HomeMy WebLinkAboutO-10821J-90-886 11/08/90 ORDINANCE NO. 10821 AN EMERGENCY ORDINANCE MAKING APPROPRIATIONS FROM THE DOWNTOWN DEVELOPMENT DISTRICT AD VALOREM TAX LEVY AND OTHER MISCELLANEOUS INCOME FOR THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA, FOR TWO -SIXTHS (2/6) (DECEMBER 11 1990, TO MARCH 31, 1991) OF THE FISCAL YEAR ENDING SEPTEMBER 30, 1991; AUTHORIZING THE EXECUTIVE DIRECTOR OF THE DOWNTOWN DEVELOPMENT AUTHORITY TO INVITE OR ADVERTISE REQUIRED BIDS; PROVIDING BUDGETARY FLEXIBILITY; PROVIDING THAT THIS ORDINANCE BE DEEMED SUPPLEMENTAL AND IN ADDITION TO THE ORDINANCE MAKING APPROPRIATIONS FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1991, FOR THE OPERATIONS OF THE CITY OF MIAMI; CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Board of Directors of the Downtown Development Authority of the City of Miami has approved and submitted to the City Commission a Budget Estimate of the expenditures and revenues of the Downtown Development Authority for the Fiscal Year 1990-1991, as prepared by the Executive Director of the Downtown Development Authority, copies of such estimates having been made available to the newspapers of the City; and WHEREAS, this operating budget of the Downtown Development Authority includes changes within said budget which reflect the expressed intention of the City Commission in regard to concerns raised by the City Commission at its meeting of September 7, 1990; and WHEREAS, the City Commission has reviewed the Downtown Development Authority's Budget Estimate and has approved appropriations as herein set forth; and WHEREAS, the City Commission adopted Ordinance No. 10796, on September 27, 1990, appropriating one -sixth (1/6) of the Downtown Development Authority's Fiscal Year 1990-1991 representing projected operating expenses for the two (2) month period of October and November, 1990; and 10821 WHEREAS, the City Commission now desires to appropriate the remaining projected budget requirements for the Fiscal Year 1990-1991; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following appropriations for two -sixths (2/6) of the Fiscal Year 1990-1991 be, and the same are hereby made, for the maintenance and for the purpose of financing the operations and other legal and proper purposes of the Downtown Development Authority of the City of Miami, Florida: Appropriation Amount Personnel Services $191,330 Professional Services 61,294 Operating Expenses 222,904 Total Appropriated Funds: $475,528 Reserve For Tax Shortfall $ 33,334 SOURCE OF REVENUE Ad Valorem Tax Levy Within The Downtown Development District $492 612 OTHER REVENUES Miscellaneous Income $ 16,250 Total Revenues For Budget $508 862 Section 3. Said appropriations are the anticipated expenditure requirements for the Downtown Development Authority for the period December 1, 1990, to March 31, 1991, but are not mandatory should efficient administration of the Downtown Development Authority or altered economic conditions indicate that a curtailment in certain expenditures is necessary. The Executive Director of the Downtown Development Authority, with approval of the Board of Directors of the Downtown Development Authority, is specifically authorized to withhold any of these - 2 - 10821 appropriated funds from encumbrance or expenditure should such action appear advantageous to the economical and efficient operation of the Downtown Development Authority. Section 4. The Executive Director of the Downtown Development Authority, with the approval of the Board of Directors of the Downtown Development Authority, is authorized to make transfers between the detailed accounts comprising any of the amounts appropriated by Section 2 hereof, in order that available and required balance in any such account may be used for other necessary and proper purposes. Section 5. The Executive Director of the Downtown Development Authority is hereby authorized to invite or advertise for bids for the purpose of any material, equipment or services embraced in the aforementioned appropriations, for which formal bidding is required, such bids to be returnable as required by law. Section 6. This Ordinance shall be deemed supplemental and in addition to the ordinance making appropriations for the Fiscal Year ending September 30, 1991, for the operations of the City of Miami. Section 7. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 8. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 9. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 10. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the City Commission. - 3 - 10821 Section 11.
