HomeMy WebLinkAboutO-10815'_ J-90-1043 12/6/90 ORDINANCE N0. 1 ~ ~ 1 rJ AN EMERGENCY ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "WYNWOOD ENTERPRISE ZONE SAFE NEIGHBORHOOD CAPITAL IMPROVEMENT PROJECT"; APPROPRIATING FUNDS THEREFOR IN THE AMOUNT OF $100,000 TO BE 1 RECEIVED AS A GRANT FROM THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS; AND 1 AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE STATE OF FLORIDA, IN SUBSTANTIALLY THE FORM ATTACHED, TO ACCEPT THE GRANT TO IMPLEMENT THE PROJECT IN ~ ACCORDANCE WITH APPLICABLE CITY CODE ' PROVISIONS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. .WHEREAS, by Sections 164-501-163.522, Florida Statutes, the State Legislature created the Safe Neighborhood Act, with responsibility for its operation being placed upon the Florida Department of Community Affairs; and WHEREAS, in accordance with the provisions of the Safe Neighborhood Act, the Miami City Commission created the Wynwood Safe Neighborhood Improvement District (WynwoodSNID) by the adoption of Ordinance No. 10406 on March 24, 1988, as amended by Ordinance No. 10522, adopted on November 17, 1988; and WHEREAS, the completed Wynwood Safe Neighborhood Plan recommends the establishment of a Wynwood Foreign Trade Zone at N.W. 5th Avenue and N.W. 22nd Street to accomplish the dual goal of increasing employment and reducing crime; and WHEREAS, the 1990 Legislature of the State of Florida appropriated $100,000 in Specific Appropriation Number 223D for Enterprise Zone Safe Neighborhood Capital Improvement projects; and ` WHEREAS, these funds will be provided to the Wynwood Community Economic Development Corporation to accomplish preliminary work needed for the construction of a Wynwood based Foreign Trade Zone to provide affordable warehouse and manufacturing space for small and minority businesses; i ~~~1~ r ' NOW, THEREFORE , BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: Fund Title: Wynwood Enterprise Zone Safe Neighborhood Capital Improvement Project Resources: Florida Department of Community Affairs $100,000 Appropriations: Wynwood Enterprise Zone Safe Neighborhood Capital Improvement Project $100,000 Section 2. The City Manager is hereby authorized to execute ~ a contract with the State of Florida, in substantially the form attached, to accept the grant and to implement, in accordance { with applicable city code provisions, the Wynwood Safe '4 Neighborhoad Improvement District Plan which incorporates a f Foreign Trade Zone project. Section 3. A11 ordinances or part of ordinances insofar as they are inconsistent or in conflict with provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or ward of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami upon the further ground of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs; more particularly to implement without delay the intent of the State Legislature. { Section 6.
