A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT AMOUNT NOT TO EXCEED $50,000 IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA AND THE POOLE AND KENT COMPANY, DATED OCTOBER 18, 1990, FOR THE LAWRENCE PUMP STATION ! MODIFICATION - PHASE II PROJECT, CAPITAL IMPROVEMENT PROJECT NO. 352184, SAID FUNDS TO BE !' PROVIDED FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO. 10782, WITH FUNDS ALREADY APPROPRIATED TO THE PROJECT; FURTHER RATIFYING THE CITY !}, MANAGER'S WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF FOUR/FIFTHS OF THE MEMBERS OF THE CITY COMMISSION. WHEREAS, there exists a contract dated October 18, 1990 between the City of Miami, Florida and The Poole and Kent Company, for Lawrence Pump Station Modifications, Phase II, Capital Improvement Project No. 352184; and WHEREAS, an increase in contract not to exceed $50,000 is required to cover the cost of necessary extra work involving a previously unknown underground condition, additional costs incurred for securing a defective pipe which prevented the proposed construction to proceed in the manner designed, this work being required prior to proceeding with the construction outlined in the plans and specifications; and WHEREAS, the City Manager has made a written finding that a valid emergency existed for the work to continue; and WHEREAS, the Director of the Department of Public Works recommends the increase in contract to cover the additional costs; and WHEREAS, funds to cover the increase are available from monies already appropriated to the project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. After a properly advertised Public Hearing, the findings of the City Manager set forth in the Preamble to this CITY COMMSSION" MEETING OF, JUL 11 10 91-- 541 (; Ak� Resolution are hereby ratified by an affirmative vote of four/fifths of the City Commission, and are hereby incorporated by —[f reference thereto and adopted as if fully set forth in this Section. -�' Section 2. The contract between the City of Miami, Florida and The Poole and Kent Company, for the Lawrence Pump Station Modification, Phase II, Capital Improvement Project No. 362184, dated October 18, 1990, is hereby increased not to exceed $50,000 with funds for the increase to be provided from monies already appropriated to the project. Odio ENCLOSURES: City Manager RECOMMENDATIONS It is respectfully recommended that the City Commission adopt the attached Resolution authorizing an increase in contract in the amount of not to exceed $50.000 in the contract between the City of Miami, Florida and the Poole and Kent Company for the Lawrence Pump Station Modification -Phase II, CIP Project #352184, said funds to be provided from the 1991 Capital Improvement Ordinance No. 10782 with funds already appropriated to the project; further ratifying the City Manager's written finding that the herein increase resulted from emergency circumstances by an. affirmative vote of four fifths of the members of the City Commission and adopting the finding and conclusions set forth in the preamble of this Resolution. BACKGROUND The Department of Public Works has determined that it is now in order for the Commission to authorize an increase in contract amount for the Lawrence Pump Station Modification -Phase II - CIP Project No. 352184. After excavation for the new pit an existing 78-inch reinforced concrete pipe storm sewer was found to be misaligned and lower than shown on record drawings used for the pump pit design. This defect was not shown on the 1953 as -built plans. This defect in the pipe has resulted in a reauirement to increase the size of the new bar screen structure and additional support is required to secure the 78-inch diameter reinforced concrete pipe during construction, and the removal of a concrete collar approximately 10 foot square by 4 foot thick. It has been decided that the most cost effective and expeditious manner in which to address this problem is with the existing contractor who is presently on the project. As required by City Ordinance, an increase of $10,000 or more in a City contract must be accompanied by a finding by the City Manager that the increase resulted from emergency circumstances, and such finding has been prepared and signed. 91- 541 i CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO FILE DATE : SUBJECT FROM Cesar H. B-5548-C Lawrence Pump Station Modification -Phase II CIP Project #352184 Emergency Need For Increase in Contract Based on information supplied to me by the Director of the Department of Public Works, I have found that there exists an emergency need for an increase in contract amount not to exceed $50,000 in the contract between the City of Miami, Florida and the Poole and Kent Company for the Lawrence Pump Station Modification -Phase II. The reason for the emergency need is as follows: There presently exists an excavation approximately 20 foot square by 20 foot deep at the southeast corner of the City of Miami Riverside Park. This excavation has approximately 10 foot of water in the bottom. The excavation is enclosed by a construction fence. However, it is an attractive nuisance and endangers the health safety and welfare of the children playing in and about the park. Because of the exposed section of 78-inch reinforced concrete pipe presently suspended due to the open excavation and shifts in the groundwater, there is the potential for storm drainage problems in the Riverside and East Little Havana Road System. 91-~ 541 LAWRENCE PUMP STATION MODIFICATION -PHASE II JOB NO.-B-5548-C CONTRACTOR'S FACT SHEET I.
