ORDINANCE NO.
AN ORDINANCE, WITH ATTACHMENT, RELATED TO
TAXATION, DEFINING AND DESIGNATING THE
TERRITORIAL LIMITS OF THE DOWNTOWN
DEVELOPMENT DISTRICT OF THE CITY OF MIAMI,
FLORIDA; FIXING THE MILLAGE AND LEVYING TAXES
IN SAID DOWNTOWN DEVELOPMENT DISTRICT FOR THE
FISCAL YEAR BEGINNING OCTOBER 1, 1990, AND
ENDING SEPTEMBER 30, 1991, AT FIVE -TENTHS
(.5) MILLS ON THE DOLLAR OF THE NONEXEMPT
ASSESSED VALUE OF ALL REAL AND PERSONAL
PROPERTY IN SAID DISTRICT; PROVIDING THAT
SAID MILLAGE AND THE TAXES LEVIED HEREIN
SHALL BE IN ADDITION TO THE FIXING OF THE
MILLAGE AND THE LEVYING OF TAXES WITHIN THE
TERRITORIAL LIMITS OF THE CITY OF MIAMI AS
REFLECTED IN THE CITY'S MILLAGE-LEVY
ORDINANCE FOR THE AFORESAID FISCAL YEAR WHICH
IS REQUIRED BY CITY CHARTER SECTION 27;
PROVIDING THAT THE FIXING OF THE MILLAGE AND
LEVYING OF TAXES HEREIN SHALL BE IN ADDITION
TO SPECIAL ASSESSMENTS; PROVIDING THAT THIS
ORDINANCE SHALL NOT BE DEEMED AS REPEALING OR
AMENDING ANY OTHER ORDINANCE FIXING MILLAGE
OR LEVYING TAXES BUT SHALL BE DEEMED
SUPPLEMENTAL AND IN ADDITION THERETO;
CONTAINING A REPEALER PROVISION, SEVERABILITY
CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Tax Assessor of Dade County, Florida, a
political subdivision of the State of Florida, has determined the
nonexempt aggregate valuation of taxable property, real and
personal, in the Downtown Development District of the City of
Miami to be $3,111,232,334;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI,.FLORIDA:
Section 1. For the purpose of this Ordinance the "DOWNTOWN
DEVELOPMENT DISTRICT" is defined as that area within tha
territorial limits of the "City of Miami" as it now exists, with
the boundaries thereof being designated in City of Miami
Ordinance No. 7370, as amended by Ordinance No. 10575, and more
specifically described on Exhibit "A," attached hereto.
Section 2. There shall be and is hereby levied upon the
nonexempt assessed value of all property, both real and personal,

in the Downtown Development District as described in Section 1
hereof, taxes at a rate shown below for the fiscal year beginning
October 1, 1990, and ending September 30, 1991, for the following
purpose:
A tax of five -tenths (.5) mills on the dollar
for the purpose of financing the operation of
the Downtown Development Authority of the
City of Miami.
Section 3. This proposed millage rate herein adopted by the
governing body exceeds the rolled back rate by zero percent (0%).
This rate is determined by calculating the percentage increase
between the Fiscal Year 1990 rolled back revenue and the Fiscal
Year 1991 estimated revenue for the Downtown Development
Authority.
Section 4. The fixing of the millage and levying of taxes
in this Ordinance shall be in addition to the fixing of the
millage and levying of taxes within the territorial limits of the
City of Miami as reflected in the millage-levy ordinance for the
aforesaid fiscal year which is required by Section 27 of the City
Charter.
Section 5. The fixing of the millage and the levying of
taxes in the Downtown Development District, as provided in this
Ordinance, shall be in addition to the special assessments for
improvements imposed by the City Commission within the
territorial limits of the City of Miami.
Section 6. This Ordinance shall not repeal or amend any
other ordinance fixing millage or levying taxes for the fiscal
year beginning October 1, 1990, and ending September 30, 1991 but
shall be deemed supplemental and in addition thereto.
Section 7. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 8. if any section, part of this section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 9. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

