A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5THS
OF THE MEMBERS OF THE CITY COMMISSION WAIVING
FORMAL COMPETITIVE SEALED BID PROCEDURES FOR
CONSTRUCTION AND EQUIPMENT FOR THE ALLAPATTAH
ELDERLY PROGRAM FACILITIES EXPANSION PROJECT;
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING THAT AN EMERGENCY EXISTS
JUSTIFYING SUCH WAIVER FOR SAID PROJECT;
AUTHORIZING THE CITY MANAGER TO HOLD SUCH
COMPETITION AS MAY BE PRACTICABLE UNDER THE
CIRCUMSTANCES FOR THE CONSTRUCTION OF
NECESSARY IMPROVEMENTS AND INSTALLATION OF
EQUIPMENT AT SAID FACILITY UNDER SAID
PROJECT; ALLOCATING FUNDS THEREFOR IN AN
AMOUNT NOT TO EXCEED $110,000 FROM 16TH YEAR
COMMUNITY DEVELOPMENT BLOCK GRANT; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE
AND/OR ISSUE THE NECESSARY DOCUMENTS, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH
THE PARTICULAR FIRM SELECTED.
WHEREAS, the City Manager has made a written finding that
the construction of additional facilities for the Allapattah
Elderly Program
at Curtis
Park
constitutes
a valid public
emergency which
requires
the
immediate
procurement of
construction services and equipment to protect the health, safety
and welfare of the elderly community and for the convenience of
the City; and
WHEREAS, the nature of said emergency is based on the
community's need for additional space and facilities to serve
meals in a safe environment and meet the health needs of the
program recipients beginning in the Spring of 1991; and
WHEREAS, the city Commission initially recognized the need
for said project by its adoption of Motion No. 90-814; and
WHEREAS, a preliminary floor plan of the project has been
donated through the efforts of. Allapattah Community Action, Inc.;
and
WHEREAS, it is necessary to begin construction in February
1991 in order to complete the work for the Spring 1991; and

WHEREAS, said deadline does not allow sufficient time for

the formal advertising, receipt of bids, and award of contracts
I;
which are normally required procedures; and

WHEREAS, Sections 18-52.5 and 18-52.6 of the City Code make
provision for the emergency procurement of required goods and
services for public works projects and improvements; and
WHEREAS, the City Manager and the Directors of the
Departments of Public Works and Community Development recommend
that such competition as may be practicable under the

circumstances be utilized to procure the needed services,
equipment and/or materials for said project; and
WHEREAS, after receipt of informal bids, contracts for said _
services, equipment and/or materials will be awarded to the
particular firm selected by the City Manager; and
WHEREAS, funds are available from the 16th Year Community
Development Block Grant for the Allapattah Elderly Program
Facilities Expansion Project and $110,000 has been allocated for
said project; and
WHEREAS, the foregoing is being presented at a properly
advertised public hearing before the City Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby incorporated herein by
reference thereto and adopted as if fully set forth in this
Section.
Section 2. The City Manager's finding that a valid
public emergency exists justifying such waiver for said Project
is hereby ratified, approved and confirmed.
Section 3. By an affirmative vote of 4/5ths of the
Members of the City Commission, formal competitive sealed bid
procedures for the procurement of services, equipment and/or
materials for the construction of the "Allapattah Elderly Program
Facilities Expansion Project" are hereby waived.

Section 4. The City Manager is hereby authorized to
select a firm by engaging in such competition as may be
practicable under the circumstances for necessary construction
and/or equipment for said project.1/
Section 5. An amount not to exceed $110,000 is hereby
allocated therefor from "16th Year Community Development Grant"
funds for the Allapattah Elderly Program Facilities Expansion
Project.
Section 6. The City Manager is hereby authorized to
execute and/or issue the necessary documents/, in a form
acceptable to the City Attorney, with the selected firm for
construction and/or equipment for said Project.
Section 7. This Resolution shall become effective
immediately upon its adoption.

The herein authorization is subject to the passage of a five
day period of time from the date that the City Commission is
notified of the City Manager's selection of the acceptable bid
during which period any individual Commissioner may object to
lout..; selection, said objection to result in the City Manager's
placement of the item on the next scheduled City Commission
meeting.

all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable
City Chanter and Code provisions.

It is respectfully recommended that the City Commission adopt the attached
resolution which waives formal competitive sealed bid procedures for
"Allapattah Elderly Program Facilities Expansion Project" based on the City
Manager's written finding that a valid public emergency exists justifying such
waiver. The resolution also authorizes the City Manager to devise a
competitive mechanism for the procurement of necessary goods and services
(construction, materials, furnishings -and equipment) and allocates funds in
the amount of $110,000 from 16th Year Community Development Block Grant.
BACKGROUND:
The Departments of Public Works and Community Development have prepared the
attached legislation. At the October 18, 1990 City Commission meeting, the
City Commission recognized the need to expand the present facility for the
Allapattah Elderly Program at Curtis Park with the passage of Motion 90-814.
In view of the present crowded conditions at the facility and the need to
expand the structure to meet Life Safety Code requirements, it is recommended
that the facility be expanded by approximately 1,900 square .feet and in
operation by the Spring of 1991. On this basis the City Manager has made a
written finding (attached) that the construction of the Allapattah Elderly
Program Facilities Expansion Project constitutes an emergency situation
requiring particular action to protect the health, safety and welfare of the
elderly community and the convenience of the City.
In order to begin construction in February 1991, a waiver of formal
competitive sealed bid procedures is required. Due to existing time
constraints imposed by formal advertising, receipt of bids and award of
contracts -by the City Commission are not practicable. It is recommended that
emergency procurement processes be implemented in accordance with Sections 18-
52.5_and 18-52.6 of the City Code.
By .adoption of the attached legislation, the -City Manager would be authorized
to seek --informal bids and/or devise an alternate competitive mechanism for the
procurement. of the needed construction, materials, furnishings and equipment,
and to award contracts and issue purchase orders for same.
Funds in the amount of $110,000 are presently available for this project from
the 16th Year Community Development Block Grant.

This memorandum serves as the written finding of a valid public emergency for
the Allapattah Elderly Program Facilities Expansion Project, a 16th Year
Community Development Block Grant Project.
1. The present facility, located at Curtis Park, was originally designed
to .accommodate 400 people per serving during meal hours. The
facility presently serves one meal per day, five days per week.
Frequently, servings are carried out in two shifts where as many as
500 people are being served per meal. These conditions are working
an extreme hardship on staff and there is a critical need to expand
the capacity of the structure.
2. Allapattah Community Action, Inc. continually receives requests for
additional program recipients and has had to honor some of these
requests. However, the program is operating at full capacity and any
increase in the number of recipients places the program in •jeopardy
due to Life Safety Code requirements.
3. The facility and program must remain in operation as many of the
recipients are completely dependent upon these services for daily
sustenance.
4. The proposed expansion of three additional rooms and one bathroom
will increase the program by 100 people per day. Failure to
implement the expansion will exacerbate the already crowded
conditions at the facility.
Such conditions indicate the* need for extraordinary measures to protect the
health,- safety and welfare of the community and the convenience of the City.
In order to initiate and complete the construction of the Allapattah Elderly
Program Facilities Expansion by the spring of 1991, formal competitive sealed
bid procedures shall be waived for the procurement of goods and services
required for this project, pursuant to Sections 18-52.5 and 18-52.6 of the
City Code. A competitive mechanism shall be devised by the City Manager in
order to 6btain materials, furnishings,. and/or equipment and a contract shall
be awarded for same by the City Manager to the particular firm selected.
