HomeMy WebLinkAboutO-10803J-90-909 10/17/90 N ORDINANCE NO. 10803 AN EMERGENCY ORDINANCE AMENDING SECTIONS 1, 2, 3, 4 AND 5 OF ORDINANCE NO. 10648, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1990, ADOPTED SEPTEMBER 28, 1989, AS AMENDED, FOR THE PURPOSE OF IMPLEMENTING BUDGETARY ADJUST TO COMPLY WITH GENERALLY ACCEPTED ACCOUNTING PRINCIPLES AS OUTLINED BY THE CITY'S EXTERNAL AUDITORS; CONTAINING A REPEALER PROVISION .AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10648, the Annual f 1 Appropriations Ordinance on September 28, 1989;..establishing revenues and appropriations for the City of Miami, Florida, for the Fiscal Year ending September 30, 1990; and WHEREAS, amendatory adjustments to the FY'90 Appropriations Ordinance are outlined below together with the explanation for said adjustments; and WHEREAS, a savings of $281,000 is projected for FY'90 in Special Programs and Accounts; and WHEREAS, the Fire, Rescue and Inspection Services Department requires an additional appropriation of $236,000 to cover increased costs associated with union negotiated increases; and WHEREAS, the Law Department requires an additional appropriation of $45,000 to cover increased personnel related costs; and WHEREAS, Planning, Building and Zoning Department revenue will increase in the amount of $200,000 due to the increased Code Enforcement efforts of the Unsafe Structures Board; and WHEREAS, the Conferences, Conventions and Public Facilities Department has $1,300,000 of additional reserve fund revenue which will be transferred to the General Fund; and WHEREAS, Tourist Bed Tax revenue received from Dade County has increased by $250,532 which will be transferred to the Conferences, Conventions and Public Facilities Department; and WHEREAS, an additional appropriation of $450,000 to be covered in full by the United States Department of Housing and Urban Development is needed to provide for rental assistance payments during FY190; and 10803 WHEREAS, the Special Obligation Debt Service Bond Fund has an accumulated cash balance of $414,000 of which $275,095 is additional Telephone Franchise revenue and the balance after expenses will be transferred to Development and Housing Special Revenue Fund; and WHEREAS, Internal Service Funds, Custodial Maintenance, will increase by $40,000; Fleet Management, by $200,000; and Commmications Maintenance by $150,000 due to increased custodial requirements relative to the Police Substations coming on line, additional costs for motor fuel and increased telephone charges; and WHEREAS, the City of Miami has received an additional $1,062,456 in pension receipts from the State of Florida, for Police and Fire Personnel pursuant to Chapters 175 and 185 of the Florida Statutes; and WHEREAS, there are available accumulated cash balances as follows: the Land Exchange agreement with Dade County and other miscellaneous projects, $360,000; interest earnings prior to 1986 in the General Obligation Bond Fund, $66,000; New Port Bridge Land Sale Fund, $420,000; with said monies to be transferred to the General Fund; and WHEREAS, various Special Revenue Funds have accumulated cash balances of $550,000 with said balances to be transferred to the General Fund; and WHEREAS, the OMNI Tax Increment District Trust Fund has unspent monies totalling $700,000 and said monies are to be transferred to the General Fund; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 1, 2, 3, 4 and 5 of Ordinance No. 10648, the Annual Appropriations Ordinance for the Fiscal Year ending September 30, 1990, adopted September 28, 1989, as amended, are hereby amended in the following particulars:l/ l/ Words and/or figures stricken through shall be deleted. The purpose of the herein budgetary adjustments to various funds is to comply with generally accepted accounting principles as outlined by the City's external auditors. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provision of this Ordinance are hereby repealed. Section 4. If any Section, part of Section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. -5- 10803 Section 5. This Ordinance is hereby declared to be an emergency measure on grounds of urgent public health, safety and property of the City of Miami and upon the further ground of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the function and duties of municipal affairs. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Con ission. Section 7. This Ordinance shall become effective immediately upon its adoption. Od City Manager DATE : O C T 1 71990 FILE : 3 SUBJECT Proposed Amendment to the FY190 Annual Appropriation REFERENCES :Ordinance ENCLOSURES. It is respectfully recommended that the City Commission adopt the attached emergency ordinance making budgetary adjustments- to comply with generally accepted accounting principles as outlined by the City's external auditors. The Departments of Budget and Finance have identified the need to make certain budgetary changes to the FY190 Annual Appropriations Ordinance. The reasons for these adjustments are stated below. A $236,000 increase in appropriations for the Fire, Rescue and Inspection Services Department is needed to cover additional costs associated with Union negotiated salary increases. A $45,000 increase in appropriations for the Law Department is needed to cover rent and additional personnel related costs. An anticipated savings of $281,000 in Special Programs and Accounts will fund said increased appropriations. The Building and Zoning Department revenue will increase in the amount of $200,000 due to the increased Code Enforcement efforts of the Unsafe Structures Board. The Conferences, Conventions and Public Facilities Department has $1,300,000 of additional reserve funds which will be transferred to the General Fund. The Tourist Bed Tax revenue received from Dade County has increased by $250,532 which will be transferred to the Conferences, Conventions and Public Facilities Department to pay for tourist related activities. 10803 The Special Obligation Debt Service Bond Fund has an accumulated cash balance of $414,000 of which $275,095 is additional Telephone Franchise Revenue.
