RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO ACQUIRE BY NEGOTIATED PURCHASE THE FEE SIMPLE TITLE TO A PARCEL OF REAL PROPERTY LOCATED AT APPROXIMATELY 129 NORTHWEST 34TH TERRACE (BETWEEN NORTHWEST FIRST AND SECOND AVENUES), MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN), FOR THE PURPOSE OF EXPANDING THE ROBERTO CLEMENTE PARK; PURSUANT TO AN UPDATED APPRAISAL BY GABRIEL GARCIA-MENOCAL, MAI, AT THE FAIR MARKET VALUE OF $55,500 WITH FUNDS THEREFOR BEING ALLOCATED FROM THE CAPITAL IMPROVEMENT PROGRAM, CLEMENTE PARK RENOVATION PROJECT NO. 331056. WHEREAS, the City Commission of the City of Miami is striving on a continuous basis to provide adequate open spaces in the form of public parks for the use and enjoyment of the citizens of the City of Miami; and WHEREAS, Resolution No. 88-654 authorized the acquisition, by negotiated purchase or condemnation, of twelve (12) lots, including the subject lot, for the expansion of the Roberto Clemente Park, at the appraised value or for not more than five (5%) percent above the appraised value; and WHEREAS, ten (10) of said twelve (12) lots have been acquired in accordance with Resolution No. 88-654; and WHEREAS, pursuant to an updated appraisal done by Gabriel Garcia-Menocal, MAI, the Fair Market Value was appraised to be $55,500; and WHEREAS, the owner of the lot in question has accepted an offer by the City of $55,500 as the Fair Market Value of this property; and WHEREAS, said lot will be the last lot to be acquired for the Roberto Clemente Park expansion project; and WHEREAS, the subject negotiated purchase would be in the City's best interest; CITY COMMISSION MEETING OF DEC 6 IM 90- 923 mmema I # # NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized to acquire by negotiated purchase the fee simple title to a parcel of real property located at approximately 129 Northwest 34th Terrace (between Northwest First and Second Avenues), Miami, Florida, more particularly described as Lot 21, Block 5, Wyndwood Park as recorded in Plat Book 5 at Page 23 of the Public Records of Dade County, Florida, pursuant to an updated appraisal dated May 30, 1990, by Gabriel Garcia-Menocal, MAI, at the Fair Market Value of $55,500 with funds therefor being hereby allocated from the Capital Improvement Program, Clemente Park Renovation Project No. 331056. Section 3. This Resolution shall become effective immediately upon its adoption. Odio FROM City Manager CA=1C DATE N O v 2 71990 FILE Resolution Authorizing SUBJECT Acquisition of Property for Roberto Clemente Park'Expansion REFERENCES For Commission Meeting ENCLOSURES of December 6 , . 1990 It is respectfully recommended that the City Commission adopt the attached resolution authorizing the City Manager to acquire, for the expansion of Roberto Clemente Park, by negotiated purchase the fee simple title of a parcel of real property located at 129 N.W. 34 Terrace pursuant to an updated appraisal by Gabriel Garcia-Menocal, MAI, at the Fair Market Value of $55,500. The Department of Development, Property & Lease Management Division, has been acquiring real property in the area of Roberto Clemente park for the expansion and renovation of the park in accordance with Resolution 88-654. This resolution stated that acquisitions were to be made at the appraised value or for no more than five (5%) per cent above the appraised value. Of the twelve lots to be acquired, ten have been acquired in accordance with Resolution 88-654. Two offers have been made to acquire Lot 21, Block 5, Wyndwood Park as recorded in Plat Book 5 at Page 23. The first one had been in accordance with the resolution. It was rejected. An updated appraisal by Gabriel Garcia-Menocal, MAI, was conducted on this property and showed the Fair Market Value to be $55,500. It would be most advantageous to the City to acquire this property by negotiated purchase in lieu of condemnation at a cost of $55,500 which is an acceptable offer to the owner. Funds for this acquisition are allocated from the Capital Improvement Program, Clemente Park Renovation Project No. 331056. Attachments: Proposed Resolution 90- . 923 14 r%.' C19 /0 - - -- -
