RESOLUTION NO. ' 956
A RESOLUTION AUTHORIZING AN INCREASE IN THE
CONTRACT AMOUNT OF $25,000.00 IN THE CONTRACT
BETWEEN THE CITY OF MIAMI, FLORIDA AND
PINO-FONTICIELLA AND ASSOCIATES, INC., DATED
MARCH 26, 1990, FOR THE GRAND AVENUE PARK -
BUILDING RENOVATION, CIP PROJECT NO. 3313429
SAID FUNDS TO BE PROVIDED FROM THE CAPITAL
IMPROVEMENTS ORDINANCE NO. 107829 WITH FUNDS
ALREADY ALLOCATED TO THE PROJECT; FURTHER
RATIFYING THE CITY MANAGER'S WRITTEN FINDING
THAT THE HEREIN INCREASE RESULTED FROM
EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE
VOTE OF FOUR -FIFTHS OF THE MEMBERS OF THE
CITY COMMISSION, AND ADOPTING THE FINDINGS
AND CONCLUSIONS SET FORTH IN THE PREAMBLE OF
THIS RESOLUTION.
WHEREAS, there exists a contract dated March 26, 1990,
between the City of Miami, Florida and Pino-Fonticiella and
Associates, Inc., for GRAND AVENUE PARK - BUILDING RENOVATION,
CIP Project No. 331342; and
WHEREAS, an increase in contract of $25,000.00 is required to
cover the cost of necessary extra work such as a new sewer
connection, security louvers, handicap -ramp and a graffiti seal
for the exterior of walls, this work should be accomplished at
this time so as to make the building accessible to the public at
an earlier date; and
WHEREAS, the City Manager has made a written finding that a
valid emergency existed for the work to be done; and
WHEREAS, the Director of the Department of Public Works
recommends the increase in contract to cover the additional
costs; and
WHEREAS, funds to cover the increase are available from money
already allocated to the project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. After a properly advertised public hearing, the
finding of the City Manager set forth in the preamble to this
resolution is hereby ratified by an affirmative vote of four -
fifths of the City Commission, and adopted as if fully set forth
in this section.
Section 2. The contract between the City of Miami, Florida
and Pino-Fonticiella and Associates, Inc., for the Grand Avenue
Park -- Building Renovation, CIP Project No. 331342, dated March
26, 1990, is hereby increased by $25,000.00 with funds for the
increase to be provided from monies already allocated to the
project.
Section 3. The Resolution shall become effective immediately
upon its adoption pursuant to law.
PASSED AND ADOPTED this 6th day of December 1990.

ENCLOSURES:
It is respectfully recommended that the City Commission adopt
the attached resolution authorizing an increase in contract in
the amount of $25,000.00 in the contract between the City of
Miami, Florida and Pino-Fonticiella and Associates, Inc. for
the GRAND AVENUE PARK - BUILDING RENOVATION, CIP Project
No. .331342,, said funds to be provided from the 1991 Capital
Improvements Ordinance 10782 with funds already allocated to
the project; further ratifying the City Manager's written
finding that the herein increase resulted from emergency
circumstances by an affirmative vote of four -fifths of the
members of the City Commission and adopting the finding and
conclusions set forth in the preamble of this resolution.
BACKGROUND:
The Department of Public Works has determined that it is now in
order for the Commission to authorize an increase in contract
amount for the GRAND AVENUE PARK - BUILDING RENOVATION - CIP
Project No. 331342.
Additional modifications were requested by the Parks and
Recreation Department as well as the local neighbors, these
include a new sewer connection, security louvers, handicap -ramp
and graffiti seal for the exterior walls.
It has been decided to do this work at this time while there is
a contractor on the project and the additional improvements can
be completed expeditiously.
As required by City ordinances, an increase of $10,000 or more
in a City contract must be accompanied by a finding by the City
Manager that the increase resulted from emergency
circumstances, and such finding has been prepared and signed.
It is further required that a Public hearing be held, and the
Public Tearing has been scheduled.

Emergency Need for Increase
REFERENCES: In Contract
ENCLOSURES:
Based on information supplied to me by the Director of the
Public Works Department, I have found that there exists an
emergency need for an increase in contract amount of $25,000.00
in the contract between the City of Miami, Florida and
Pino-Fonticiella and Associates, Inc. for the Grand Avenue
Park - Building Renovation.
The reason for the emergency need is as follows:
Additional modifications were requested by the Parks

security louvers, handicap -ramp and graffiti seal from
the exterior walls.
This work can be readily accomplished at this time as
the contractor is on site and working on the original
-contract.
