AN ORDINANCE AMENDING ORDINANCE 11000, AS AMENDED, THE NEW ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA (EFFECTIVE SEPTEMBER 4, 1990), BY AMENDING ARTICLE 9, GENERAL AND SUPPLEMENTARY REGULATIONS, SECTION 907, LOT, YARDS AND RELATED TERMS; DEFINITIONS, METHODS FOR MEASUREMENT; GENERAL REQUIREMENTS AND LIMITATIONS, BY ADDING NOISE LIMITATIONS TO SECTION 907.4 YARDS, GENERAL LIMITATIONS ON OCCUPANCY; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of April 4, 1990, Item No. 3, following an advertised hearing adopted Resolution No. PAB 18-90 by a vote of 9 to 0, RECOMMENDING APPROVAL of amending Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 11000, as amended, the new Zoning Ordinance of the City of Miami, Florida, to become effective September 4, 1990, is amended in the following respects: .1/ "ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS Sec. 907. Lot, yards, and related terms; definitions; methods for measurement; general requirements and limitations. Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. 110,7.� 907.4. Yard, general limitations on 000upanoy. Fenoes and walls may be permitted in any yard subjeot to height limitations established herein, and further provided that poles, posts, and other customary yard aooessories, ornaments, and furniture shall be permitted in any required yard if they do not constitute substantial impediments to free flow of -2- 10792 Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. Consideration of amending Ordinance 11000, as amended, the new Zoning Ordinance of the City of Miami, as amended, to be effective September 4, 1990, by amending Article 9. General and Supplementary Regulations, subsection 907.4 Yard, General Limitations on Occupancy, by adding noise limitations for mechanical and fire equipment for the purpose of attenuating noise. (This item is similar to a recent corresponding amendment to Zoning Ordinance 9500, which will expire September 3, 1990.) REQUEST To institute distance requirements and noise level parameters for the purpose of attenuating noise from mechanical and fire equipment. RECOMMENDATION PLANNING DEPARTMENT Approval, BACKGROUND This proposal addresses an omission in the zoning ordinance. It does not have separation requirements so that plans examiners can examine construction drawings for the proper Placement of mechanical equipment. ANALYSIS These proposed auandments to Zoning L:dinance 11000 will: ft Require that mechanical and fire equipment in commercial and industrial districts where yards. are required, be installed 10' from adjacent property lines and riot within the Yard or setback. Where no setback is required and the building is built at the Property line, such equipment shall be located at least 10' vertically from grade and discharged vertically. • Require that mechanical equipment and fire equipment in residential districts be installed on walls, roof or windows or in the rear yard only if at least 10' from adjacent property lines. 10792 • PLANNING ADVISORY BOARD At its meeting of April 49 19909 the Planning Advisory Board adopted Resolution PAB 18-90 by a 9-0 vote, recommending approval of the above.
