AN ORDINANCE AMENDING THE ZONING ATLAS OF ORDINANCE NO. 11000 (EFFECTIVE SEPTEMBER 4, 1990), THE NEW ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION OF APPROXIMATELY 120-186 SOUTHWEST 13TH STREET; 1315-1325 SOUTHWEST 2ND AVENUE, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN), FROM 0-OFFICE TO C-1 RESTRICTED COMMERICAL; BY MAKING FINDINGS; AND BY MAKING ALL THE NECESSARY CHANGES ON PAGE NO. 37 OF SAID ZONING ATLAS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of April 4, 1990, Item No. 2, following an advertised hearing adopted Resolution No. PAB 17-90, by a 9 to 0 vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning (Effective September 4, 1990), Atlas of Ordinance No. 11000 the new Zoning Ordinance of the City of Miami, Florida, is hereby amended by changing the zoning classification, from 0-Office to C-1 Restricted Commercial, of property located at approximately 120-186 Southwest 13th Street; 1315-1325 Southwest 2nd Avenue, Miami, Florida, more particularly described as All of Lot 4; Lots 5 & 6 less the North 10'; and those portions of Lots 1, 2, 3, 17, 18, 19, and 20, West of the westerly right-of-way line of the Florida East Coast Railroad, and less then North 10' of said Lot 3, Block 94 S, MIAMI (A.L. Knowlton), according to the plat thereof, as recorded in Plat Book B at Page 41 of the Public Records of Dade County, Florida; 10784 W and Lots 7 V 8, less then North 10' and West 101; and all of Lot 10, Block 94 S, MIAMS HGTS, according to the plat thereof, as recorded in Plat Book 8 at Page 29 of the Public geoords of Dade County, Florida. Section 2. it is hereby found that this zoning classification change: a. is in conformity with the adopted Miami Comprehensive Neighborhood Plan and does not require a plan amendment; b. is in harmony with the established land use pattern; o. is related to adjacent and nearby districts; d. is not out of scale with the needs of the neighborhood or the City; e. Maintains the same or similar population density pattern and thereby does not increase or overtax the load on public faoilities such as schools, utilities, streets, eto.; f. Existing district boundaries are illogically drawn in relation to existing conditions on the property proposed for change; g. is necessary due to changed or changing conditions; h. Positively influences living conditions in the neighborhood; i. Has the same or similar impact on traffic and does not affect public safety to a greater extent than the existing classification; J. Has the same or similar impact on drainage as the existing classification; k. Has the same or similar impact on light and air to adjacent areas as the existing classification; 1. Has the same or similar impact on property values in the adjacent areas as the existing classification; -2- 10'7 8 4 m. Will contribute to the improvement or development of adjacent property in accord with existing regulations; n. Conveys the same treatment to the individual owner as to owners within the same classification and the immediate area and furthers the protection of the public welfare; o. There are substantial reasons why the use of the property is unfairly limited under existing zoning; and p. is difficult to find other adequate sites in the surrounding area for the proposed use in districts alreading permitted such use. Section 3. Page No. 37 of the Zoning Atlas, made a part of Ordinance No. 11000 by reference and description in Article 3, Section 300 of said Ordinance, is hereby amended to reflect the changes made necessary by this amendment. Section 4. All ordinances, code sections, or parts thereof in conflict herewith are hereby repealed insofar as they are in conflict. Section 5. Should any part or section, paragraph, clause, phrase or word of this Ordinance be declared invalid by a court of competent jurisdiction, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective forty-five (45) days after final reading and adoption thereof. PASSED ON FIRST READING BY TITLE ONLY this 26th day of July , 1990. Consideration of amending the Zoning Atlas of Ordinance 11000, as amended, the new Zoning Ordinance of the City of Miami, Florida, to be effective September 4, 19901, by changing the Zoning classification of the subject from 0- OFFICE to C-1 RESTRICTED COMMERCIAL. (This item is similar to a recent corresponding amendment to Zoning Ordinance 9500, which will expire September 3, 1990.) REQUEST To change the plan designation of the subject property from 0-OFFICE to C-1 RESTRICTED COMMERCIAL. RECOMMENDATION PLANNING DEPARTMENT Approval. BACKGROUND A Plan Amendment and Zoning Atlas Amendment to Ordinance 9500 have passed 1st reading on February 15, 1990, and have been referred to the Florida Department of Community Affairs for 90 day review. ANALYSIS The proposed change is contrary to the Mimi Comprehensive Neighborhood Plan 1989-2000 (MCNP) designation of Office. A companion item has been presented" to the PI-anni ng Advisory. -Board.. which has recommended a change in the land use .designation of the subject property to Restricted Commercial, which has been recommended for approval by the Planning 10784 Department. A zoning atlas amendment .to Ordinance 9500 has been reconwnded by the Zoning Board; both has been passed on 1st reading by the City Commission. The requested zoning change to Ordinance 11000 is a change - from 0-Office to C-1 Restricted Commercial, and involves the extension of the existing commercial district to the east -and is in harmony with the established use pattern. There have been changes along 13th Street that make the passage of the proposed change desirable. The proposed change has the same or similar impact on traffic and the load on public facilities such as schools, utilities, and streets is the same. The proposed commercial zone will serve the residential districts located generally north, south and west of the subject property. PLANNING ADVISORY BOARD: At its meeting of April 4, 1990, the -Planning Advisory Board adopted Resolution PAB 17-90, by a vote of 9-0, recommending approval of the above.
