' 956 A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT AMOUNT OF $25,000.00 IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA AND PINO-FONTICIELLA AND ASSOCIATES, INC., DATED MARCH 26, 1990, FOR THE GRAND AVENUE PARK - BUILDING RENOVATION, CIP PROJECT NO. 3313429 SAID FUNDS TO BE PROVIDED FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO. 107829 WITH FUNDS ALREADY ALLOCATED TO THE PROJECT; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF FOUR -FIFTHS OF THE MEMBERS OF THE CITY COMMISSION, AND ADOPTING THE FINDINGS AND CONCLUSIONS SET FORTH IN THE PREAMBLE OF THIS RESOLUTION. WHEREAS, there exists a contract dated March 26, 1990, between the City of Miami, Florida and Pino-Fonticiella and Associates, Inc., for GRAND AVENUE PARK - BUILDING RENOVATION, CIP Project No. 331342; and WHEREAS, an increase in contract of $25,000.00 is required to cover the cost of necessary extra work such as a new sewer connection, security louvers, handicap -ramp and a graffiti seal for the exterior of walls, this work should be accomplished at this time so as to make the building accessible to the public at an earlier date; and WHEREAS, the City Manager has made a written finding that a valid emergency existed for the work to be done; and WHEREAS, the Director of the Department of Public Works recommends the increase in contract to cover the additional costs; and WHEREAS, funds to cover the increase are available from money already allocated to the project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Crff cOMMSSION MEEMG OF DEC 6 1990 REfOLIRIOIi . 0 - 9 5 6 Section 1. After a properly advertised public hearing, the finding of the City Manager set forth in the preamble to this resolution is hereby ratified by an affirmative vote of four - fifths of the City Commission, and adopted as if fully set forth in this section. Section 2. The contract between the City of Miami, Florida and Pino-Fonticiella and Associates, Inc., for the Grand Avenue Park -- Building Renovation, CIP Project No. 331342, dated March 26, 1990, is hereby increased by $25,000.00 with funds for the increase to be provided from monies already allocated to the project. Odio City Manager RECOMMENDATION: 26 DATE: NOV % 7 1990 FILE: B-2945 SUBJECT: GRAND AVENUE PARK - BUILDING RENOVATION CIP Project No. 331342 Resolution for Increase in REFERENCES Contract ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached resolution authorizing an increase in contract in the amount of $25,000.00 in the contract between the City of Miami, Florida and Pino-Fonticiella and Associates, Inc. for the GRAND AVENUE PARK - BUILDING RENOVATION, CIP Project No. .331342,, said funds to be provided from the 1991 Capital Improvements Ordinance 10782 with funds already allocated to the project; further ratifying the City Manager's written finding that the herein increase resulted from emergency circumstances by an affirmative vote of four -fifths of the members of the City Commission and adopting the finding and conclusions set forth in the preamble of this resolution. BACKGROUND: The Department of Public Works has determined that it is now in order for the Commission to authorize an increase in contract amount for the GRAND AVENUE PARK - BUILDING RENOVATION - CIP Project No. 331342. Additional modifications were requested by the Parks and Recreation Department as well as the local neighbors, these include a new sewer connection, security louvers, handicap -ramp and graffiti seal for the exterior walls. It has been decided to do this work at this time while there is a contractor on the project and the additional improvements can be completed expeditiously. As required by City ordinances, an increase of $10,000 or more in a City contract must be accompanied by a finding by the City Manager that the increase resulted from emergency circumstances, and such finding has been prepared and signed. It is further required that a Public hearing be held, and the Public Tearing has been scheduled. Attachments; Proposes Resolution 90- 956 TO. FILE FROM: Cesar H. Odio City Manager CITY OF MIAMI. FLORIDA INTER -OFFICE MEMORANDUM DATE: FILE: B- 2 9 4 5 SUBJECT: GRAND AVENUE PARK - BUILDING RENOVATION CIP Project No. 331342 Emergency Need for Increase REFERENCES: In Contract ENCLOSURES: Based on information supplied to me by the Director of the Public Works Department, I have found that there exists an emergency need for an increase in contract amount of $25,000.00 in the contract between the City of Miami, Florida and Pino-Fonticiella and Associates, Inc. for the Grand Avenue Park - Building Renovation. The reason for the emergency need is as follows: Additional modifications were requested by the Parks and Recreation Department as well as the local neighbors, which include a new sewer connection, security louvers, handicap -ramp and graffiti seal from the exterior walls. This work can be readily accomplished at this time as the contractor is on site and working on the original -contract.
