A RESOLUTION OF THE MIAMI CITY COMMISSION
APPROVING, IN PRINCIPLE, THE DEVELOPMENT OF
AN INTERIM PLAN AND BUDGET IN CONJUNCTION
WITH DADE COUNTY, THE STATE OF FLORIDA AND
ALL AGENCIES PROVIDING SERVICES TO THE
HOMELESS TO ADDRESS THE EMERGENCY SITUATION
CURRENTLY EXISTING BY REASON OF THE LARGE
NUMBERS OF HOMELESS FAMILIES AND INDIVIDUALS
IN THE COMMUNITY WITH SAID INTERIM PLAN AND
BUDGET ADDRESSING THE NEEDS AND COORDINATING
RESOURCES FOR 300-500 HOMELESS INDIVIDUALS
OVER THE NEXT 12 MONTHS UNTIL A LONG TERM
PLAN AND BUDGET CAN BE DEVELOPED AND
IMPLEMENTED; FURTHER PROVIDING THAT THE
CITY'S PARTICIPATION IS CONTINGENT UPON
FUNDING BEING RECEIVED FROM THE STATE OF
FLORIDA AND DADE COUNTY AND THE PARTICIPATION
OF THE AGENCIES PROVIDING SERVICES TO THE
HOMELESS.
WHEREAS, the City of Miami is faced with a homelessness
emergency which intensifies on a daily basis and which obviously
affects the life, safety and health of thousands of City
citizens, whether homeless or not; and
WHEREAS, the City of Miami finds itself as a defendant in
the United States District Court. for the Southern District of
Florida in Pottinger et al., v. City of Miami, 88-2406-Civ-
ATKINS, a case of first impression which seeks to define the
constitutional parameters of the rights of homeless persons and
whether city government may be restricted in the application of
certain state laws and municipal ordinances; and
WHEREAS, the City of Miami, Metropolitan Dade County, and
the State of Florida are faced with large concentrations of
homeless persons in public parks and under the expressways, on
rights -of -way and alongside city, county and state roadways; and
WHEREAS, the recent strategic report of the Greater Miami
Chamber of Commerce finds an alarming increase in the number of
homeless individuals in Dade County, Florida, reflecting an
increase from an estimated 4,000 individuals in November, 1988 to
an estimated 6,000 individuals in May, 1991; and

WHEREAS, approximately six thousand homeless persons,
including infants, children, and women, are found at, this time in
the streets of Miami and Dade County, Florida, without shelter
and subject to inclement weather and contagious disease; and
WHEREAS, the cooperation of the State of Florida,
Metropolitan Dade County, as well as all other groups, providing
services to the homeless, has been or is being enlisted to
support this mutual effort to help alleviate the emergency
problem by furnishing whatever resources are available to them on
both a short term and long term basis;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The development of an interim plan and budget
in conjunction with Dade County, the State of Florida and all
agencies providing services to the homeless is hereby approved,
in principle, the City's participation being contingent upon
funding to be received from the State of Florida and Dade County
and the participation of the agencies providing services to the
homeless.
Section 3. This Resolution shall become effective
immediately upon its adoption.
