J'-90-934 10/29/90 ORDINANCE NO. 10 811 AN EMERGENCY ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "EMERGENCY SHELTER GRANT (FY'90)"; APPROPRIATING FUNDS FOR OPERATION OF SAME IN THE AMOUNT OF $292,000 FROM UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (USHUD) AWARDED AS A RESULT OF APPROVAL BY USHUD OF THE CITY'S 1990 EMERGENCY SHELTER GRANT APPLICATION; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Resolution No. 90-130 on February 7, 1990, which authorized the City Manager to submit a grant application in the amount of $292,000 to the United States Department of Housing and Urban Development for the 1990 Emergency Grant; and WHEREAS, the United States Department of Housing and Urban Development (USHUD) has awarded the City of Miami $292,000 of 1990 Emergency Shelter Grant funds from the Stewart B. McKinney Homeless Assistance Act to provide programs for the homeless; and WHEREAS, the City Manager has executed the necessary implementing agreement with USHUD; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: EMERGENCY SHELTER GRANT (FY190) RESOURCES: UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT APPROPRIATION: EMERGENCY SHELTER GRANT GRANT NO. S-90-MC-12-0002 $292,000 $292,000 10811 Section 3. The herein authorization shall remain valid and outstanding even if the anticipated grant award is reduced or increased. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of this section, paragraph clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity of the City of Miami to make the required and necessary payments to its employees and officers, the payment of its debts, the necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 7. The requirement of reading this Ordinance on two separate days is hereby dispensed with a vote of not less than four -fifths of the members of the Commission. Section 8. Odio City Manager RECOMMENDATION DATE V (j 1 3 U 1990 FILE SUBJECT Appropriations Ordinance for FY'90 Emergency Shelter Grant REFERENCES: City Commission Agenda November 8, 1990 ENCLOSURES: proposed Ordinance It is respectfully recommended that the City Commission adopt the attached emergency ordinance which establishes a new special revenue fund entitled "Emergency Shelter Grant (FY'90)" appropriating $292,000 from the 1990 Emergency Shelter Grant through the U.S. Department of Housing and Urban Development (USHUD) as a result of the approval of the City's 1990 ESG grant application by USHUD. BACKGROUND The Department of Community Development has prepared legislation establishing a new special revenue fund entitled "Emergency Shelter Grant (FY'90)" and appropriating $292,000 from the 1990 Emergency Shelter Grant (ESG) resulting from the approval of the City's ESG grant application by the U.S. Department of Housing and Urban Development (USHUD). At its meeting of February 7, 1990, the City Commission adopted Resolution No. 0130 authorizing the City Manager to submit the aforementioned grant application and enter into the necessary implementing agreement with USHUD upon approval. The implementing agreement with USHUD has been executed. The City's ESG application included $242,000 to be directed to the operation of the Beckham Hall Shelter for the Homeless, a facility jointly operated by the City and Metropolitan Dade County, and a $50, 000 allocation to Betterway, Inc. The Department of Community Development has also submitted a companion item to the proposed legislation which allocates $183,600 of the $242,000 for Beckham Hall to Metropolitan Dade County and further authorizes the City Manager to enter into agreement with to the County. Metropolitan Dade County is responsible for administering funds for the operation of this facility, with the exception of funds used to pay the personnel costs of City staff working at the shelter.
