AN ORDINANCE AMENDING THE ZONING ATLAS OF ORDINANCE NO. 11000 (EFFECTIVE SEPTEMBER 4, 1990), THE NEW ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION OF A 19 FOOT STRIP OF LAND ABUTTING APPROXIMATELY 1701-1991 DELAWARE PARKWAY, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN), FROM R-1 SINGLE FAMILY RESIDENTIAL AND 0-OFFICE TO C2-LIBERAL COMMERCIAL, AND RETAINING A 1 FOOT STRIP NORTHEASTERLY OF, PARALLEL TO AND ABUTTING, THE NORTHEASTERLY RIGHT-OF-WAY LINE OF DELAWARE PARKWAY IN THE EXISTING R-1 AND 0 ZONING; BY MAKING FINDINGS; AND BY MAKING ALL NECESSARY CHANGES ON PAGE NUMBER 26 OF SAID ZONING ATLAS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board at its meeting of April 18, 1990, Item No. lb, following an advertised public hearing, adopted Resolution No. PAB 20-90, by a 8 to 0 vote, RECOMMENDING APPROVAL of the request to amend the Zoning Atlas as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend the zoning atlas as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning (Effective September 4, 1990), Atlas of Ordinance No. 11000 the new Zoning Ordinance of the City of Miami, Florida, is hereby amended by changing the zoning classification of a strip of land 19 feet in width, lying northeasterly of, parallel to and 1 foot from, the northeasterly right-of-way line of Delaware Parkway, comprising portions of the following: Parcel "A", Tracts "D" and "E", DADE REAGENTS, according to the plat thereof, as recorded in Plat Book 70 at Page 56 of the Public Records of Dade County, Florida and Tract "F", DELAWARE PARK SECTION ONE, according to the plat thereof, as i recorded in Plat Book 40 at Page 17 of the Public Records of Dade 10786 County Ca complete legal description on file with the hearing Boards Office, City of Miami Building and Zoning Department), from R-1 Single Family Residential and O-Office to C-2 Liberal Commercial, and retaining a 1 foot strip northeasterly of, parallel to and abutting, the northeasterly right-of-way line of Delaware Parkway in the existing R-1 and 0 zoning, of property located at approximately 1701-1991 Delaware Parkway, Miami, Florida. Section 2. It is hereby found that this zoning classification change: a. is in conformity with the adopted Miami Comprehensive Neighborhood Plan and does not require a plan amendment; b. Is in harmony with the established land use pattern; o. Is related to adjacent and nearby districts; d. Is not out of scale with the needs of the neighborhood or the City; e. Maintains the same or similar population density pattern and thereby does not increase or overtax the load on public facilities such as schools, utilities, streets, eto.; f. Existing district boundaries are illogically drawn in relation to existing conditions on the property proposed for change; g. Is necessary due to changed or changing conditions; h. Positively influences living conditions in the neighborhood; i. Has the same or similar impact on traffic and does not affect public safety to a greater extent than the existing classification; J. Has the same or similar impact on drainage as the existing classification; -2- 10786 k. Has the same or similar impact on light and air to adjacent areas as the existing classification; 1. Has the same or similar impact on property values in the adjacent areas as the existing classification; M. Will contribute to the improvement or development of adjacent property in accord with existing regulations; n. Conveys the same treatment to the individual owner as to owners within the same classification and the immediate area and furthers the protection of the public welfare; and o. There are substantial reasons why the use of the property is unfairly limited under existing zoning. Section 3. Page No. 26 of the Zoning Atlas, made a part of Ordinance No. 11000 by reference and description in Article 3, Section 300 thereof, is hereby amended to reflect the changes made necessary by this amendment. Section 4. All ordinances or 'parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. REOUEST To reduce a 20 foot buffer strip to 1 foot. 10786 RECOMMENDATION PLANNING DEPARTMENT Approval. BACKGROUND In 1965, a ZO foot buffer was created to separate the general con iarcial uses from the residential uses west of Delaware Parkway, and to prevent additional access from Delaware Parkway for shipping and receiving activities. ANALYSIS This proposal will still retain a buffer, albeit one foot, which will generally prevent property owners to the west from applying for con, rcial zoning by reason of contiguity. However, this proposal will more the zoning envelope 19 feet closer to Delaware Parkway. While there is no height limit per se, the height limit is governed by an inward sloping light plane commencing at the setback_ line and- rising 12 feet and sloping 63 inward. Exterior wails could be placed as close as 6 feet to the northeasterly right-of-wav of Delaware Parkway. PLANNING ADVISORY BOARD At its meeting of April 18, 1990, the Planning Advisory Board adopted Resolution PAB 20-90 by an 8-0 vote; recommending approval of the above. Two OPPONENTS were present at the meeting; one PROPONENT was present at the meeting. Seven replies AGAINST were received by mail.
