RESOLUTION NO. 9 0 926
A RESOLUTION RELATED TO THE TASTE OF THE
GROVE FESTIVAL TO BE CONDUCTED BY THE TASTE
OF THE GROVE COMMITTEE, ON JANUARY 19-20,
1991; AUTHORIZING THE CLOSURE OF DESIGNATED
STREETS TO THROUGH VEHICULAR TRAFFIC SUBJECT
TO THE ISSUANCE OF PERMITS BY THE DEPARTMENTS
OF POLICE AND FIRE, RESCUE AND INSPECTION
SERVICES; AUTHORIZING A TWO-DAY PERMIT TO
SELL BEER AND WINE IN CONNECTION WITH SAID
EVENT SUBJECT TO THE ISSUANCE OF ALL PERMITS
REQUIRED BY LAW; ESTABLISHING AN AREA
PROHIBITED TO NON -FESTIVAL RETAIL PEDDLERS
DURING THE PERIOD OF SAID EVENT; CONDITIONED
UPON THE ORGANIZERS PAYING FOR THE NECESSARY
COSTS AND SUBJECT TO THE ORGANIZERS OBTAINING
INSURANCE TO PROTECT THE CITY IN THE AMOUNT
PRESCRIBED BY THE CITY MANAGER OR HIS
DESIGNEE.
WHEREAS, the Taste of the Grove Committee will conduct the
Taste of the Grove Festival on January 19-20, 1991; and
WHEREAS, certain streets shall be closed to through
vehicular traffic during specified dates and hours to insure the
safety of the participants and pedestrians attending this event;
and
WHEREAS, the Taste of the Grove Committee has requested
permission to sell beer and wine for a two-day period in
connection with the Taste of the Grove Festival on Saturday,
January 19, 1991 and Sunday, January 20, 1991; and
WHEREAS, the Taste of the Grove Committee has requested
authorization that retail peddlers be prohibited within a
specified area and for a specific period of time during the
festival; and
WHEREAS, the restriction imposed by Ordinance No. 10764 as
to the limitation of the number of events in the Coconut Grove
Special
Events
District does
not
apply
to the
Taste
of the Grove
Festival
since
this event
has
been
held in
the
past in the
Coconut Grove area;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. In the interest of safety during the Taste of
the Grove Festival, to be conducted by the Taste of the Grove
Committee, the following streets are hereby closed to through
vehicular traffic from 12:00 midnight Friday, January 18 through
12:00 midnight Sunday, January 20, 1991:
McFarlane Road from South Bayshore Drive to Main Highway.
South Bayshore Drive from McFarlane Road to Mary Street.
Included in the herein closure are all streets, avenues,
alleys, ways and thoroughfares which intersect the
enumerated areas delineated in this Section.
Section 2. Such closing of streets is subject to State
approval and the issuance of permits by the Departments of Police
and Fire, Rescue and Inspection Services. Said permit from the
Department of Police is to be issued upon full approval of the
Chief of Police after giving all due consideration to the safety
and traffic needs of residents, businesses, and religious
institutions in the area for entering and crossing through said
arterials and upon the favorable exercise of the City Manager's
judgment predicated upon all factors set forth herein.
Section 3. Upon the issuance of a temporary permit by the
Florida State Department of Business Regulation, Division of
Alcoholic Beverages and Tobacco, to sell beer and wine, and
pursuant to the City Code 54-12.1, the request of the organizers
to sell beer and wine for a two-day period in connection with the
Taste of the Grove Festival on January 19-20, 1991, is hereby
granted subject to the issuance of all permits required by law.
Section 4. Pursuant to the provisions of City Code Section
39-13, all retail peddlers' occupational licenses issued under
the provisions of Chapter 31 of the City Code, as amended, will
not be applicable or valid on January 19-20, 1991, during the
hours described in Section 1 and in the area of the public right-
of-way included within and adjoining the streets and avenues
described in Section 1 for two blocks in all directions.

Section 5. Such authorization of the street
closures
described in Section 1 herein and the inapplicability
of retail
peddlers' licenses described in Section 2 herein are
hereby
conditioned upon the organizers obtaining insurance to protect
the City in the amount prescribed by the City Manager
or his
designee and upon the organizers paying for all the
necessary
costs of City services associated with said event.
Section 6. This Resolution shall become
effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached resolution authorizing the necessary street closures
establishing a pedestrian mall, the restriction of non -festival
retail peddlers and a two-day permit to sell beer and wine in
connection • with the Taste of the Grove to be conducted by the Taste
of the Grove Committee on Saturday and Sunday, January 19-20, 1991.
The street closures are subject to the issuance of all permits
required by law and compliance with such conditions and limitations
as prescribed by the City of Miami. These authorizations -are
conditioned upon the organizers paying for all the necessary costs of
City services and subject to the organizers obtaining insurance to
protect the City in the amount to be prescribed by the City Manager
or his designee.
BACKGROUND:
The Department of Community Development has prepared the appropriate
legislation in connection with the Taste of the Grove to be conducted
on January 19-20, 1991. The 'Taste of the Grove Committee has
requested the aforementioned authorizations in connection with said
event.
The limitations on the number of events in the Coconut Grove Special
Events District do not apply in this case, since the aforementioned
event has been held in the Grove in the past.
