A RESOLUTION REVERSING THE
DECISION
OF THE
ZONING BOARD TO DENY THE
APPEAL,
THEREBY
REVERSING THE DETERMINATION
OF USE
OF THE
PLANNING DIRECTOR, DATED FEBRUARY
22, 19901
CONCERNING THE SERVING OF MEALS NOT
PREPARED
ON PREMISES AND FREE TO RECIPIENTS AT A HOUSE
OF WORSHIP WITH AN ASSEMBLY HALL, BY SPECIAL
EXCEPTION WHEN LOCATED IN THE CR-1 ZONING
DISTRICT.
WHEREAS, the Miami Zoning Board at its meeting of
May 21, 1990, Item No. 1, adopted Resolution ZB 50-90 by a five
to four (5-4) vote, denying the appeal and thereby upholding the
Determination of Use of the Planning Director, dated
February 22, 1990, and
WHEREAS, the Miami Coalition for Care to the Homeless and
others have taken an appeal to the City Commission from the
Zoning Board's decision; and
WHEREAS, the City Commission, after careful consideration of
this matter, and notwithstanding the decision of the Zoning
Board, finds that the Determination of Use of the Planning`
Director, dated February 22, 1990, fails to meet the applicable
requirements of the Zoning Ordinance;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The appeal from the decision of the Zoning
Board to uphold the Planning Director's Determination of Use,
dated February 22, 1990, concerning the serving of meals not
prepared on premises and free to recipients at a house of worship
with an assembly hall, by special exception, when located it the,

By' he third week in May the Zoning Hoard of the
City of Miami will be making a decision on a change in policy
which will have an effect throughout the city, not just in the case
which has caused the matter to be brought to the board's
attention. The policy affects all the churches and the
synagogue within the city's boundaries which have undertaken to
be of assistance to homeless and hungry PeoPie in their
immediate neighborhoods.

aware that if all programs such as this were to cease to
it would irease the pressure on city resources to
exist nc
take their place and ,would contribute to unrest and tension
that could make the atmosphere much worse than it is now if
the city found itself unable to rep;ace the volunteer
service programs.
I feel the city should be expressing gratitude
to the hundreds of people who have been routinely giving up
leisure time -and early morning sleep to keep these programs:
going. While no special award or.certificate program is
`indicated, stSl-the city should be see}cing out ways to affizm
and assist in such functions, not ordaining procedures that
would dismantle and deny the activitiesalready in existence.`

We believe it is within the mission of the church or synagogue to' feed the
hungry, and that no house of worship should be required-to_obtain special
permission. from the city to do so.
We sincerely hope that you agree with us that the new zoning determination is

gogues, along with the Ci-61 and the County to find mutually acceptable methods
