ORDINANCE NO.
AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, AS AMENDED, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY
CHANGING THE ZONING CLASSIFICATION FROM RS-
2/2 ONE FAMILY DETACHED RESIDENTIAL TO SPI-2
COCONUT GROVE CENTRAL COMMERCIAL DISTRICT FOR
THE PROPERTY LOCATED AT 3560 MAIN HIGHWAY
MIAMI, FLORIDA, (MORE PARTICULARLY DESCRIBED
HEREIN) AND BY MAKING ALL THE NECESSARY
CHANGES ON PAGE NO. 46 OF SAID ZONING ATLAS;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of
March 5, 1990, Item No. 3, following an advertised hearing,
adopted Resolution No. ZB 25-90, by a six to two (6-2) vote,
RECOMMENDING APPROVAL of a change of zoning classification, as
hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, as
amended, the Zoning Ordinance of the City of Miami, Florida, is
hereby amended by changing the zoning classification from RS-2/2
One Family Detached Residential to SPI-2 Coconut Grove Central
Commercial District for the property located at 3560 Main Highway
Miami, Florida, also described as a parcel known as the "Old
House" site and more particularly described as beginning at a
pipe set in the Northwesterly line of Main Highway, formerly
known as County Road, which pipe is North 45 degrees West a
distance of 186.5' from a pipe in concrete in a rock wall marking
the Southeast corner of the Northeast 1/4 of the Southwest 1/4 of
Section 21, Township 54 South, Range 41 East, Dade County,
Florida, said Southeast corner being the so-called agreed corner

referred to in an instrument and marked on a Plat recorded in
Deed Book "D", Page 251 to 253 of Dade County Public Records;
thence proceed North 45 degrees 31 minutes 45 seconds West 108.20
feet to a point on the South line of Franklin Avenue; thence
proceed North 89 degrees 39 minutes 00 seconds East along the
said South line of Franklin Avenue 145,15 feet to its
intersection with the Northwesterly line of Main Highway, as it
now exists, thence proceed South 41 degrees 32 minutes 15 seconds
West along said Northwesterly line of Main Highway, 102.451 to
the Point of Beginning; the enclosed triangle containing portions
of Lots 2, 3, 4, and an un-named street as shown in Roberts
subdivision of the Frow Homestead and recorded in Plat Book A,
Page 21, of the Public Records of Dade County, Florida.
Section 2. It is hereby found that this zoning
classification change:
(a) is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) is not contrary to the established land use pattern;
(c) will not create an isolated district unrelated to
adjacent and nearby districts;
(d) is not out of scale with the needs of the neighborhood
or the City;
(e) will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) is necessary due to changed or changing conditions;
(g) will not adversely influence living conditions in the
neighborhood;
(h) will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) will not create a drainage problem;
(j) will not seriously reduce light and air to adjacent
area;
(k) will not adversely affect property values in the
adjacent area;

(1) will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; and
(m) will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare.
Section 3. Page No. 46 of the Zoning Atlas, made a part of
Ordinance No. 9500, as amended, by reference and description of
said Ordinance, is hereby amended to reflect the changes made
necessary by these amendments.
Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.

DENIAL. The proposed change is contrary to cne
Future Land Use Element if the 'Miami
Comprehensive Neighborhood Plan J989-2000 (MCNP)
designation of Single Family Residential. There
is a companion item being presented to the
Plan=g Advisory Board requesting a change in
the land use designation of the subject property
to Commercial Restricted, :rhich is also being
recommended for denial. av the ?tanning
Deoar tent.
The proposed change :s contrary =o the
established land use pattern, even though the
lots tihe pack f :he lsxiscin¢ Taurus
Restaurant are being used for an otfstreet
parking facility, the proposed change would be
an intrusion into the residuacsal area.
Included in this application there is a recently
built single ramify structure on 3560 :lain
Highway.

