PAB 28-91, by a 9 to O vote, im nt to the Future Land Use Map of Neighborhood Plan 1989-2000, as WHEREAS, notwithstanding the the Miami Comprehensive inafter set forth; and ommendation of the Planning Advisory Board, the City Commission, fter careful consideration of this matter, deems it advisable an in the best interest of the general welfare of the City of Miam' grant this Comprehensive Plan change as h NOW, THEREFORE, BE IT ORDAINED BY THE OF MIAMI, FLORIDA: and its inhabitants to inafter set forth; OMMISSION OF THE CITY Section 1. The Future Land Use Map of 0 dinance No. 10544, as amended, the Miami Comprehensive Neighborho Plan 1989-2000, is hereby amended by changing the land use esignation from Restricted Commercial to General Commercial for th area fronting both sides of Northwest 54th Street between Northwe t 2nd and 6th Avenues (I-95), Miami, Florida, more particularly escribed as Lots 1-9 and Lots 19-21 of Block 10, Lots 1-3 and 7- of Block 11, and Lots 1-10 and 21-23 of Block 12, inclusive, RAI AY SHOPS ADD 2ND AMEND, according to the plat thereof, as recorded in Plat .~~EN~c~'~- ~~ '1~~'T"t t~ni 91-- 4'79 book 3 ~t Page 183 of the Public Records of bade County, Florida; Lots 11-15 of Block 9, Lots 11-15 of Block 10, Lots 11-15 of block 11, and Lots 11-15 of Block 12, inclusive, BUENA VISTA GDN5, according to the plat thereof, as recorded in Plat book 5 at Page 45 of the Public Records of Dade County, Florida; and Lots 13-24 of Block 4, RAILROAD SHOPS INTER-SCHOOL TR, according to the plat thereof, as recorded in Plat Book 3 at Page 192 of the Public Records of Dade County, Florida. Section 2. It is hereby found that this Comprehensive Plan designation change: a. is necessary due to changed or changing conditions; b. is one which involves property that has not been the specific subject of a Comprehensive Plan change within the last year; and c. is one which does not involve the same owner's property within 200 feet of property that has been the subject of a Comprehensive Plan change within the last year. Section 3. The City Manager is hereby instructed to direct _ the Director of Planning, Building and Zoning to transmit a copy of this Ordinance immediately upon approval on first reading to - Bill Sadowski, Secretary, Florida Department of Community _ Affairs, 2740 Centerview Drive, Tallahassee, Florida 32399-2100, _ for 90 day review and comment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of this section, paragraph, ;- clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. `3: Section 6. Businesses .include paint and body shops, contractor's offices and yards, auto repair garages, storage yards, electrical rotor repair shop and an 'air conditioning service in addition to other coe~ereial and residential .uses. Odio er,c~osuaes: Agenda Item; City Commission City Manager Meeting of June 20, 1991 At .the Commission meeting of May 23, 1991, during discussion of Items PZ-2 and 3, ertaining to the C-2 liberal Commercial Zoning Districts on NW 36th Street and also Items PZ-11 and 12 on NW 54th Street), you raised the problem of a businessperson who,. after buying a commercial building on NW 36th Street, with no (or .insufficient) offstreet parking, then applies for; a zoning variance for parking, and is then denied by the Zoning Board. because o.f .the difficulty in meeting the "hardship" test in the Zoning_Ordinance. You-then requested the Planning, Building and Zoning Department to evaluate - alternatives for consideration. Alternatives -For ;discussion purposes, the..following alternatives are presented and ranked according to desirability, together with their pro's and con's. Alternative A:-For all C-2 districts City-wide. prohibit all auplications for variances from off-street a~rkina requirements. A. new businessperson, buying a vacant commercial establishment, would either have to >provide sufficient parking spaces on his .property or buy adjacent commercial property to satisfy the parking requirement. If a businessperson could assume a previous Certificate of Use, he_would be able to open the business with whatever parking was available to the previous: owner, even if `deficient. If the businessperson faces a choice between two locations in a C-2 Zoning District: one, with parking sufficient to meet the City's requirements and the second with insufficient parking, and realizing that there will be a two months wait before a public hearing on a parking variance, coupled with the additional. uncertainty of obtaining the variance, will probably choose the first location. These locational decisions occur hundreds of times per year throughout the City. The net effect is to favor these sites with adequate parking or situations in which a former CO can be utilized. When a .variance is granted from all or a portion of the Off-Street parkingy requirements, in non-residential areas, conditions can be established