RESOLUTION NO.
A RESOLUTION, WITH ATTACHMENT(S), AUTHORIZING
THE CITY MANAGER TO EXECUTE AN AMENDMENT TO
THE AGREEMENT DATED SEPTEMBER 15, 1989, IN
SUBSTANTIALLY THE ATTACHED FORM, WITH ANDRES k
DUANY AND ELIZABETH PLATER-ZYBERK,
ARCHITECTS, INC., INCREASING SAID AGREEMENT
IN AN AMOUNT NOT TO EXCEED $20,000 FOR
COMPLETION OF THE DESIGN DEVELOPMENT AND
CONSTRUCTION DOCUMENT PHASES IN CONNECTION
WITH THE DEVELOPMENT OF A TWENTY-THREE (23)
UNIT SINGLE FAMILY RESIDENTIAL SALES HOUSING
DEVELOPMENT FOR MODERATE INCOME FAMILIES ON
THE CITY -OWNED ST. HUGH OAKS ACADEMY PROPERTY
LOCATED IN THE COCONUT GROVE NEIGHBORHOOD;
FURTHER ALLOCATING MONIES THEREFOR FROM
CAPITAL IMPROVEMENT PROJECT NO. 321034,
"SCATTERED SITE AFFORDABLE HOUSING
DEVELOPMENT PROGRAM".
WHEREAS, there exists in the City of Miami, a severe
shortage of housing within the affordability range of families
and individuals of low and moderate income; and
WHEREAS, on November 3, 1988, through Resolution
No. 88-1042, the City Commission approved the development of a
thirty (30) unit single family residential sales housing
development on the City -owned St. Hugh Oaks property for moderate
income families; and .
WHEREAS, the City Commission, by Resolution No. 89-165, on
February 9, 1989, approved the selection of Andres Duany and
Elizabeth Plater-Zyberk, Architects, Inc. as the most qualified
firm to provide, along with the designated sub -consultants,
professional architectural, landscape, engineering, professional
planning and design services to the City for the above mention
housing development and authorized the City Manager to negotiate
an Agreement with the said firm; and
WHEREAS, the City Manager executed an Agreement with Andres
Duany and Elizabeth Plater-Zyberk, Architects, Inc., on
September 15, 1989, for the provision of architectural and

— engineering services in connection with the proposed St. Hugh
Oaks Affordable Housing Project; and
WHEREAS, on April 25, 1991, through Resolution No. 91-325,
the City Commission approved the issuance of a Major Use Special
Permit pursuant to Article 17 of the City Zoning Ordinance
No. 11000 in connection with the development of the St. Hugh Oaks
Academy property in the Coconut Grove neighborhood; and
WHEREAS, through Resolution Nos. 91-325 and 91-403, the City
Commission further reduced the number of single family detached
homes being proposed on the subject parcel from twenty-eight (28)
to twenty-three (23) units; and
WHEREAS, in order to move the design of the proposed project
forward, it is necessary that the City increase the contract
amount with the architectural firm for additional cost incurred
due to changes in the scope of services requested by the City
under the existing Agreement, dated September 15, 1989; and
WHEREAS, the cost of providing the additional and unforeseen
services under the aforementioned Agreement for the project is
estimated not to exceed $20,000 in order to complete the design
development and construction document phases for the St. Hugh
Oaks Affordable Housing Project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized to
execute an amendment, in substantially the attached form, to the
Agreement') dated September 15, 1989, with Andres Duany and
Elizabeth Plater-Zyberk Architects, Inc., in an amount not to
exceed $20,000 to defray the cost of providing additional
services to the City in connection with the proposed St. Hugh

all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable
City Charter and Code provisions.

Oaks Affordable Housing Project with funds therefor being hereby
allocated from Capital Improvement Project No. 321034, "Scattered
Site Affordable Housing Development Program".
Section 3. This Resolution shall become effective
immediately upon its adoption.

