROMOTE THE 1990 AND 1991 ORANGE BLOSSOM CLASSIC; AND AUTHORIZING THE CITY MANAGER TO ACCEPT THE AFOREMENTIONED GRANT AND ENTER INTO THE NECESSARY CONTRACT AND/OR AGREEMENT WITH THE STATE OF FLORIDA; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the legislature of the State of Florida has made an appropriation for a grant in the amount of $250,000 in item 236A, Section 1, of the 1990-91 General Appropriations Act and Summary Statement of Intent; and WHEREAS, the aforementioned funds shall be utilized to promote the 1990 and 1991 Orange Blossom Classic activities; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: ORANGE BLOSSOM CLASSIC (1990-1991) RESOURCES: STATE OF FLORIDA DEPARTMENT OF COMMERCE DIVISION OF ECONOMIC DEVELOPMENT $250,000 APPROPRIATION: ORANGE BLOSSOM CLASSIC (1990-1991) $250,000 Section 2. The herein Special Revenue Fund is established to promote the 1990 and 1991 Orange Blossom Classic. Section 3. The City Manager is hereby authorized to accept the grant as set forth in the preamble to this ordinance and to enter into the necessary contract and/or agreement with the State of Florida to accept this grant ,which is to be implemented in accordance with provisions established by Resolution*of.the City Commission. *Resolution 90-681 10778 Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 6. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to made the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 7. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four. -fifths of the members of the Commission. Section 8. Odio City Manager RECOMMENDATION: DATE : FILE AU0i.31990 SUBJECT : Emergency Ordinance State of Florida Grant for. the Orange Blossom Classic REFERENCES: ENCLOSURES :Commission Agenda Item September 7, 1990 It is respectfully recommended that the City Commission adopt the attached emergency ordinance appropriating $250,000 from the State of Florida 1990-91 General Appropriation Act, to be utilized for the promotion of the Orange Blossom Classic. BACKGROUND: The Department of Community Development has prepared the appropriate legislation in order to appropriate a pass -through grant of $250,000 from the State of Florida, Department of Commerce, specifically designated for the purpose of promoting the 1990 and 1991 Orange Blossom Classic game, parade and festivals. This Ordinance is being presented as an emergency ordinance in order to enable the City to release the funds promptly to the organizers of the Orange Blossom Classic Committee to reimburse them for expenses already incurred in connection with the promotion of the 1990 Classic. The State of Florida has advised Community Development staff that the agreement will be forwarded to the City for execution by the end of August. This year., due to new regulations, the State will not release the full, amount of the grant as an advance. One quarter of the grant (25%) will be released to the City upon execution of the agreement with the State. The second and third quarter releases are anticipated respectively in September. and December. 1990. The fourth quarter releases will be made monthly beginning in March of 1991.
