A RESOLUTION AMENDING SECTION 3 OF RESOLUTION NO. 89-798, ADOPTED SEPTEMBER 14, 1989, RELATING TO THE DISPOSITION OF WEAPONS PREVIOUSLY ISSUED FOR INDIVIDUAL USE BY SWORN PERSONNEL OF THE MIAMI POLICE DEPARTMENT, TO THEREBY ESTABLISH A CITY COMMISSION POLICY TO BE IN EFFECT FOR A ONE-YEAR PERIOD FROM THE DATE OF THIS RESOLUTION TO PROVIDE THAT IF MORE THAN ONE WEAPON HAD BEEN ISSUED TO SAID SWORN PERSONNEL FOR THEIR INDIVIDUAL USE, THEY SHALL HAVE THE RIGHT TO PURCHASE ONE SUCH OTHER WEAPON, IF THE WEAPON IS AVAILABLE, AT A PRICE WHICH IS EQUAL TO OR GREATER THAN THE AMOUNT THAT WOULD BE REASONABLY ANTICIPATED FROM THE SALE OF SUCH OTHER WEAPON THROUGH PUBLIC AUCTION; FURTHER RATIFYING, APPROVING AND CONFIRMING ANY SUCH ACTIONS THE CITY MANAGER MAY HAVE TAKEN IN AUTHORIZING THE PURCHASE OF SUCH OTHER WEAPON PRIOR TO THE DATE HEREOF. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 3 of Resolution No. 89-798, adopted September 14, 1989, is hereby amended in the following particulars:/ Section 3. In order to improve the morale of sworn police personnel and thereby contribute to community civic progress, the City Manager shall implement the following policy: 4&� Henceforth, subject to applicable law and with the concurrence of the Chief Procurement Officer, any one weapons which have hasbeen issued to sworn personnel of the Police Department for their individual use arc 1& to be made available as a donation at no cost to such personnel on the date of their retirement under honorable conditions; provided, that such personnel shall have qualified for service, early service, rule of 70, ordinary disability or service incurred disability retirement. Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Further, if more than one weapon had been issued to said sworn 8ersonnel for their individual use, they shall have the right to purchase one such other weapon, if the weapon is available, at a price which is equal to or greater than the amount that would be reasonably anticipated from the sale of such other weapon through public auction This subsection shall remain in force and effect for one year commencing on the date this Resolution is adopted and at the end of such one year ,period any such other weapon still in the custody of the Department or in the possession of said sworn personnel shall be collected and disposed of as the Chief Procurement Officer deems appropriate." Section 2. Any actions that the City Manager may have taken in authorizing the purchase of the other weapon prior to the date hereof are hereby ratified, approved, and confirmed. Section 3. The Miami Police Department has issued Glock, 9mm, semiautomatic firearms to officers who previously carried Smith & Wesson revolvers. Resolution No. 89-798 approved the donation of service weapons to retiring officers, so long as they met certain requirements. This amendment to Resolution No. 89-798 would allow for the sale of the previously issued Smith & Wesson revolvers to officers at market price. In bids for the Smith & Wesson revolvers, received by the Chief Procurement Officer, the highest price quoted was $85.00. It is suggested that this be the price set for the sale of these revolvers.
