A RESOLUTION AMENDING RESOLUTION N0. 87-654, ADOPTED
JULY 9, 1987, AS AMENDED, BY PROVIDING FOR AN INCREASE
IN AN AMXJNr OF $250,000, FOR THE CONTINUED FINANCING
OF COMPLEX AND/OR PRM ACTED CRIMINAL INVESTIGATIONS,
WITH FUNDS ALLOCATED FROM THE CITY OF MIAMI LAW
ENFORCEMENT TRUST FUND, UPON SUCH COSTS AND EXPENSES
HAVING BEEN APPROVED BY THE CHIEF OF POLICE.
WHEREAS, Florida Statute 932.704(3)(a) authorizes the use of Law
Enforcement Trust Fund monies to defray the costs of complex and/or protracted
criminal investigations and to provide law enforcement with additional
technical equipment and expertise; and
WHEREAS, the need exists within the Miami Police Department to conduct
complex and/or protracted criminal investigations which often require
additional monies for such costs as overtime, the purchase or rental of
equipment and supplies, payment of confidential informants, buy monies, and
other investigative support expenses; and
WHEREAS, it is in the best interest of the community and the City of
Miami to fund these expenditures through monies generated as a result of the
seizures authorized under the Florida Contraband Forfeiture Act; and
E' WHEREAS, funds to cover these necessary and legitimate costs and
expenditures have not been included in the Police Department's normal,
operating budget; and
WHEREAS, the Chief of Police has recommended adoption of this Resolution
and determined that the expenditures proposed comply with Florida Statute
932.704; and
WHEREAS, the funds to cover the necessary and legitimate expenses are
available in the City of Miami Law Enforcement Trust Fund, Project No. 690001,
Index Code 290904-996; and
WHEREAS, Resolution No. 87-654 was amended by Resolution No. 87-1082,
adopted December 10, 1987, allocating an additional amount of $150,000;
NOW, THEREFGRE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this
Resolution are hereby adopted by reference thereto and incorporated herein as
if fully set forth in this Section.
Section 2. Section 2 of Resolution No. 87-654, adopted on July 9, 1987,
as amended, is hereby amended in the following particulars -.I/
"Section 2. Additional funding in an amount not to exceed 99
5250,000 is hereby allocated from the Law Enforcement Trust Fund, and
the Chief of Police is hereby authorized to expend monies for the
necessary and legitimate expenses associated with the continuation of
complex and/or protracted investigations."
Section 3. This Resolution shall become effective immediately upon its
adoption.

It is respectfully requested that the City Commission adopt the
attached resolution amending Resolution No. 87-654 and allocating
an additional $250,000 from the City of Miami Law Enforcement
Trust Fund for specialized crime suppression activities which
will involve protracted, in-depth, and/or complex investigations.
The Miami Police Department is requesting that the funding of
special investigative activities, as provided for originally
under the seed monies allocated under "Operation Crime
Suppression" in Resolution No. 86-665 and Resolution No. 87-654,
be continued as authorized under Florida Statute 932.704, the
Florida Contraband Forfeiture Act.
The monies will be utilized to enhance and support police
operations by providing additional resources to pay for such
expenses as overtime, the purchase and/or rental of necessary
equipment and supplies, the payment of confidential informants,
the provision of buy monies, consultant/expert services, and any
other special investigative expenditures required for the
successful investigation of protracted and/or complex
investigations as authorized by the Chief of Police.
Therefore, it is requested that the attached resolution amending
Resolution No. 87-654, by providing an additional $250,000 from
the Law Enforcement Trust Fund, Project No. 690001, Index Code
290904-996, for the continued financing of complex and/or
protracted criminal investigations, be approved.

I, Perry L. Anderson, Jr., Chief of Police, City of Miami, do
hereby certify that the aforementioned request for expenditures
from the City of Miami Law Enforcement Trust Fund, for the
continued financing of protracted Complex Investigations, in the
amount of S250.000. complies with the provisions of Section
932.704, Florida Statutes.
