A RESOLUTION APPROVING THE MOST QUALIFIED FIRM
TO PROVIDE PROFESSIONAL ENGINEERING SERVICES
FOR OBTAINING A NATIONAL POLLUTANT DISCHARGE
ELIMINATION SYSTEM (NPDES) PERMIT FOR THE
CITY'S STORM SEWER SYSTEM; AUTHORIZING THE
CITY MANAGER TO UNDERTAKE NEGOTIATIONS WITH
THE MOST QUALIFIED FIRM TO ARRIVE AT A
CONTRACT WHICH IS FAIR, COMPETITIVE AND
REASONABLE; AND DIRECTING THE CITY MANAGER TO
PRESENT THE NEGOTIATED AGREEMENT TO THE CITY
COMMISSION FOR ITS APPROVAL.
WHEREAS, on October 31, 1990, the United States
Environmental Protection Agency (EPA) approved Its final rule on
stormwater discharges requiring municipalities to obtain National
Pollutant Discharge Eliminating System (NPDES) permits for storm
sewer systems; and
WHEREAS, by Resolution No. 91-121 passed and adopted
February 14, 1991, the City of Miami Commission approved as a
Category "B" Project the acquisition of Professional Engineering
Services for obtaining a National Pollutant Discharge Elimination
System (NPDES) Permit for the City of Miami's Storm Sewer System
required by the EPA, authorized the City Manager to advertise for
the required professional services, established a Certification
Committee, appointed Luis A. Prieto-Portar, Director of Public
Works, as chairman of the Competitive Selection Committee to
review the qualifications, performance data and related
Information provided by those responding to the City's Request
for Proposals for Professional Services; and
WHEREAS, the City through public advertisement and direct
mailing, sollcited expressions of Interest from qualified
consultants for meeting the EPA's NPDES requirements; and

RESOLMON No.
WHEREAS, the Certification Committee evaluated the
qualifications of those firms who responded to the City's Request
For Proposals and then the Competitive Selection Committee
selected the firm most qualified to provide professional
engineering services for the NPDES project, all in accordance
with the Competitive Negotiations Act as defined in Florida
Statutes Sec. 287.055, and as contained in Section 18.52.3 of the
City Code, for the acquisition of professional services;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and Incorporated herein as If fully set forth in this
Section.
Section 2. The City Commission hereby approves the
recommendation by the Competitive Selection Committee of the
following firm as the most qualified to provide engineering
services for obtaining a National Pollutant Discharge Elimination
System (NPDES) Permit for the City's storm sewer system:

Section 3. The City Commission hereby authorizes the City
Manager to negotiate and enter Into a professional services
agreement on behalf of the City of Miami with said firm. In the
event that the City Manager cannot negotiate an agreement which,
In his opinion, is fair, competitive and reasonable with said
firm, then he Is hereby authorized to terminate such negotiation
and to proceed to readvertise the City's Request for Proposals
for Professional Engineering Services.
Section 4. The City Manager Is directed to present the
City Commission with the negotiated agreement at the earliest
scheduled meeting of the Commission Immediately following the
negotiation of said agreement for Its approval.
Section 5. This Resolution shall become effective
Immediately upon Its adoption.

RECOMMENDATION:
It Is respectfully recommended that the City Commission adopt
the attached Resolution approving the most qualified firm to
provide professional engineering services for obtaining the
National Pollutant Discharge Elimination System (NPDES) permit
for the City's storm sewer system.
BACKGROUND:
The Department of Public Works, In a continuing effort to serve
all residents of the City of Miami, Is recommending the adoption
of the attached Resolution approving the most qualified firm to
provide professional engineering services for the City In
response to recent Federal Environmental Protection Agency (EPA)
legislation.
On October 31, 1990, the EPA approved Its final Rule on
stormwater discharges for municipal and Industrial storm sewer
systems. The Rule requires large municipalities including the
City of Miami to obtain National Pollutant Discharge Elimination
System (NPDES) permits for storm sewer systems.
On February 14, 1991, the City Commission adopted Resolution No.
91-121 designating as a Category 1113" Project the acquisition of
professional engineering services for obtaining the aforesaid
NPDES permit. Through public advertisement and direct mailing,
the Department of Public Works solicitted expressions of
Interest from qualified engineering consultants for meeting the
EPA's NPDES requirements.

The Certification Committee along with the Competitive Selection
Committee evaluated the qualifications of the firms who
responded to the Clty's Request for Proposals and selected the
firm of CH2M Hill as the most qualified to provide professional
engineering services for the NPDES project. All evaluations and
procedures were In accordance with the Competitive Negotiations
Act as defined In Florida Statutes Sec. 287.065, City of Miami
Ordinance No. 9572 and Section 18.52.3 of the City Code.
It is now In order for the Commission to approve the
recommendation of the Competitive Selection Committee
establishing the firm of CH2M Hill as the most qualified to
provide engineering services for obtaining a NPDES permit for
the City's storm sewer system.
