RESOLUTION NO.90— 928
A RESOLUTION, WITH ATTACHMENTS, ACCEPTING THE
PLAT ENTITLED "KAMPONG PLAT", A SUBDIVISION IN
THE CITY OF MIAMI, SUBJECT TO ALL OF THE
CONDITIONS OF THE PLAT AND STREET COMMITTEE,
AND ACCEPTING THE DEDICATIONS SHOWN ON SAID
PLAT; ACCEPTING THE COVENANT TO RUN WITH THE
LAND POSTPONING THE IMMEDIATE CONSTRUCTION OF
CERTAIN IMPROVEMENTS UNTIL REQUIRED BY THE
DEPARTMENT OF PUBLIC WORKS; ACCEPTING THE
COVENANT TO RUN WITH THE LAND ALLOWING AN
EXISTING STONE WALL OF HISTORIC VALUE AND CHAIN
LINK FENCE TO REMAIN IN THE UNDEDICATED RIGHT
OF WAY OF S.W. 37 AVENUE (DOUGLAS ROAD) UNTIL
SUCH TIME AS SAID WALL AND FENCE ARE DEMOLISHED
OR DAMAGED BEYOND REPAIR AT WHICH TIME THE
SUBJECT RIGHT OF WAY SHALL BE DEDICATED TO THE
CITY AS SET FORTH THEREIN, AND REQUIRING THE
CONVEYANCE OF EASEMENTS AT THE APPROPRIATE TIME
FOR THE CONSTRUCTION OF SANITARY SEWERS;
ACCEPTING A UNITY OF TITLE WHICH CONSIDERS
TRACTS "C" AND "D" OF SAID PLAT AS ONE PLOT AND
PARCEL OF LAND IN ORDER TO PRESERVE CERTAIN
ACCESSORY STRUCTURES UNTIL RELEASED BY THE
DEPARTMENT OF PLANNING, BUILDING AND ZONING;
AUTHORIZING AND DIRECTING THE CITY MANAGER AND
CITY CLERK TO EXECUTE THE PLAT; AND PROVIDING
FOR THE RECORDATION OF SAID PLAT IN THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA.
WHEREAS, the City Department of Public Works recommends
the acceptance of the herein plat;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The plat entitled "Kampong Plat" is a
subdivision of the property described on Exhibit "A" attached
hereto, which plat by reference is made a part hereof as if fully
incorporated herein, and, which plat subject to all of the
conditions required by the Plat and Street Committee as set forth
as Exhibit "B" attached hereto, is hereby accepted. The
dedications shown on the plat together with the dedications to
the perpetual use of the public of all existing and future
planting, trees and shrubbery on said property, are hereby
accepted and confirmed by the City of Miami, Florida.

Section 2. The Covenant To Run With The Land executed
by the property owners, Catherine Hauberg Sweeney and the
National Tropical Botanical Garden, as set forth in Exhibit "C",
postponing the immediate construction of full width street
improvements (sidewalk, curb and gutter, pavement, drainage and
landscaping), until such time as required by the Department of
Public Works of the City of Miami is hereby accepted and the
proper officials are directed to record said covenant after the
plat has been recorded in the Public Records of Dade County,
Florida.
Section 3. The Covenant to Run With The Land In Favor
of the City of Miami executed by the property owners, Catherine
Hauberg Sweeney and the National Tropical Botanical Garden as set
forth in exhibit "D", allowing an existing stone wall of historic
value and chain link fence to remain within the undedicated right
of way until such time as said wall and fence are demolished or
damaged beyond repair, and at that time making mandatory the
dedication of the remaining undedicated right of way and
requiring the conveyance of easements to the City at the
appropriate time to allow for the construction of sanitary sewers
to serve the site, is hereby accepted and the proper officials
are directed to record said covenant after the plat has been
recorded in the Public Records of Dade County, Florida.
Section 4. The Unity of Title executed by the property
owners, Catherine Hauberg Sweeney and the National Tropical
Botanical Garden as set forth in Exhibit "E", which considers
tracts "C" and "D" of the Kampong Plat as one plot and parcel of
land in order to preserve certain accessory structures located on
tract "D", until such time as the Department of Planning,
Building and toning no longer requires said Unity of Title, is
hereby accepted and the proper officials are directed to record
said Unity of Title after the plat has been recorded in the
Public Records of Dade County, Florida.

Section 5. The City Manager and City Clerk are hereby
authorized and directed to execute the plat and cause the same to
be recorded in the Public Records of Dade County, Florida.
Section 6. This Resolution shall become effective
immediately upon its adoption.

