RESOLUTION NO.
A RESOLUTION, WITH ATTACHMENT, OFFICIALLY
CLOSING, VACATING, ABANDONING AND DISCONTINUING
THE PUBLIC USE OF THAT PORTION OF THE PRIVATE
ROADWAY LOCATED IN TRACT C OF CLAUGHTON
SUBDIVISION ON CLAUGHTON ISLAND, MIAMI, FLORIDA,
AS RECORDED IN PLAT BOOK 133 AT PAGE 16 OF THE
PUBLIC RECORDS OF DADE COUNTY, FLORIDA; SAID
CLOSURE, ABANDONMENT AND DISCONTINUANCE BEING A
CONDITION FOR THE APPROVAL OF TENTATIVE PLAT NO.
1399 - "CLAUGHTON ISLAND".
WHEREAS, the Miami Zoning Board at its regular meeting of
May 6, 1991, Item No. 3, following an advertised hearing, adopted
Resolution No. ZB 22-91 by a nine to zero (9-0) vote, RECOMMENDING
official vacation and closure of the private roadway as herein set
forth, in accordance with all recommendations of the Plat and
Street Committee; and
WHEREAS, the City Commission finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of the private
roadway and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference thereto
and incorporated herein as if fully set forth in this Section.
Section 2. The portion of that private roadway located in
Tract C of Claughton Subdivision on Claughton Island, Miami,
Florida, as recorded in Plat Book 133 at Page 16 of the Public
Records of Dade County, Florida is hereby closed, vacated,
abandoned and discontinued for public use, said closure, vacation,
abandonment and discontinuance being a condition for the approval
of Tentative Plat No. 1399 - "CLAUGHTON ISLAND", and also being
subject to conditions required by the Plat and Street Committee as
set forth in Exhibit "A" attached hereto.

The City of Miami Plat and Street Committee, at Its meeting of
April 5, 1991, approved the above tentative plat subject to the
following revisions being made to the tentative plat, additional
Information being provided and/or variances being granted. Please
be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied.
- Add bearing on westerly 38-foot line.
- indicate present zoning designation on location sketch.;
Also Include adjacent properties.

- A water main extension with hydrants will be required
(Contact Robert Florello, Miami Fire Dept.).
- Satisfy the requirements of Florida Power & Lighti
Company regarding easements..
- The Plat and Street Committee has reviewed your request

to vacate and close a portion of Tract "C" (133-16), a
platted private road, and finds that It conforms to the
pubiic Interest considerations of Sec. 54.5-16(c) of
the Miami City Code as well as all other technical
requirements of Chapter 54.5. The Plat and Street
Committee recommends In ,favor of the proposed vacation
and closure.
In addition to the above requirements, you should be aware of
the following:
1. State and local laws require the installation of various
physical Improvements In the public rights -of -way when
property Is platted. These subdivision Improvements
Include paving, drainage, landscaping, sidewalks, etc. In
some cases this could represent a substantial investment
on your part.

2. The alteration, relocation or installation of utilities
such as storm and sanitary sewers, electric, telephone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.
3. A building permit will not be Issued on the property being
platted until the final plat Is recorded. Also, the
Certificate of Occupancy for any building construction will
be Issued only after all the required subdivision
Improvements have been completed.
4. Approval for fire flow requirements must be obtained from
the Fire, Rescue and Inspection Services Department prior
to the issuance of a building permit.
5. Additional Items must be provided to the City of Miami
Department of Public Works before the final plat Is
submitted to the City Commission for approval. You will be
notified In writing as to what these Items are after the
:amount of the bond has been determined for the necessary
subdivision Improvements.
6. Tentative plat approval is only valid for one (1) year from
the date of the Plat and Street Committee Meeting at which
time It was approved.
