HomeMy WebLinkAboutR-91-0454J-{9.1-432 05/24/91 RESOLUTION NO. 9 1 - 454 A RESOLUTION RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S UTILIZATION OF THE SERVICES OF ENVIRX, INC., FOR THE CLEANUP OF LEAD CONTAMINANTS FROM THE MIAMI POLICE DEPARTMENT FIRING RANGE, AT A COST OF $17,257, WITH FUNDING ALLOCATED FROM THE 1991 CAPITAL IMPROVEMENT ORDINANCE NO. 10782, PROJECT NO. 312019, "MPD FIREARMS RANGE RENOVATIONS" TO COVER THE CONTRACT COST. WHEREAS, the Miami Police Department is currently renovating its indoor firing range; and WHEREAS, during the initial study of this renovation it was determined that the firing range contained lead contaminants which had to be removed; and WHEREAS, several vendors were interviewed for estimates for the removal of these contaminants, but only EnviRx, Inc., supplied a written proposal; and WHEREAS, to avoid the delay of going through formal bid process the City Manager determined the existence of lead contaminants in the Miami Police Department constituted a health hazard; and WHEREAS, the 1991 Capital Improvement Ordinance No. 10782, was adopted on September 27, 1990, and monies are available in the Capital Improvement Project No. 312019, "MPD Firearms Range Renovations" to cover this service; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. j Section 2. Odio City Manager DATE : MAY 2 91991 FILE : SU&)ECT : Resolution Ratifying the Use d EnviRx for the MMPD Range Cleanup REFERENCES: ENCLOSURES: It is respectfully recommended that a resolution ratifying the City Manager's authorization to utilize the services of EnviRx, Inc., 3916 N. 29 Avenue, Hollywood, Florida, for the removal of lead contaminants from the Miami Police Department firing range, in the amount of $17,257, be approved. The Police Department is proceeding in the renovation of its firing range. During the initial study it was determined that lead contaminants found in the range and surrounding areas had to be removed prior to the installment of any new equipment. Because of the dangers associated with lead contaminants, and the delays associated with the formal bid process, a determination was made to allow EnviRx, Inc., to perform the cleanup on an emergency basis. Two other vendors were contacted, with EnviRx being the only vendor to submit a bid. The original estimate for this cleanup was $14,762, as evidenced by the copy of the emergency request attached to this memorandum. After the approval was granted Public Works made additional recommendations which increased the, actual cost of cleanup to $17,257. The delay in beginning work from the time of the Manager's approval was caused by the inherent liabilities associated with the removal of toxic wastes. INIS T ND� ATIO Your emergency approval authorizing a Po ice Nrtment to forego the formal bid process in obtaining estimates for the cleanup of lead contaminants in the Police Department Firing Range and further authorizing the cleanup on an emergency basis is requested.: On September 18, 1990 the Police Department received a report from A C Laboratories Inc., regarding the amount of lead contaminants in and around the firing range. At that time, BKJ Services, Inc., and EnviRx were contacted for estimates on removing these contaminants. The Police Department is in the process of reviewing the proposal submitted by EnviRx. BKJ Services, Inc., has not responded. The Department of Public Works, has assisted in this review and their recommendations have been approved by the vendor. Once the Police Department is able to clarify some minor details, the proposal will be sent to the Law Department for review. Because of the serious nature of lead contaminants, and the safety and well-being of employees working in and around the range area, it is requested that the formal bid process be foregone and the services of EnviRx be utilized. Their estimate of $14,762 does not include the cost of disposal, because this figure cannot be calculated until EnviRx is certain of the amount of hazardous waste that must be removed. Requiring the Police Department to go through the formal bid process would only prolong a dangerous situation. Furthermore, for police personnel to travel to and from the Medley range, for any shooting exercise, adds to mileage on vehicles, time away from the street, and increased risk to officers and vehicles due to the extended driving requirement.