The City of Miami Plat and Street Committee, at Its meeting of
November 27, 1990, approved the above tentative plat subject to the
following revisions being made to the tentative plat, additional
Information being provided and/or variances being granted. Please
be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied.
- A unity of title will be required to ensure that the
accessory structures on tract "D" are not separated
from the main structure located on tract "C".
- Show ail required zoning on location sketch: R-1 with
SD-18 overlay.
- A mean high water survey may be required by
Metropolitan Dade County.
- Provide a name for the private road.
- Indicate the width of the private road.
- All requirements of utility companies must be
satisfied.
- Correct the spelling of "Kiebba Drive" In the
Surveyor's notes.

some cases this could represent a substantial Investment
on your part.
2. The alteration, relocation or Installation of utilities
such as storm and sanitary sewers, electric, telephone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.

3. A building permit will not be Issued on the property being
platted until the final plat Is recorded. Also, the
Certificate of Occupancy for any building construction will
be Issued only after all the required subdivision
Improvements have been completed.
4. Approval for fire flow requirements must be obtained from
the Fire, Rescue and Inspection Services Department prior
to the Issuance of a building permit.
5. Additional Items must be provided to the City of Miami
Department of Public Works before the final plat is
submitted to the City Commission for approval. You will be
notified in writing as to what these Items are after the
amount of the bond has been determined for the necessary
subdivision Improvements.
6. Tentative plat approval Is only valid for one (1) year from
the date of the Plat and Street Committee Meeting at which
time It was approved.

COVENANT TO RUN WITH THE LAND
WHEREAS, NATIONAL TROPICAL BOTANICAL GARDEN, a
congressionally chartered scientific and educational
organization for tropical studies, formerly known as PACIFIC
TROPICAL BOTANICAL GARDEN, a congressionally chartered,
scientific and educational organization for tropical studies
(hereinafter referred to as "the Owner" or "he" irrespective
of actual gender and number, and meaning either singular or
plural and including heirs, assigns and successors in
interest thereof, where the context so requires or admits) is
the present fee simple owner of a subdivision entitled
Kampong Plat, according to the plat thereof, as recorded in
Plat Book , at Page , of the Public Records of Dade
County, Florida; and
WHEREAS,. the City of Miami, a municipal corporation in
the State of Florida, in the County of Dade (hereinafter
referred to as the "CITY"), pursuant to Chapter 54, of The
Code of the City of Miami, Florida, requires the OWNER to
construct or cause to be constructed, at no expense to the
CITY, the following improvements within the area and/or on
the streets abutting said subdivision.
Sidewalk, curb and gutter, drainage, asphalt
paving and landscaping;
and
WHEREAS, the OWNER has asked to be relieved of his
obligation to construct the aforementioned improvements at
this time, and in consideration of the forbearance of the
CITY he agrees with the CITY that he will, at his own
expense, construct the aforementioned improvements at such
time in the future as he is notified by the CITY that the
aforementioned improvements are necessary or desirable.
NOW, THEREFORE, in consideration of the premises herein
and other good and valuable consideration, the OWNER hereby
covenants and agrees with the CITY to construct or cause to
be constructed at the expense of the OWNER, and without cost
to the CITY, the aforementioned improvements within the area
and/or on the street right-of-way abutting the aforesaid
subdivision, upon thirty (30) days written notice from the
Director of Public Works of the City of Miami, Florida,
addressed to the OWNER, at P.O. Box 340, Lawai, Kauai, Hawaii
96765.
It is expressly agreed that this obligation shall be
binding upon the OWNER, his heirs, successors in interest or
assigns, and shall be a condition implied in any conveyance
or other instrument affecting the title to the aforesaid
subdivision or any portion thereof.
In the event that the OWNER or any future fee simple
owner of any lot or tract in said subdivision shall fail to
cause the aforementioned improvements to be constructed
within the area, and/or in the street right-of-way abutting
the property platted as herein provided within thirty (30)
days after the mailing of the written notice from the
Director of the Department of Public Works of The City of
Miami, Florida, then the City Manager of The City of Miami,
Florida shall act as agent of the OWNER or any fee simple
owner of any lot, tract or parcel described in said written
notice, which agency is hereby specifically created, and said
City Manager shall cause the aforementioned improvements to
be constructed at the expense of the OWNER and/or said fee
simple owner, and the amount of such construction cost shall
be declared and established as a lien on the property of such
defaulting OWNER and/or said fee simple owner, and enforced

as any lien for materials furnished and work and labor done,
as provided under the Statutes of Florida.

