RESOLUTION NO. 9 0— 969
A RESOLUTION OFFICIALLY CLOSING, VACATING,
ABANDONING AND DISCONTINUING THE PUBLIC USE
OF THAT PORTION OF NORTHWEST 1ST COURT
LOCATED NORTH OF THE NORTH RIGHT-OF-WAY LINE
OF NORTHWEST 4 STREET AND SOUTH OF THE SOUTH
RIGHT-OF-WAY LINE OF NORTHWEST 5 STREET,
MIAMI, FLORIDA; SUBJECT TO THE GRANT OF LAND
TO THE CITY OF MIAMI BY THE STATE OF FLORIDA
UNDER I-95 IN THE AMOUNT OF APPROXIMATELY
12,000 SQUARE FEET FOR POLICE PARKING; SAID
CLOSURE, ABANDONMENT AND DISCONTINUANCE BEING
A CONDITION FOR THE APPROVAL OF TENTATIVE
PLAT NO. 1384 - "STATE OF FLORIDA REGIONAL
SERVICE CENTER".
WHEREAS, the Miami Zoning Board at its regular meeting of
November 5, 1990, Item No. 3, following an advertised hearing,
adopted Resolution No. ZB 97-90 by a six to zero (6-0) vote,
RECOMMENDING official vacation and closure of a portion of a
street as herein set forth, in accordance with all
recommendations of the Plat and Street Committee, subject to
review and approval by staff of revised disclosure information;
and
WHEREAS, the City Commission finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of the street
portion in question and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

of Northwest 4 Street and South of the South right-of-way line of
Northwest 5 Street, Miami, Florida, is hereby closed, vacated,
abandoned and discontinued for public use, said closure,
vacation, abandonment and discontinuance being a condition for
the approval of Tentative Plat No. 1384 - "State of Florida
Regional Service Center".
Section 3. This Resolution shall become effective
immediately upon its adoption.

1st Court located north of the north right-of-
way line of NW 4th Street and south of the south
right-of-way line of NW 5th Street would not
have an adverse impact on the surrounding
properties. At present this portion of the
public right-of-way only serves the abutting
property owner i.e., State of Florida, and is
not deemed necessary for the overall public
interest. The vacation and closure will
facilitate the. use and development of the
contiguous properties without adversely
affecting public travel.

PUBLIC WORKS The Plat and Street Committee has determined
that the tentative plat is in conformance with
the technical requirements of City Code Chapter
54.5 and the Committee recommends approval of
the vacation and closure of the street, as
requested. At the request of the applicant, the
Plat and Street Committee met on October 5, 1990
to reconsider certain conditions piased upon the
applicant as a requirement of the of the street
closure. At that meeting the committee decided
that the removal of the abandoned fuel storage
tank in N.W 4 Street and the removal of the
existing planters, benches and flagpole in N.W.
2 Avenue would not be a requirement of the
street closure since these structures are
located outside the limits of the street closure
application
DADE COUNTY TRAFFIC
AND TRANSPORTATION No comment.
ZONING BOARD At its meeting of September 10, 1990, the Zoning
Board continued consideration of this item for
the applicant to meet with staff regarding
certain Plat and Street Committee requirements
At its meeting of November 5, 1990, the Zoning
Board adopted Resolution ZB 97-90, by a 6-0
vote, recommending approval of the above.
