The City Commission has established a policy that the lunch recess will begin at
the conclusion of deliberations of the agenda item being considered at 12:00
noon; further, that Commission meetings will adjourn at the conclusion of

1. CONSENT AGENDA
Unless a member of the City Commission wishes to remove
a specific item from this portion of the agenda, Items

resolutions are self-explanatory and are not expected to
require additional review or discussion. Each item will

CA-1. RESOLUTION - (J-90-838) - (ACCEPTING BID)
Accepting the bid of Lloyd Steier a non -minority
vendor for furnishing four 4) Purebred German
Shepherd_dogs to the Department of Police at a
total proposed cost not to exceed 10,800.00;
using funds therefor previously allocated from the
Law Enforcement Trust Fund, Project No. 690001,
Account Code No. 290904-996; authorizing the City
Manager to instruct the Chief Procurement Officer
to issue a purchase order for this purchase.
CA-2. RESOLUTION - (J-90-882) - (ACCEPTING PLAT)
Accepting the plat entitled 'Chinatown•, a
subdivision in the City of Miami, subject to all
of the conditions of the Plat and Street
Committee, and accepting the dedications shown on
said plat; authorizing and directing the City
Manager and City Clerk to execute the plat; and
providing for the recordation of said plat in the
Public Records of Dade County, Florida.

for the purpose of providing and securing City
Commission information, direction and guidance in
significant pending and concluded matters,

2. RESOLUTION - (J-90-875) - (AUTHORIZING SETTLEMENT)
Authorizing the Director of Finance to pay to
Russell, Inc., without the admission of liability-,
the sum of $90,000 in full and complete settlement
of any and all claims and demands against the City
of Miami, in Circuit Court Case No. 87-23717 CA
13, upon the execution of a release releasing the
City of Miami from any and all claims and demands,
using funds therefor allocated from Capital
Improvement Project (CIP) Fund No. 341094 monies
and to the extent necessary from the Public Works
Department Operating Budget which budgeted funds
shall be restored as soon as practicable and
further authorizing a final payment of $117,952.70
from previously appropriated C_IP monies to
Russell, Inc. representing retainage and final
draw, upon completion of remaining punch -list
items to the satisfaction of the Public Works
Department.

emergency basis in order to make final adjustments
to the City's fiscal year 1990 financial records,
for review by the City's external auditors. Any
delays in the passage of this ordinance will delay
the auditors' final review of the City's
accounting records and could result in a delay in
the publishing of the City's final fiscal year
1990 financial statements.)
Amending Sections 1, 2, 3, 4 and 5 of Ordinance
No. the Annual Appropriations Ordinance for
the fiscal year ending September 30, 1990, adopted
eptember 28, 1989, as amended, for the purpose of
implementing budgetary adjustments to comply with
generally accepted accounting principles as

Amending Chapter 37, of the Code of the City of
Miami, Florida, as amended, entitled "Offenses -
Miscellaneous", by adding a new Section 37-72
thereto, entitled, 'Unauthorized Use of Official
City Police Department Emblem and Stationery
Prohibited'; thereby providing for restrictions on
the sale, use, and offering for sale of said
emblem; containing a repealer provision,
severability clause and providing for an effective
date. (This item was deferred from the meeting of
September 7, 1990.)
5. FIRST READING ORDINANCE - (J-90-788)
Related to Conflicts of Interest, amending the
Code of the City of Miami, Florida, as amended, by
amending Section 2-302 thereof to authorize the
appearance of members of the Downtown Development
Authority Board before the City Commission in
representation of third parties; further, amending
Section 2-304 of said Code to clarify conflicts of
interest waiver provisions pertaining to
appearances before the City Commission; containing
a repealer provision, severability clause and
providing for an effective date.

F CONSERT TO LEASE AGREEMENT)
Authorizing the City Manager to execute a consent

encroachment upon a riparian area of the Miami
River, for the construction of the Metramover
Miami River Bridge Pier and Fender System by Dade
County on that portion of Miami River bottom owned
by the State of Florida.

maintain a guideway for the Omni Extension of the
Metromover Extension Project over a portion of the
Miami Municipal Railway right-of-way located on
the westerly side of NE 2 Avenue between NE 10 and
