AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 10782, THE CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE ADOPTED SEPTEMBER 27, 1990, AS AMENDED, BY DECREASING THE TOTAL APPROPRIATIONS TO CAPITAL PROJECT ENTITLED "MODEL CITY LAND," PROJECT NO. 321039, IN THE AMOUNT OF $365,250, SAID DECREASE BEING MADE IN FUNDS AVAILABLE FROM FIFTEENTH (15TH) YEAR COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FUNDS, REALLOCATING AND APPROPRIATING SAID FUNDS FOR THE PURPOSE OF UNDERTAKING OTHER COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM ACTIVITIES IN THE CITY OF MIAMI; CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, there exists in the City of Miami a severe shortage of housing within the affordability range of families and individuals of low and moderate income; and WHEREAS, the City Commission recognizes that the participation of both the public and private sector is necessary to foster the development of housing within the affordability range of families and individuals of low and moderate income; and WHEREAS, on April 27, 1989, through Motion No. 89-390, the City Commission approved the allocation of $500,000 in 15th Year Community Development Block Grant Program funds for the purpose of acquiring certain slum and blighted properties in the Model ! City neighborhood, bound by Northwest 56th and 58th Streets E between Northwest 6th Place and I-95 Expressway, in connection with the development of affordable housing in the neighborhood; and WHEREAS, on July 23, 1989, through Resolution No. 89-645, the City Commission modified Motion No. 89-390, thereby reducing the previously approved acquisition allocation of $500,000 to $375,000 for the aforementioned project; and 10812 WHEREAS, the City Commission adopted Ordinance No. 10782 on September 27, 1990, establishing appropriations for implementation of Capital Improvements in the City of Miami; and WHEREAS, said Ordinance established funding for Capital Improvement Project No. 321039, "Model City Land Acquisition"; and WHEREAS, over the past year the City has been unsuccessful in securing ownership of the subject properties through a negotiated purchase settlement with the property owner(s); and WHEREAS, approximately $9,750 was expended from the original $375,000 to defray the cost of site appraisals and there currently exists a remaining balance of $365,250 from 15th Year Community Development Block Grant Program in Project No. 321039, "Model City Land Acquisition"; and WHEREAS, funding in the amount of $365,250 is available from Capital Improvement Project No. 321039, "Model City Land Acquisition funds" which are being decreased hereby; and WHEREAS, it is recommended that the said $365,250 in available funds be reprogrammed and allocated to St. John Community Development Corporation to assist the not -far -profit corporation in financing, in part, the construction of a thirty- five (35) unit affordable rental housing project planned on City - owned parcels in the Overtown Community Development Target Area; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 10782, the Capital Improvement Appropriation Ordinance adopted September 27, 1990, as amended, is hereby amended in the following particulars:/ "Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during fiscal year 1990-1991. The herein appropriations which Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. All figures are rounded to the nearest hundred dollars. -2- 10812 P ad se Ll 2 are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations and revenues therefore being set forth for seven program (I-VII) areas based upon use or functional category within said areas, as follows: TOTAL APPROPRIATIONS ($ X000) III. The recitals and findings contained in the reamble to this Ordinance are hereby approved, confirmed and opted by reference thereto and incorporated herein as if fully t forth in this Section. Section 3. All ordinances, or parts of ordinances insofar they are inconsistent or in conflict with provisions of this dinance are hereby repealed. Section 4. If any section, part of this section, paragraph, ause, phrase or word of this Ordinance is declared invalid, the maining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an ergency measure on the grounds of urgent public need for the enervation of peace, health, safety, and property of the City Miami, and upon the further grounds of the necessity to make a required and necessary payments to its employees and ficers, payment of its debts, necessary and required purchases goods and supplies, and to generally carry on the functions 1 duties of municipal affairs. -3- 10 812 Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 5. This Ordinance shall become effective immediately upon its adoption. Odio REFERENCES Model City Land City Manager Acquisition Project ENCLOSURES C i t y Commission Agenda Item/November 8, 1990 RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Ordinance, amending Section 1 of Ordinance No. 10782, the Capital Improvement Appropriations Ordinance, adopted September 27, 1990, by decreasing the appropriation for Capital Improvement Program (C.I.P.) Project No. 321039, entitled Model City Land Acquisition, by the amount of $365,250, for the purpose of funding other community development and housing related activities in the Overtown Community Development Target Area. BACKGROUND: The Department of Development and Housing Conservation recommends ratification of the attached Ordinance, amending Section 1 of Ordinance No. 10782, the Capital Improvement Appropriations Ordinance, by decreasing the appropriation for Capital Improvement Program Project No. 321039, entitled "Model City Land Acquisition," by the amount of $365,250 for the purpose of funding other community development and housing related activities in the Overtown Community Development Target Area. On April 27, 1989, through Motion No. 89-390, the City Commission approved the allocation of $500,000 in 15th Year Community Development Block Grant Program funds, for the purpose of acquiring certain slum and blighted properties in the Model City neighborhood bounded by Northwest 56th and 58th Streets between Northwest 6th Place and the I-95 Expressway, in connection with the development of affordable housing in the neighborhood. On July 13, 1989, through Resolution No. 89-645, the City Commission modified Motion No. 89-390, thereby reducing the previously approved acquisition allocation of $500,000 to $375,000, for the above mentioned land acquisition project. Over the past year, the Department of Development and Housing Conservation staff has been aggressively attempting to acquire the subject properties through a negotiated purchase settlement with the property owner. However, the City's efforts to acquire the subject properties has proven unsuccessful. Presently, the subject properties are scheduled to be purchased by Tacolcy Economic Development Corporation for the purpose of developing ff d bl h n the subject arcels a or a e ousing o p 1 1 ordinance Amending CIP Ord. Presently, there exists a remaining balance of $365,250 in 15th Year Community Development Block Grant Program funding. It is recommended that the remaining balance of $365,250 be earmarked by the City Commission to provide a project development equity grant to St. John Community Development Corporation. to assist, in part, in financing the construction of a thirty-five (35) unit affordable rental housing project planned in the Overtown neighborhood.