AMENDMENT NO. 2
This Amendment, made this day of ,
1991, to an Agreement dated September 15, 1989, by and between
the CITY OF MIAMI, a municipal corporation of the State of
Florida, hereinafter referred to as "CITY", and ANDRES DUANY and
ELIZABETH PLATER-ZYBERK, ARCHITECTS, INC., a for profit
corporation of the State of Florida, hereinafter referred to as
"CONSULTANT."
RECITAL
WHEREAS, there exists in the City of Miami, a severe
shortage of housing within the affordability range of families
and individuals of low and moderate income; and
WHEREAS, in an effort to expand the availability and
affordability of housing for moderate income families and
individuals in the CITY OF MIAMI, in September of 1986, the City
of Miami Commission authorized the acquisition of a three (3)
acre parcel of land located in the Coconut Grove neighborhood
known as the St. Hugh Oaks Academy property; and
WHEREAS, in October of 1986, the City of Miami Commission,
through Resolution No. 86-840, approved the implementation of a
City -sponsored Scattered Site Affordable Homeownership
Development
Program for
the purpose
of
facilitating the
production
of sales housing
in the City
within
the affordability
range of qualified low and moderate income purchasers; and
WHEREAS, in October of 1986, the City of Miami Commission,
through Ordinance No. 10165, also authorized the issuance of
Special Obligation Bonds in the amount of $4,290,000 for the
purpose of providing financing for the construction of owner -
occupied residential dwelling units within the affordability
range of qualified low and moderate income purchasers; and
WHEREAS, the City of Miami serving as developer, intends to
develop a thirty (30) unit single family residential sales

housing development on the City -owned St. Hugh Oaks Academy
property; and
WHEREAS, by Resolution No. 88-1042, passed and adopted on
November 3, 1988, the City Commission approved the designation as
a Category "B" Project, the planning and design of a thirty (30)
unit single family residential sales housing development for
moderate income families on the City -owned St. Hugh Oaks Academy
property, appointed at the time Jerry Gereaux, Director, Housing
Conservation and Development Agency, as Chairman of the
Competitive Selection Committee and established a Certification
Committee of not less than three professions, qualified in the
field of endeavor or practices involved, to review the
qualifications, performance data and related information provided
by those responding to the City's Request for Proposal Services
in accordance with Ordinance No. 8965; and
WHEREAS, the City, through public advertisement and direct
mailing, solicited expressions of interest from qualified
consultants; and
WHEREAS, the Competitive Selection Committee, along with the
Certification Committee, evaluated the qualifications of those
firms who responded to the City's Request for Proposals, and
selected the firms most qualified to provide professional
architectural, landscape architectural and engineering services
for this project, all in accordance with the Competitive
Negotiations Act as defined in Florida Statutes, Chapter 287 and
in the City of Miami Code, Chapter 18-52.2 for the acquisition of
professional and technical services required; and
WHEREAS, the City Commission, by Resolution No. 89-165,
dated February 9, 1989, approved the selection of Andres Duany
and Elizabeth Plater-Zyberk Architects, Inc. as the most
qualified firm to provide, along with the designated
sub -consultants, professional architectural, landscape
architectural and engineering services for the development of a
thirty unit single family residential sales housing development
for moderate income families on the City -owned St. Hugh Oaks
Academy property and has also authorized the City Manager to

negotiate an Agreement with it for the professional and technical
services required.
WHEREAS, on January 10, 1991, the City Commission approved
Resolution No. 91-04, authorizing the City Manager to execute an
amendment to the agreement dated September 15, 1989, for an
amount not to exceed $30,000 for Stages I and II professional and
technical services in connection with the development of a thirty
unit single family residential sales housing development for
moderate income families on the City -owned St. Hugh Oaks Academy
property located in the Coconut Grove neighborhood.
WHEREAS, on April 25, 1991, through Resolution No. 91-325,
the City Commission approved the issuance of a Major Use Special
Permit pursuant to Article 17 of the City Zoning Ordinance No.
11000, in connection with the development of the St. Hugh Oaks
property; and
WHEREAS, the City Commission, through Resolution Nos. 91-325
and 91-403, further reduced the number of single family detached
homes being planned on the subject property from twenty-eight
(28) to twenty-three (23) units; and
WHEREAS, in order to move the design of the proposed project
forward, it is necessary that the City increase the contract
amount with the architectural firm for additional cost(s)
incurred due to changes in the scope of services required by the
City under the existing Agreement dated September 5, 1989;
pursuant to Resolution No. 91-325;
WHEREAS, on , 1991, the City Commission
approved Resolution No. 91- , authorizing the City Manager to
execute an amendment to the agreement dated September 15, 1989
for an amount not to exceed $20,000 for Stages I and II for
professional and technical services in connection with the
development of twenty-three (23) single family residential sales
housing development for moderate income families on the
City -owned St. Hugh Oaks property located in the Coconut Grove
neighborhood.

