ORDINANCE NO.
AN ORDINANCE RELATING TO PLANNING AND ZONING,
AMENDING CHAPTER 62 OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED, BY AMENDING
SECTION 62-84(1) BY CHANGING THE COMPOSITION
OF THE URBAN DEVELOPMENT REVIEW BOARD; BY
DELETING PROCEDURES FOR APPOINTMENT TO SAID
BOARD CONTAINED IN SECTION 62-84(2) RELATIVE
TO PUBLIC NOTICE AND SOLICITATION; BY
AMENDING SECTION 62-84(4) ACCORDINGLY;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission adopted Ordinance No. 10674 on
November 30, 1989, establishing an Urban Development Review
Board, and providing for the functions, power, duties and
membership criteria of said board; and
WHEREAS, the City Commission, at its meeting of
February 7, 1990, Item No. 18, while attempting to make initial
appointments to said board, found the appointment procedures to
be cumbersome and time-consuming, and indicated that it desired
the elimination of membership appointment publication
requirements and related membership procedures found in the
pertinent section(s) of Chapter 62; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to adopt
this amendment as hereinafter set forth;
NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Chapter 62 of the Code of the City of Miami,
Florida, as amended, is hereby amended in the following
particulars:l/

remaining provisions are now in effect and remain unchanged.

"CHAPTER 62
ZONING AND PLANNING
ARTICLE IX. URBAN DEVELOPMENT REVIEW BOARD
Sec. 62-84. Membership.
The Urban Development Review Board shall consist of
nine (9) members and one (1) alternate, to be appointed
by the City Commission.
(1) Qualifications. It is intended that members
of the Urban Development Review Board shall
be persons of knowledge, experience, mature
judgment and background, having ability,
special professional training and interest to
act in the public interest in order to make
informed and equitable decisions concerning
architecture, urban, physical and site
design. To that end, qualifications of board
members shall be as follows:
(a) At least five (5) members shall be
architects registered in the State of
Florida. Each member shall have had
five (5) years of experience after
registration in the practice of his
profession.
(b)
Four (4) other members shall be either,
architects or landscape
architects
registered in the State of
Florida,
and
shall meet the same criteria
as
subparagraph (a), above.
(c)
The alternate member shall
satisfy
the
qualifications set forth in
paragraphs
(et) or ( b) , above.
During the qualification
process,
professional organizations
such as
the
American Society of Architects
and
the
American Society of
Landscape
Architects shall be encouraged
to
submit names of persons
and their
qualifications to the City
Commission
through the City Manager.

Terms of office. Members of the Urban
Development Review Board shall be appointed
for three year terms, except that members of
the first board appointed under this article
shall be appointed as follows: four (4)
members for a term of three (3) years, three
(3) members for a term of two (2) years, and
two (2) members and one (1) alternate member
for a term of one (1) year. Notwithstanding
the above, individual members may serve until
their successor is appointed and qualified.

After the initial term of appointment, no

member of the board shall be reappointed to
more than two (2) consecutive terms,
thereafter.

Vacancies. Vacancies in the membership of
the Urban Development Review Board shall be
filled by the City Commissioner in
above,Set fOrbit ill SubSeCtiOn (2) and shall
be only for the unexpired term of the member
affected.

Removal. Members of the Urban Development
Review Board may be removed for cause by vote
of not less than three (3) members of the
City Commission; however, whenever a member
has had within a calendar year, three (3)
absences from regularly scheduled meetings,
the chairman shall certify same to the City
Commission. Three (3) instances of arriving
ten (10) minutes after the scheduled
beginning time or leaving before the
termination of the last agenda item at a
regularly scheduled meeting of the board
counts as one (1) absence. Upon such
certification, the member shall be deemed to
have been removed and the City Commission
shall fill the vacancy pursuant to subsection
t4t . 3, above.
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.

Section 3. If any part of section, paragraph, clause,
phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty
(30) days after adoption thereof.

RECOMMENDATION:
It is requested that the City Commission approve amendments to Chapter 62
Planning and Zoning of the City Code, Section 62-84, by changing the
composition of the Urban Development Review Board and deleting' public -notice -
and solicitation procedures, per the attached ordinance.
BACKGROUND:
The Urban Development Review Board was reconstituted by Ordinance 10674,
November 30, 1989. On February 7, 1990, while attempting to make initial
appointments, the City Commission found the procedures to be cumbersome and
time-consuming and indicated their desire to eliminate prior publication of
vacancies and public notice of candidates' qualifications.
These amendments have been prepared for the purpose of providing greater
flexibility and to expedite Board appointments.
These amendments would:
1. Recast the composition of the Board to require a minimum of 5
architects; the remaining 5 could be either architects or landscape
architects.
2. Eliminate the 30-day public notice of vacancies and 5-day public
notice of candidates' names and qualifications.
