RESOLUTION NO A RESOLUTION REVERSING THE DECISION OF THE ZONING BOARD TO DENY THE APPEAL, THEREBY REVERSING THE DETERMINATION OF USE OF THE PLANNING DIRECTOR, DATED FEBRUARY 22, 19901 CONCERNING THE SERVING OF MEALS NOT PREPARED ON PREMISES AND FREE TO RECIPIENTS AT A HOUSE OF WORSHIP WITH AN ASSEMBLY HALL, BY SPECIAL EXCEPTION WHEN LOCATED IN THE CR-1 ZONING DISTRICT. WHEREAS, the Miami Zoning Board at its meeting of May 21, 1990, Item No. 1, adopted Resolution ZB 50-90 by a five to four (5-4) vote, denying the appeal and thereby upholding the Determination of Use of the Planning Director, dated February 22, 1990, and WHEREAS, the Miami Coalition for Care to the Homeless and others have taken an appeal to the City Commission from the Zoning Board's decision; and WHEREAS, the City Commission, after careful consideration of this matter, and notwithstanding the decision of the Zoning Board, finds that the Determination of Use of the Planning` Director, dated February 22, 1990, fails to meet the applicable requirements of the Zoning Ordinance; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. I feel the city should be expressing gratitude to the hundreds of people who have been routinely giving up leisure time -and early morning sleep to keep these programs: going.
