AN ORDINANCE AMENDING SUBSECTIONS (B), (C) AND (D) OF SECTION 2-399 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY PROVIDING THAT THE NOTICE REQUIREMENT FOR CODE ENFORCEMENT BOARD HEARINGS MAY BE MET BY POSTING WHEN SUCH POSTING OF NOTICE IS DONE IN ADDITION TO NOTICE BY CERTIFIED MAIL OR BY HAND DELIVERY BY THE SHERIFF, OR OTHER LAW ENFORCEMENT OFFICER, CODE INSPECTOR, OR DESIGNATED AGENT ACTING BY AND THROUGH THE CODE INSPECTOR AND BY PROVIDING THAT SO LONG AS PROOF OF SAID POSTING CAN BE PROVIDED BY THE PERSON POSTING SUCH NOTICE, SAID POSTING SHALL BE SUFFICIENT TO SHOW THAT THE NOTICE REQUIREMENTS HAVE BEEN MET WHETHER OR NOT THE ALLEGED VIOLATOR ACTUALLY RECEIVED SUCH NOTICE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2-399 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars: "Sec. 2-399 Notices. (a) All notices required by this article shall be in writing and furnished by certified mail, return reoeipt requested or by hand delivery by the sheriff or other law enforcement officer, code inspector,, or designated agent acting by and through the code inspector. In all cases the owner of the subject property may be notified in addition to anyone else also charged with an alleged violation occurring on the subject property. (b) In addition to providing notice as set forth in subsection (a), hereof at the option of the code enforcement board, notoe may also be served by publication, or postin-, as follows: (1) Such notice shall be published once during each week for four (4) consecutive weeks Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. 10798 • (four (4) publications being sufficient) in a nespaper of general circulation in Dade County. The newspaper shall meet such requirements as are prescribed under Chapter 50, Florida Statutes, for legal and official advertisements. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance shall be held to be invalid, the remaining provisions of this Ordinance shall not be affected. It will save the City a considerable amount of money in employee time, publication costs, etc. It will also save in the time necessary to obtain compliance. Background In order to take a violator before the Code Enforcement Board, the property owner and/or tenant must be notified. This notification is done by personal service (process server, sheriff or inspector), certified mail, or publication in newspaper of general circulation. We have found that many owners do not live on the prope.rl.y and at times it is difficult to serve process on them. An alternative and inexpensive method of notification can be accomplished by posting a notice on the property.
