RESOLUTION NO. 9 4 - 472
A RESOLUTION DIRECTING THE CITY ATTORNEY TO
PREPARE A CITY CHARTER AMENDMENT TO THEREBY
ELIMINATE THE REQUIREMENT THAT THE TITLE TO
EACH PROPOSED ORDINANCE BE READ ALOUD PRIOR
TO ITS INITIAL CONSIDERATION BY THE CITY
COMMISSION WHICH AMENDMENT SHALL ALSO PROVIDE
THAT THE CITY'S PRACTICE OF HAVING THE TITLE
TO PROPOSED ORDINANCES READ ALOUD UPON THEIR
INITIAL CONSIDERATION SHALL CONTINUE ONLY FOR
SO LONG AS STATE LAW REQUIRES THAT SUCH
READING TAKE PLACE.
WHEREAS, the existing State law and City Charter provisions
mandate that the title to any proposed ordinance be read aloud on
each of the two times such ordinance is required to be approved
prior to its adoption as a duly adopted legislative measure; and
WHEREAS, an inordinate amount of time is spent during City
Commission meetings by waiting for the reading aloud of the title
to all proposed ordinances being considered by the City
Commission for the first time;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. The City Attorney is hereby directed to
prepare a City Charter Amendment to thereby eliminate the
requirement that the title to each proposed ordinance be read
aloud prior to its initial consideration by the City Commission
which amendment shall also provide that the City's practice of
having the title to proposed ordinances read aloud upon their
initial consideration shall continue only for so long as State
law requires that such reading take place,

Presently, we have no specific instructions expressly
directing us to prepare any Charter Amendments for the three
scheduled elections during 1991 (September 13, November 5, and
November 15). However, our office is working closely with the -
Department of Development and Housing Conservation and the
Department of --General Services Administration and Soiid Waste in
regard to ossible Charter Amendments related 11 4-
disposition of real property, and (2) acquisition of goods and
services; respectively. These items may appear in the form of
requested Preliminary Resolutions on the July 11th Commission
Meeting Agenda.
In .light of your deliberations during the past year, we -are
attaching two proposed resolutions which address the following
concerns: (a) eliminating the presently required practice of
reading aloud the ordinance title upon your initial consideration
of any ordinance, subject, of course, to such; practice being
continued -for so long as the State law requires such reading; and
(b) enabling you, by ordinance,'to grant subpoena power to Boards
and Committees appointed by you as you may deem appropriate
(Attch. A and Attch. B, respectively).
We will be governed by your decisions on the subject of
proposed Charter Amendments in accordance with the provisions of
our attached May 28, 1991 Memorandum (Attch. "C").

In connection with possible City Charter amendments, City
i
Code Section 2-42, adopted pursuant to and in accordance with
Section 5.03A of the Dade County Charter, establishes the method
of amending the City Charter. Two resolutions are required to be
adopted by the City Commission: the first one being preliminary
in nature, directing that within four months the City Attorney
shall prepare an amendment to the Charter; the second or finaj
text the
resolution, setting forth the verbatim -of proposed
amendment and calling for a special election thereon to take
place not less than 60 nor more than 120 days after the..adoption
of this final resolution.

There are three county -wide elections during 1991:
September 3, November 5 and November 12. Deadline calendar dates
for adoption of the above final resolution as well as
corresponding scheduled City Commission Meeting deadline dates
for its adoption are listed on the attached outline setting forth
the above respective election dates.