which require that the, applicant make a payment to the Off-Street Parking Department of a sum equivalent to the estimated normal, current cost of providing. required parking spaces to serve the contemplated use. Payments would be made in one lump sum. prior. to ;the issuance of a building permit and/or business license. Funds derived ..from such payments shall be deposited in a special fund, and, unless theapplicant consents otherwise, are to be used and expended exclusively for the .purpose of planning, designing, acquiring, and -_ developing off-street parking. facilities located, insofar as is practical, in the general vicinity of the property for which the in-lieu payments were made. Estimated costs_ per space range from X1,000-X2,000 for surface lots and `from 57,000-510,000 for. structure parking. Any off-street parking 'variance satisfied in this manner would run with the land, and any subsequent change of use that requires more parking will trigger additional 'similar 'actions; no refund will be made when there is a change to a'use requiring less 'parking: cc: Xavier L. DISCUSSION The subject 9.27 acre site is comprised of the lots fronting on`NW 54th - Street,--from NW 2nd to 6th Avenues, in the Edison/Little River CD Target Area.. of Panning District A. The majority of the subject area is characterized by those commercial uses which a) do not depend on "walk-in" business or on'the immediate neighborhood or, b) present 'a negative appearance... by reason of the kinds of business activities in which they are engaged. Businesses include paint and. body shops, contractor's offices and yards, auto repair shops. ,and. an air conditioning service in addition to other commercial and residential uses. Miami Comprehensive :Neighborhood. Plan (MCNP) Land.• Use Policy 1.6.1:`, establishes future land use categories according to the i:uture land Use ,`Plan Map and the "Interpretation of the..: Future' Land Use Plan Map". The subject ` property. is currently designated "Restricted•Conmercial". Areas of the same designation are located to the east and west of the subject property, wtiile to the north and south there are "Residential -Duplex" land.`use designations. The ".Restricted-Commercial" land use category allows residential` uses ~~ (exceptin rescue missions) to a maximum density equivalent to "High' Density Multifamily Residential" subject to the same limiting conditions;... anyy activity included in the "Office" designation as wail as commercial activities that generally serve the daily retailing and service needs of the public, typically t= requiring.easy: access by personal auto, and often located along arterial cr collector roadways, which include: general retailing, personal and professional services, .real estate, banking and other financial services, restaurants, sa]oons and cafes. general entertainment facilities, private clubs and recreation facilities, major sports and exhibition or entertainment. facilities and ether commercial activities whose scale and land use impacts -.,,.r ~` ~~~ `4'~9 C _:.~. ~~~~ ~" ~ ~ are similar in nature to those uses described above, places of worship, and primary and secondary schools. .This category also includes commercial marinas and living quarters on vessels as permissible. "General-Commercial" land use category allows all activities included in the "Office" and xhe "Restricted-Commercial" designations (with the exception of permanent living facilities but including rescue missions), as well as wholesaling and distribution activities that generally serve the needs of other businesses; generally require on and off loading facilities; and benefit from close proximity to industrial areas. These commercial activities include retailing of second hand items, automotive repair services, new and used vehicle sales,. parking lots and garages, heavy equipment sales and service, building material sales and storage, wholesaling, warehousing, distribution and transport related services, light manufacturing 'and assembly and other activities whose scale of operation and land use impacts are similar to those described above. This category also allows commercial marinas and living quarters on vessels for transients. The proposed change would be consistent with MCNP land Use Goal LU-1, which requires the City to promote the efficient use of .land use and minimize land _ use conflicts by changing the land use designation to reflect the existing land uses. The change also, would be consistent with Policy LU~1.1.3. which requires that all areas of the City be protected from encroachment of incompatible land uses. Housing Policies HO-1.1.5. and 1.2.7. require the City to preserve. and enhance the' general appearance and character of the:: City neighborhoods. Together these goals and policies argue that the land use designation in this area should be changed to reflect the land use pattern. In addition,.
