HomeMy WebLinkAboutO-10801J-90-767 9/17/90 W ORDINANCE NO. 10801 AN ORDINANCE AMENDING ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY ADDING A NEW SECTION 620 ENTITLED "SD-20 EDGEWATER OVERLAY DISTRICT," TO ARTICLE 6. SD SPECIAL DISTRICTS; PROVIDING FOR INTENT, EFFECT, AND EXCEPTIONS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board at its meeting of September 12, 1990, Item No. 2, following an advertised public hearing, adopted Resolution No. PAB 61-90, by a vote of 8 to 0, RECOMMENDING APPROVAL of the request to amend Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended as follows:l/ "ARTICLE 6. SD SPECIAL DISTRICTS GENERAL PROVISIONS Sec. 619. SD-19: Designated F.A.R. overlay district. l/ Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Sec. 620.2.2. Exception Irrespective of minimum lot sizes of underlying districts the minimum lot size shall be 5,000 square feet. Irrespective of minimum open space requirements is the underlying districts, the lot coverage shall be limited to 60% of gross lot area. For residential uses, the front setback shall be a minimum of 20 feet; the rear setback shall be a minimum of 10 feet and the side setback shall be a minimum of 5 feet on side. For commercial uses, the front setback shall be 10 feet; the rear setback shall be 5 feet; no side setback is required. Sec, 620 2 4 Exception to height limits. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. Consideration of a .text amendment to Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami,. Florida, by adding Section 620 SD-20 Edgewater Overlay District containing provisions on Intent, Effect of SD-20. District Designation, Limitations on Lot Coverage and Setbacks and Parking Requirements. REQUEST To add the SO-20 Edgewater Overlay District to the text of Zoning Ordinance 11000. RECOMMENDATION PLANNING DEPARTMENT Approval. BACKGROUND On March 8, 1990, during discussion of adoption of new Zoning Ordinance 11000, citizens from Edgewater requested consideration of an increase in Floor Area Ratio (FAR) for commercial properties. On July 18, 1990 the Department presented and the Planning Advisory Board recommended approval of the application of the SD-19 Designated FAR Overlay District, with a designated FAR of 2.0 and retaining the underlying commercial zoning, for the area from N.E. 17th Terrace to N.E. 36th Street, between N.E. 2nd Avenue and the fronting properties on. the . east side of Biscayne Boulevard (except south of N.E. 20th Street where the Boulevard itself was the boundary. At the City'Commission hearing of July 26, 1990, on first reading, citizens from Edgewater objected that the ordinance was insufficiently broad. The Commission instructed staff to meet with the neighbors and to bring legislation, as amended, back. The Planning, Building and Zoning Department has: a) withdrawn the application of SO-19 to the area; b) authored this draft ordinance SD-20; and 10801 5( "1 i� Y I j j 7 i r' 1 I 1 j i I j i I ANALYSIS RECO114ENDATION PLANNING ADVISORY BOARD CITY COMMISSION c) recommended its application to an expanded area, including the area previously considered. This overlay district -has the following features. 1. Floor Area Ratios retain 1.72 for the underlying residential districts but increase the FAR to 2.0 for underlying commercial districts. 2. Lot Coverage is a maximum of 60% of gross lot area. 3. Setbacks Residential Commercial Front: 20' 10' Rear: 10, _ 5'_ Sides: 5' 0' 4. There are no height limits. S. The parking ratios for residential uses are: - 1 space for efficiencies, 1 bedroom and 2 bedroom units - 2 spaces for 2 bedroom units For commercial areas the parking ratio is: - 1 space for each 550 square feet of gross floor area. At its meeting of September 12, 1990, the Planning.Advisory Board adopted Resolution Number'PAB 61-90 by a 8 to 0 vote, recommending approval of the above.