The present zoning change request from RS-2/2 to
SPI-2 should be denied as Lt would allow a more
intense commercial use to intrude into the
existing homogeneous residential neighborhood,
increasing the potential of more intense '_and
uses along Franklin Avenue, and ultimately into
the low density residential neighborhood.
The proposed :hange will increase ==affic
congestion which is already quite heavy is peak
traffic hours along ;lain Highway.
The proposed change will be a deterrent to the
improvement or development of adjacent property
in accord with existing regulations.
PUBLIC WORKS This request will not cause the existing
sanitary sewer system to -exceed. its. design. _
capacity, however, a trend of these requests
along the block may cause the existing sanitary
system to fail.
ZONING SECTION Oa ,►ugust 30, 1989 -a notice of violation and
summons to appear before the Code Enforcement
Board was issued for operating an office in a
single family residence, case number 88-286. At
the board hearing a stipulation was entered in
to comply by February 26, 1989 with a fine of
$250.00 per day for each day there after not in
compliance. The board granted several
extensions to this to allow the owner to apply
for a zoning change.

ZONING BOARD At its meeting of March 3; 1990; the
Zoning Board adopted Resolution ZB 2S-90
by a 6-2 vote; recommending approval of
the above.
Three replies in favor received by mail.
Twenty-two proponents and ten opponents
were present at this meeting.
CITY COMMISSION At its meeting of April 26, 1990, the City
Commission passed the above on First Reading,
for the triangle property located at approxi-
mately 3560 Main Highway only.

DECLARATION OF RESTRICTIONS
This is a Declaration of Restrictions (the "Declara-
tion") made this
day
of
March,
1990
by David Hill
and
Christine Hill (the
"Owners")
in
favor
of The
City of Miami
(the
"City").
The Owners are the owners of the real property legally
described on Exhibit "A" attached to this Declaration .(the
"Property"). The Owners desire to develop the Property in a
manner compatible with the surrounding properties and in order to
ensure that such compatible development does in fact occur, the
Owners make the following Declaration of Restrictions covering
and running with the Property:
1. Limitation on Use. Notwithstanding the SPI-2
zoning classification on the Property, the use of the Property
shall -be limited to professional office uses, including, but not
Limited to, the following office uses: medical, legal, real
estate, financial, commercial and similar office uses.
2. Binding Effect. The restrictions set forth in
this Declaration during their lifetime shall be for the benefit
of, and limitation upon, all present and future owners of the
Property and for the public welfare. This Declaration on the
part of the Owners shall constitute a covenant running with the
land and may be recorded in the public records of Dade County,
Florida, and shall remain in full force and effect and be binding

upon the Owners, their heirs, successors and assigns until such
time as it is modified or released.
3. Term. This Declaration is to run with the
Property and shall be binding on all parties and persons claiming
under them.for a period of thirty (30) years from the date it is
recorded, after which time it shall be extended automatically for
successive periods of ten (10) years, unless an instrument signed
by a majority of the then owner(s) of the Property has been
recorded agreeing to change the Declaration in whole, or in part,
provided the Declaration has first been released.by the City.
4. Modification. This Declaration may be modified,
amended or released as to the Property or any portion thereof, by
the owner(s) of the fee simple title to the portion of the
Property to be affected by such modification, amendment or
release provided that the same is also approved by the City
Commission or City Zoning Board (whichever by law has
jurisdiction over such matters) after public hearing. Should
this Declaration be so modified, amended or released the Director

instrument effectuating and acknowledging such modification
amendment or release.
Notwithstanding the foregoing, no request to
modify paragraph 1 of this Declaration shall be considered by the
City until 75% of the residential property owners within 375 feet
of the Property have provided written consent to such
modification.

5. Enforcement. Enforcement shall be by action at
law or in equity against any party or persons violating or
attempting to violate any covenants contained in this
Declaration, either to restrain violation or to recover damages.
The prevailing party in such action or suit, shall'be entitled to
recover, in addition to costs and disbursements allowed by law,
such sum as the court may adjudge to be reasonable for the
services of his attorney. Enforcement may be exercised by the
City or other property owner within 375 feet of the Property.
6. Severability. Invalidation of any one of the
provisions of this Declaration by judgment of court shall not
affect any of the other provisions, which shall remain in full
force and effect.
