ORDINANCE NO. 1 0 8 1 0
AN EMERGENCY ORDINANCE CREATING A NEW SPECIAL
REVENUE FUND ENTITLED: "RECREATION PROGRAMS
FOR THE MENTALLY RETARDED - FY'91" AND
APPROPRIATING FUNDS FOR ITS OPERATION IN THE
TOTAL AMOUNT OF $384,281 CONSISTING OF A
$264,281 GRANT FROM THE STATE OF FLORIDA,
DEPARTMENT OF HEALTH AND REHABILITATIVE
SERVICES (HRS), $45,000 FROM FISCAL YEAR 1991
GENERAL FUND, RECREATION DIVISION OPERATING
BUDGET, AND $75,000 IN CARRY-OVER FUND
BALANCE FROM THE FY'90 REVENUE FUND OF THE
SAME NAME; AUTHORIZING THE CITY MANAGER TO
ACCEPT THE GRANT AWARD AND TO ENTER INTO THE
NECESSARY AGREEMENT(S), IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, TO ACCEPT THE GRANT AND
IMPLEMENT THE PROGRAM, SUBJECT TO APPLICABLE
CITY CODE PROVISIONS; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the sum of $45,000 was budgeted in the Fiscal Year
1990-91 General Fund, Recreation Division Operating Budget as the
City's contribution to Recreation Programs for the Mentally
Retarded; and
WHEREAS, the State of Florida Department of Health and
Rehabilitative Services (hereinafter referred to as HRS) has
offered the City a grant of $147,636 consisting of federal and
state funds to provide recreation and transportation to mentally
retarded individuals for the period October 1, 1990 through
September 30, 1991; and
WHEREAS, HRS has offered the City a grant of $116,645
consisting of federal and state funds to provide developmental
training and transportation to mentally retarded individuals for
the period October 1, 1990 through September 30, 1991; and
WHEREAS, the total grant award for these four program
components is $264,281; and
WHEREAS, a carry-over fund balance in the amount of $75,000
is anticipated from the Fiscal Year 1990 revenue fund of the same
name; and

WHEREAS, these funds, in the total amount of $384,281, will
allow the program to continue through to continue through
September 30, 1991;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The following Special Revenue Fund is hereby
established as described herein:

RECREATION DIVISION OPERATING BUDGET
- FY 191 $ 45,000
CARRY-OVER FUND BALANCE FROM RECREATION
PROGRAMS FOR THE MENTALLY RETARDED
FY '90 $ 75,000
APPROPRIATION: RECREATION PROGRAMS FOR THE MENTALLY
RETARDED - FY'91 $384,281
Section 2. The City Manager is hereby authorized to accept
the grant award as set forth in the preamble to this Ordinance
and to enter into the necessary agreement(s), in a form
acceptable to the City Attorney, to carry out said programs for
the mentally retarded grant project, subject to applicable City
Charter and Code provisions.
Section 3. All Ordinances or parts of Ordinances insofar
as they are inconsistent of in conflict, with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
reservation of peace, health, safety, and property of the City of
Miami and upon the further grounds of the necessity to make the

required and necessary purchases and payments, and to generally
carry out the functions and duties of municipal affairs.
Section 6. The requirements of reading this Ordinance on
two separate days is hereby dispensed with by a vote of not less
than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become affective
immediately upon its adoption.

Recommendation
It is respectfully recommended that the City Commission adopt the attached
emergency ordinance creating a new special revenue fund entitled: "Recreation
Programs for the Mentally Retarded - FY191" and appropriating funds for the
program's operation in the amount of $384,281 consisting of a $264,281 grant
from the State of Florida, Department of Health and Rehabilitative Services
MRS), $45,000 as the City's contribution from FY191 General Fund, Recreation
Division Operating Budget, and $75,000 as a carry-over fund balance from the
FY190 revenue fund of the same name. The ordinance would also authorize the
City Manager to accept the grants from HRS for this fiscal year and to enter
into the necessary contract(s) for the acceptance of this grant and the
implementation of the program.
Background:
The City of Miami Department of Parks and Recreation, Handicapped Division has
received grant funds from the State of Florida Department of Health and
Rehabilitative Services for the past thirteen years. These monies are used to
provide community recreation, developmental training and transportation to a
minimum of one hundred mentally retarded individuals on a monthly basis for a
twelve month period. Due to the high quality and level of service provided by
the City of Miami the State of Florida has again awarded this grant. The
grant award as well as cash match were projected as future revenue and
included in the Handicapped Division's annual budget presentation.
These programs serve to enhance the lives of the developmentally disabled
citizens of Miami by providing an integrated setting and equal opportunities
and access in all their endeavors. The Handicapped Division promotes and
advocates for the needs of the disabled and considers community recreation and
developmental training to be vital components in the transition process. We
therefore recommend that the proposed action be taken to accept the grant and
appropriate the funds needed to continue this worthwhile program.
This ordinance is being presented as an emergency measure to meet granting
agency deadlines and so that funds are immediately in place for the
continuation of this Handicapped Program.
