ORDINANCE NO. 10797
AN EMERGENCY ORDINANCE AMENDING SECTIONS 36-4
AND 36-5 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA' AS AMENDED; BY PROVIDING THAT THE
CITY COMMISSION MAY DECLARE EXEMPTIONS FROM
THE PROHIBITIONS AND RELAX TIME LIMITATIONS ON
THE CREATION OF NOISE THAT ARE CONTAINED IN
SAID CODE SECTIONS; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI'
FLORIDA:
Section 1. Sections 36-4 and 36-5 of the Code of the
City of Miami; Florida; as amended; are hereby amended in the
following particulars: I/
"Sec. 36-4. Operation of radios; phonographs or
other sound -making devices; bands;
orchestras and musicians -Generally;
Exemption.
(a) It shall be unlawful for any person owning;
occupying or having charge of any building or premises
or any part thereof; in the city; at any time to cause
or suffer or allow any loud unnecessary; excessive or
unusual noises in the operation of any radio;
phonograph or other mechanical sound -making device or
instrument, or reproducing device or instrument, or in
the playing of any band; orchestra; musician or group
of musicians; or in the use of any device to amplify
the music of any band; orchestra; musician or group of
musicians; where the noise or music is plainly audible
at a distance of one -hundred (100) feet from the
building; structure; vehicle or premises in which or
from which it is produced. The fact that the noise or
music is plainly audible at a distance of one -hundred
(100) feet from the vehicle or premises from which it
originates constitutes prima facie evidence of a
violation of this chapter.
(b) The city commission may_declare an exemption
from the prohibitions contained in paragraph a above
and declare them inapplicable on special occasions by
resolution.

remaining provisions are now in effect and remain unchanged.

(a) The city commission may relax the time
restrictions contained in paragraph a above or
declare them inapplicable on special occasions by
resolution:
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent with the provisions of this Ordinance
are hereby repealed.
Section 3. If any section; part of section; paragraph;
clause' phrase, or word of this Ordinance be declared invalid;
the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace; health; safety; and property of the City
of Miami.
Section 5. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 6. This Ordinance shall become effective
immediately upon its adoption.
PASSED AND ADOPTED this 18th day of October 1990.

As directed at the above -referenced meeting, we have
prepared the attached proposed Emergency Ordinance and
Resolution.
As explained at the Commission Meeting, in order for the
City Commission to adopt the resolution relaxing the time
limitation for the staging of the Miami River Blues Festival, as
requested by the representatives of Tobacco Road, you must first
adopt the attached Ordinance to provide that the City Commission
may relax the time limitation and declare an exemption from the
prohibitions as set forth in Sections 36-4 and 36-5 of the City
Code, as amended.
This item needs to be submitted to the City Manager for
placement on an Agenda so that the legislation can be adopted and
effective in time for the Festival scheduled for
October 21, 1990.
