PLANNING RECOhMEN0ATI0N Approval. BACKGROUND This segment of NM 54th~Street was classified as C-5 Liberal Commercial in ionin Ordinance b$91, Zoning Ordinance 950Q in 193 eontinudd ~n equivalent zoning classification -- CG•~/1. The zoning classification ryas substantially, opg,rAd~d by ~ change tQ C-~ ~estricte~i ~om~rCial in ~99b ~. ~~"" ~$ • when Zoning Ordinance 11000 took effect, leaving certain properties in a legal non-conforming • • status unable to expand substantially. ANALYSIS This segment of NW 54th Street is characterized by those con~aercial uses which a) do not depend on "walk-in" business or on the immediate neighborhood or b) presant a negative appearance by reason of the kinds of business activities in which they are engaged.. Businesses -include paint and body shops, contractor's offices and yards, auto repair.. garages, storage yards,- electrical actor repair shop and an air conditioning service in addition to other- commercial and residential uses. While the intent was to upgrade the kinds of businesses in this seg~ent, the economics of business dictate that restricted. commercial - businesses already have 'care than aa+p1e zoning 'districts in which to locate and are.andike,l,y to°. l ocete here.' The existing`, "heavy" _ commercial • businesses are left in an untenable status; they;'- ; wilt reeain in business for' the foreseeable future, they are non-conforeing with .respect to. the Zoning Ordinance and are restricted from - expanding their operations significantly. This proposed designation would accoaiodate all.-the... existing uses while still leaving open: the possibility of new "restricted" businesses to' come in. PLANNING ADVISORY BOARp At .its meeting of May 1, 1991, the Planaing Advisory . Board adopted Resolution PAB 29-91 by•a 9 Co 0 rote, recommending denial of the above. Fl. 33128 Re: Proposed Rr-zoning of N W 54th Street from N W'2nd Ave to N W bth Ave. Dear Sir: As the property owner of 253 N W 54 Street, I request that the proposed zoning change from C-a Restricted Commercial to C-2 Liberal Commercial be granted. This part of 54th Street is a stable, active commercial street, reflecting a mix of established businesses and an area where new enterprises are welcome. To continue the lia+itation of Restricted Commercial will put present owners and/or tenants at a disadvantage in future sales ore rentals of the properties Again, I urgently request this rezoning. S.