COVENANT RUNNING WITH THE LAND IN FAVOR OF THE CITY OF MIAMI
THIS COVENANT, made and entered into this 28 day of
November, 1990, by NATIONAL TROPICAL BOTANICAL GARDEN, a
congressionally chartered scientific and eduational organization
for tropical studies, formerly known as PACIFIC TROPICAL
BOTANICAL GARDEN, a congressionally chartered scientific and
educational organization for tropical studies (the "OWNER"), and
the CITY OF MIAMI, a municipal corporation of the State of
Florida, in the County of Dade, (the "CITY");
WITNESSETH:
WHEREAS, OWNER is the fee owner of that certain property
legally described as Tracts A. B, C and D, RAMPONG PLAT,
according to the plat thereof, as recorded in Plat Book ,
at Page , of the Public Records of Dade County, Florida (the
"PREMISES"); and
WHEREAS, the PREMISES were recently replatted at the request
of OWNER;
WHEREAS, as a condition to its approval of the replatting of
the PREMISES, CITY required certain agreements and
acknowledgements from OWNER as more particularly described and
set forth herein.
NOW, THEREFORE, in consideration of the foregoing premises,
the approval of the CITY to the replatting of the PREMISES, and
other good and valuable consideration, OWNER hereby covenants,
promises and agrees as follows:
1. That at such time as the existing stone wall of
historic value and the chain link fence located within the
officially established but undedicated right-of-way of Douglas
Road are demolished or damaged beyond repair, then OWNER shall
dedicate to the CITY as additional right-of-way for the said
public road, a strip of land 15 feet wide and lying in the
westerly most portion of the PREMISES and running adjacent and
parallel to S.W. 37th Avenue (Douglas Road), and OWNER shall
remove said wall and fence encroachment.
2. That at such time as the CITY shall require the
installation of sanitary sewer lines through or under the
PREMISES, then OWNER shall dedicate and convey to CITY easements
over and through the PREMISES as reasonably required by CITY for
such purposes.
3. OWNER does hereby covenant to indemnify, defend, save
and hold harmless CITY from any claims, demands or liabilities of
any nature whatsoever arising out of or because of this
instrument.
4. This Covenant shall be recorded in the Public Records

PERTINENT INFORMATION REGARDING THE PLAT:
1. The property platted is a r e p 1 a t of Lots 110" and "P" of

5. There is a Life Estate reserved in Catherine Hauberg Sweeney
as set forth in Deed of Gift filed in Official Records Book
12291, Page 18, Public Records of Dade County, Florida.
6. The area platted is not encumbered by mortgages.
7. Since there is no sidewalk, curb and gutter or drainage on
Douglas Road in the vicinity of the property platted, it is
recommended that a covenant be accepted postponing the
immediate construction of these improvements until the area
is more fully developed. In addition, a rock wall of
historic significance and chain link fence occupy a portion
of the undedicated right of way abutting the property. For
this reason it has been determined by the Supervisor of
Plats that right of way dedication encompassing the area of
the wall and fence will not be required at this time.
However, a covenant will be required which mandates the
dedication should the wall be demolished or damaged beyond
repair. Also, a covenant will be required which will
obligate the owner to grant a utility easement should the
City decide to construct sanitary sewers within the South
Grove District. A unity of title has also been required to
ensure that the accessory structures located on tract "D"
are not separated from the main structure, which is located
on tract "C".
8. The attached Resolution has been prepared for the acceptance
of the Plat by the City Commission of Miami, Florida.

Please be informed that I plan to bring up as a Pocket Item at the
December 6, 1990 City Commission meeting the replat of the Kampong,
Dr. David Fairchild's famous home located at 4013 Douglas Road in
south Coconut Grove. This matter was originally on our December 6
agenda but was not fully prepared for distribution on November 28.
The attached information is provided in connection with the replat of
the Kampong. The plat and Street Committee recommended approval of
the replat on November 27, subject to certain conditions. These
conditions have been fulfilled.
Some additional discussion information provided is as follows:
The replat is submitted in order to satify the
requirements of the Dade County Property Appraiser
to qualify the estate for a reduced level of real
property taxes. The estate was given by Ms. Catherine
Sweeney to the National Tropical Botanical Garden, a
nonprofit corporation created by an act of Congress.
The Garden is charged with operating the Kampong as an
international center for tropical plant research and
preservation. Without the City Commission's approval
and recording of this replat before January 1, 1991,
the Kampong must pay $ 97,000 in taxes for 1990 alone.
The Kampong's total annual budget is less than
$300,000. Taxation at the full rate will bankrupt the
Garden and could force the development of the estate
into homesites.