Fiscal Year 1990-1991 Budget
Downtown Development Authority
At its meeting of September 26, 1990, the Board of Directors of
the Downtown Development Authority considered your request to
amend the DDA's Fiscal Year 1990-1991 Budget to include funding
for the Miami Film Festival and a Homeless Coordinator.
In response to your request, the DDA Board passed Resolution
Number 22/90 amending the proposed Budget for Fiscal Year 1990-
1991 to include an allocation of $20,882 to be applied towards
50% of the salary of the Homeless Coordinator.
The DDA Board respectfully recommends that the Homeless
Coordinator be provided an office with the Downtown Miami
Business Association (DMBA) and that the activities of the
Homeless Coordinator be coordinated under the DMBA with input
from the City Commission and the DDA.
After meeting with Miami Film Festival staff and consideration of
existing budget commitments to implement DDA initiated projects
for the next fiscal year, the DDA regrets that it is unable to
provide funding for the Miami Film Festival.
However, the DDA Board of Directors did pass Resolution Number
23/90 providing "in kind" services and DDA staff assistance to
the Miami Film Festival in lieu of financial support.
It is respectfully requested that the City of Miami Commission
approve the Proposed Budget of the Downtown Development Authority
for Fiscal Year 1990-1991 with the above considerations.

Section 2. Said appropriations are the anticipated
expenditure requirements for the Downtown Development Authority
but are not mandatory should efficient administration of the
Downtown Development Authority or altered economic conditions
indicate that a curtailment in certain expenditures is necessary.
The Executive Director of the Downtown Development Authority,
with approval of the Board of Directors of the Downtown
Development Authority, is specifically authorized to withhold any
of these appropriated funds from encumbrance or expenditure
should such action appear advantageous to the economical and
efficient operation of the Downtown Development Authority.
Section 3. The Executive Director of the Downtown
Development Authority, with the approval of the Board of
Directors of the Downtown Development Authority, is authorized to
make transfers between the detailed accounts comprising any of
the amounts appropriated by Section 1. hereof, in order that
available and required balance in any such account may be used
for other necessary and proper purposes.
Section 4. The Executive Director of the Downtown
Development Authority is hereby authorized to invite or advertise
for bids for the purpose of any material, equipment or services

A RESOLUTION OF THE BOARD OF DIRECTORS OF
THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE
CITY OF MIAMI; DIRECTING THE STAFF OF THE
DOWNTOWN DEVELOPMENT AUTHORITY TO PROVIDE
"IN KIND" SERVICES AND STAFF ASSISTANCE
TO THE MIAMI FILM FESTIVAL.
WHEREAS, the City of Miami Commission has requested that the
Board of Directors of the Downtown Development Authority of the
City of Miami consider funding of the Miami Film Festival in its
Fiscal Year 1990-1991 Budget; and
WHEREAS, the Board of Directors and staff of the Downtown
Development Authority has determined that funds from the Fiscal
Year 1990-1991 Budget are not available to fund the Miami Film
Festival; and
WHEREAS, the Board of Directors of the Downtown Development
Authority recognizes the importance of the Miami Film Festival to
Downtown and the Greater Miami Community;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA:
Section 1. The Board of Directors of the Downtown
Development Authority agrees to provide "in kind" services and
staff assistance to the Miami Film Festival.

Recommendation

Background `
Chapter 14 of the City of Miami Code authorizes the City
Commission to levy an additional ad valorem tax on all real and
personal property in the Downtown Development Authority district,
not exceeding five tenths (.5) mills on the dollar valuation of
such property, for the purpose of financing the operation of the
Downtown Development Authority.
Attached are ordinances for City Commission approval which
establish the Downtown Development Authority special tax district
boundaries, fixes the millage, levies the taxes and makes
appropriations for the fiscal year beginning October 1, 1990 and
ending September 30, 1991.
