AN ORDINANCE, WITH A7rMMn, CREATING MA= 12.1 OF THE CODE OF THE CITY OF MnMI, FLORIDA AS AMENDED, ENTITLED "CONVE'NIENCE STORE SECURITY"; TO PROVIDE FOR DEFINITIONS; REQUIRING CERTAIN RETAIL GROCERY STORES TO BE EQUIPPED WITH SPECIFIED SECURITY DEVICES; REQUIRING CERTAIN LEVELS OF LIGHTING FOR PARKING LOTS; REQUIRING POSTING OF (3rRTAIN SIGNS; REQUIRING POSTING OF SPECIFIED SIGM; PROHIBITING WINDOW TINTING; REQUIRING TRAINING FOR CERTAIN ENIPIAYEES; PROVIDING FOR CIVIL FINES; PROVIDING FOR NONCOMPLIANCE FEES; CONTAINING A REPEALER PROVISION, A SEVERABILITY + CLAUSE, AND PROVIDING AN EFFECTIVE DATE. WEMWM, the Legislature of the State of Florida found that many convenience stores operating durnight and y g hours are at risk for robbery and that ce securi are helpful in protecting the store loyee and the co r public from robbery and injury; and Aislat:ure of S tof Florida has found that such mininWM s ity requi t beneficial to areas where death, serious injury, or sexual ba has occurred during the commission of a theft or robbery at a convenience :,Lore; and s WHMWS, Section 4 of the Convenience Store Security Act (Chapter 90-346, Laws of Florida) requires each local government in which a death, serious injury, or sexual battery has occurred during the commission of a theft or robbery at a statutorily defined convenience store within its jurisdiction during the twelve-month period preceding July 6, 1990 to adopt an ordinance which mandates the provisions of Section 2, Section 3, Section 4, and Section 5 of Chapter 12.1 created herein; and WHEREAS, the Police Department of the City of Miami has determined that a death, serious injury, or sexual battery has occurred during the commission of a theft or robbery at a convenience store as defined herein within the City of Miami during the twelve-month period preceding July 6, 1990; and
