A RESOLUTION APPROVING THE PURCHASE OF UNDERWATER VIDEO EQUIPMENT, AND ALLOCATING FUNDS THEREFOR, IN AN AMOUNT NOT TO EXCEED $5,000, FROM THE LAW ENFORCEMENT TRUST FUND, SUCH COSTS HAVING BEEN APPROVED BY THE CHIEF OF POLICE AND BEING SUBJECT TO APPLICABLE CITY CODE PROCUREMENT PROVISIONS. WHEREAS, Florida State Statute 932.704(3)(a), as amended, authorizes the expenditure of forfeiture proceeds for law enforcement purposes not considered normal operating expenses; and WHEREAS, the Miami Police Department Marine Patrol Unit conducts underwater searches for evidence, contraband, and other items; and WHEREAS, the officers must present this evidence during trial and other proceedings; and WHEREAS, the presentation of a video is very persuasive in influencing a jury as to the credibility of the witness; and WHEREAS, contraband found on the underside of a marine vessel can be filmed and quite damaging in a forfeiture action against the vessel; and WHEREAS, funds to cover the purchase are available in the City of Miami Law Enforcement Trust Fund, Project No. 690001, Index Code 029002-247; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORTDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. City Manager ENCLOSURES It is respectfully requested that a Resolution authorizing the purchase of underwater video equipment, at a cost of $5,000, funding therefor from the Law Enforcement Trust Fund, Project No. 690001, Index Code 029002-247, be approved. The Police Department Marine Patrol Unit is called upon to conduct underwater searches for evidence, contraband and other articles during their course of duty. In an effort to preserve these underwater crime scenes, for use in court or for other purposes, it is necessary that pictures of the items be taken. Underwater video equipment will insure that the testimony of the recovering unit is accurate and that items are properly seized and identified. Criminals frequently smuggle contraband into Miami attached to the hulls of boats. Underwater video cameras would be quite persuasive in influencing a jury in a forfeiture action against those vessels.
