AN EMERGENCY ORDINANCE AMENDING SECTION ONE OF ORDINANCE NO. 10642, ADOPTED SEPTEMBER 28, 1989, AS AMENDED, THE CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE, BY ESTABLISHING THE NEW CAPITAL IMPROVEMENT PROJECT ENTITLED "UNDERGROUND STORAGE TANK RETROFITTING", PROJECT NO. 311009, IN THE AMOUNT OF g 185,000 FROM VARIOUS FUNDING SOURCES AS SET FORTH HEREIN; CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. WHEREAS, the City Commission adopted Ordinance No. 10642 on September 28, 1989, to establish appropriations for capital Improvements, continue previously approved capital Improvement projects,,and establish new capital Improvement projects to begin during fiscal year 1989-90; and WHEREAS, there exists an emergency need to remove and/or retrofit existing underground storage tanks, operated by various City departments, which have been Identified as active sources of contamination; and WHEREAS, In order to comply with Federal, State and local regulations governing the operation of underground tanks, the City must undertake this project at the,earliest possible date; and WHEREAS, the estlmated immediate cost of Identified emergency remedlation Is $185,000 and monies are available from various funding sources to cover said expenses; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 10775 a Section 1. Section 1 of Ordinance No. 10842, as amended, adopted September 28, 1989 Is hereby amended in the following particulars: 1/ "Section 1. The herein appropriations are hereby made for Implementation of all municipal capital Improvements of the City of Miami, Including new capital Improvement projects scheduled to begin during fiscal year 1989-1990. The herein appropriations which are hereby designated by reference to descriptive project title and number also Include appropriations for previously approved scheduled projects as well as reappropr lat Ions of prior fund appropriations. The source of revenues to support the herein appropriations Is hereby Identified by fund and project with the project appropriations and revenues therefor being set forth for seven program (I-VII) areas based upon use or functional category within said areas, as follows: I. GENERAL GOVERNMENT GENERAL GOVERNMENT A. CAPITAL PROJECTS a. 13. UNDERGROUND STORAGE TANK RETROFITTING 311009 TOTAL APPROPRIATIONS ($ X000) $ 185.0 (a) $ 65.0 - SUPERFUND GRANT (b) $ 100.0 - 1970 POLLUTION CONTROL BOND AUTHORIZATION GS (c) $ 20.0 - MIAMI SPRINGS GULF COURSE RETAINED * 11 Section 2. All ordinances, or parts of ordinances Insofar as they are Inconsistent or In conflict with provisions of this ordinance are hereby repealed. Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now In effect and remain unchanged. Asterisks indicate omitted and unchanged material. All figures are rounded to the nearest hundred dollars. -2- 10775 Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance Is declared Invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary payments to generally carry out the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 6. Odio ENCLOSURES: City Manager RECOMMENDATION: It Is respectfully recommended that the City Commission adopt the attached emergency ordinance amending the Capital Improvement Appropriations Ordinance No. 10642 by establishing the new project entitled "Underground Storage Tank Retrofitting", C.I.P. No. 311009. BACKGROUND: The Department of Public Works, with the assistance of the Capital Improvement Manager, Is recommending the adoption of the attached emergency ordinance establishing the new capital Improvement project entitled "Underground Storage Tank Retrofitting". Various regulatory agencies have Informed the City that most of the City's 57 underground fuel storage tanks do not comply with current Federal, State and local regulations. Additionally, several of the City's tanks have already been identified as active sources of soil and groundwater contamination. These tanks must be replaced or retrofitted as soon as possible. The establishment of this new project and the appropriation of funds will enable the Department of Public Works to coordinate and expedite the tank retrofitting and bring the City's tank farm Into compliance with current regulations. The estimated Immediate cost for this emergency remedlation Is $220,000, available from various funding sources as set forth in the emergency ordinance. The locations that will be given top priority are the Miami Springs Golf Course and the City's Heavy Equipment Facility. The Miami Springs Golf Course fuel tank Is located close to one of three wells used to provide drinking water to a large portion of Dade County. At the Heavy Equipment Facility (H.E.F.), several fuel tanks are already leaking. Tank replacement at the H.E.F. should proceed as soon as a site contamination assessment Is completed. 10775
