AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY
CHANGING THE ZONING CLASSIFICATION OF A 19
FOOT STRIP OF LAND ABUTTING APPROXIMATELY
1701-1991 DELAWARE PARKWAY, MIAMI, FLORIDA
(MORE PARTICULARLY DESCRIBED HEREIN), FROM
RS-2/2 ONE FAMILY DETACHED RESIDENTIAL AND
RO-3/6 RESIDENTIAL OFFICE TO CG-2/7 GENERAL
COMMERCIAL, AND RETAINING A 1 FOOT STRIP
NORTHEASTERLY OF, PARALLEL TO AND ABUTTING,
THE NORTHEASTERLY RIGHT-OF-WAY LINE OF
DELAWARE PARKWAY IN THE EXISTING RS-2/2 AND
RO-3/6 ZONING; BY MAKING FINDINGS; AND BY
MAKING ALL NECESSARY CHANGES ON PAGE NUMBER
26 OF SAID ZONING ATLAS; CONTAINING A
REPEALER PROVISION AND SEVERABILITY CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board at its meeting of
April 18, 1990, Item No. la, following an advertised public
hearing, adopted Resolution No. PAB 19-90, by a 8 to 0 vote,
RECOMMENDING APPROVAL of the request to amend the Zoning Atlas as
hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
the zoning atlas as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF THE CITY OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
Zoning Ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of a strip of land 19 feet
in width, lying northeasterly of, parallel to and 1 foot from,
the northeasterly right-of-way line of Delaware Parkway,
comprising portions of the following: Parcel "A", Tracts "D" and
"E", DADE REAGENTS, according to the plat thereof, as recorded in
Plat Book 70 at Page 56 of the Public Records of Dade County,

Florida, and Tract "F", DELAWARE PARK SECTION ONE, according to
the plat thereof, as recorded in Plat Book 40 at Page 17 of the
Public Records of Dade County (a complete legal description on
file with the Hearing Boards Office, City of Miami Building and
Zoning Department), from RS-2/2 One Family Detached Residential
and RO-3/6 Residential Office to CG-2/7 General Commercial, and
retaining a 1 foot strip northeasterly of, parallel to and
abutting, the northeasterly right-of-way line of Delaware Parkway
in the existing RS-2/2 and RO-3/6 zoning of property located at
approximately 1701-1991 Delaware Parkway, Miami, Florida.
Section 2. It is hereby found that this zoning
classification change:
(a) is in conformity with the adopted Miami
Comprehensive Neighborhood Plan;
(b) Is not contrary to the established land use
pattern;
(o) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) Is not out of scale with the needs of the
neighborhood or the City;
(e) Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets,
etc.;
(f) Will not adversely influence living conditions in
the neighborhood;
(g) Will not create or excessively increase traffio
congestion or otherwise affect public safety;
(h) Will not create a drainage problem;
(i) Will not seriously reduce light and air to
adjacent area;
(j) Will not adversely affect property values in the
adjacent area;

(k) Will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; and
(1) Will not constitute a grant of special privilege
to an individual owner as contrasted with
protection of the public welfare.
Section 3. Page No. 26 of the Zoning Atlas, incorporated in
said ordinanoe by reference and description in Article 3, Section
300 thereof, is hereby amended to reflect the herein zoning
changes.
Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section B. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective thirtv
(30) days after final reading and adoption thereof.

REQUEST To reduce a•20 foot buffer strip to 1 foot.

RECOMMENDATION
PLANNING DEPARTMENT Approval.
BACKGROUND In 1965, a 20 foot buffer was created to
separate the general co am ial uses from the
residential uses west of Delaware Parkway, and
to prevent additional access from Delaware
Parkway for shipping and receiving activities.
ANALYSIS This proposal -will still retain a buffer, albeit
one foot, which will generally prevent property
owners to the west from applying for commercial
zoning by reason of contiguity. However, this
proposal will move the zoning envelope 19 feet
closer to Delaware Parkway. While there is no
height limit per se, the height limit is
governed by an inward sloping light plane
comencing at the sstback--line and rising 12
feet and sloping 63 inward. Exterior walls
could be placed as close as 6 feet to the
northeasterly right-of-way of Delaware Parkway.
?DINNING ADVISORY BOARD At its meeting of April 18, 1990, the
Planning Advisory Board adopted Resolution
PAS 19-90 by an 8-0 vote, recommending
approval of the above.

Dear Sirs:
We are writing to notify you that we are opposed to the proposed
rezoning of the 19' strip of land on the north easterly side of
1701-1991 Delaware Parkway from residential to commercial.
As residential property owners fronting Delaware Parkway on the west
—' side, we feel the current zoning helps restrict adjacent industrial
construction on Delaware Parkway and provides a "buffer set -back" in
the transition from an industrial environment to our residential
neighborhood.
For this reason, we are requesting that our objection be read into the
public record during the May 24, 1990 Public Hearing on this issue.