NOW, THEREFORE, THE PARTIES AGREE TO AMEND THE AGREEMENT AS
FOLLOWS:1/
In Subsection Stage I, Subsection a. Design Development
Phase, Subsection 3, is hereby amended to read as follows:
3) Based on its findings and expertise, the CONSULTANT shall
prepare a site plan. The site plan will show the most
advantageous geographical configuration, in order to
maximize the use of the existing property, in obtaining
single family lots of no less than three thousand (3,000)
i square feet approximately fthirty (30) twenty-three (�231
single family homes. The CONSULTANT will also provide the

CITY with a Cost Estimate for the development of the
configuration listed above and approved by the PROJECT
MANAGER.
In Subsection Stage I, Subsection a. Design Development
Phase, Subsection 4, is hereby amended to read as follows:
4) The CONSULTANT, based on the input provided by the CITY
and the Neighborhood Organizations, shall prepare documents
consisting of drawings including plans, sections and
elevations for the design of two models of single family
homes of no more than one thousand five hundred (1,500)
square feet, preferably two (2) stories with 3-bedroom and a
3-baths. The master bedrooms on these
homes must have their own bathrooms, the structure must be
C.B.S. and all floor slabs must be of reinforced concrete.

the construction within the City's protect budget for the
development of the project The CONSULTANT must submit an
estimate of the construction cost broken down into major
categories to substantiate the proposed design.
Section IV Compensation, is hereby deleted in its entirety,
and a new Section IV, to read as follows, is substituted
therefore:
The CONSULTANT shall be compensated for an additional amount
not to exceed S20,000 in connection with the professional
services provided to the CITY for development of the St
Hugh Oaks property as stipulated in Section II -
Professional Services and further enumerated in subsection
E. Additional work Authorized by the CITY pursuant to said
Agreement due to the additional cost incurred for
modifications in the scope of services requested by the CITY
under the existing Agreement, dated September 15, 1989.
It is further understood that all conditions outlined under
the original Agreement dated September 15, 1989, shall remain in
full force and effect except as modified herein.
IN WITNESS WHEREOF, the parties hereto have caused this
instrument to be executed by the representative officials
thereunto duly authorized, this the day and year first above
written.

It is respectfully recommended that the City Commission adopt the
attached resolution authorizing the City Manager to amend the
Professional Service Agreement between the City of Miami and Andres
Duany and Elizabeth Plater-Zyberk, Architects, Inc., dated
September 15, 1989, in connection with the provision of
professional planning and design services to the City for the
development of a twenty-three (23) unit single family residential
housing project on the City -owned St. Hugh Oaks parcel in the
Coconut Grove neighborhood. The attached resolution further
allocates funds not to exceed $20,000 from Capital Improvement
Program Project No. 321034, "Scattered Site Affordable Housing
Development Program," to increase the compensation for providing
additional and unforeseen services to the City in connection with
the aforementioned housing project.
BACKGROUND:
The Department of Development and Housing Conservation recommends
ratification of the attached resolution, authorizing the City
Manager to amend the Professional Service Agreement between the
City and Andres Duany and Elizabeth Plater-Zyberk, Architects,
Inc., dated September 15, 1989, in connection with the provision of
professional planning and design services to the City for the
development of a twenty-three (23) unit moderate income housing
project on the City -owned St. Hugh Oaks property. 'The attached
resolution further allocates funds not to exceed $20,000 from
Capital Improvement Program Project No. 321034, "Scattered Site
Affordable Housing Development Program," to increase the
compensation for providing additional and unforeseen services to
the City in connection with the aforementioned housing project.
At the November 3, 1988 City Commission meeting, through Resolution
No. 88-1042, the City Commission designated as a Category "B"
Project, the planning and design of a thirty (30) unit single
family detached residential sales housing development for moderate
income families on the three (3) acre City -owned St. Hugh Oaks
property,

The said resolution further directed the Administration to proceed
in the preparation of a Request for Proposals for the purpose of
retaining professional architectural, landscape, and engineering
services for the development of the aforementioned moderate income
housing project.
On February 9► 1989, through Resolution No. 89-165, the City
Commission authorized the City Manager to undertake negotiations
with the top three (3) ranked architectural firms selected by the
Competitive Selection Committee and to return with a negotiated
Agreement for City Commission ratification and approval.
Subsequently, in July of 1989, through Resolution No. 89-617, the
City Commission authorized the City Manager to execute the
negotiated Agreement between the City and Andres Duany and
Elizabeth Plater-Zyberk, Architects, Inc., and established
compensation for said services in the amount of $95,000.
The City's original housing proposal for development of the St.
Hugh Oaks parcel called for the construction of thirty (30) new
single family homes, to be constructed on lots consisting of
approximately 3,000 square feet. Over the past two (2) years, the
planning, design and construction document phases of the proposed
project has been virtually at a standstill due to the inability of
the . Department of Development and Housing Conservation to
effectuate the replat of the 3 acre parcel into thirty (30)
buildable lots consisting of less than 5,000 square feet.
At the February 7, 1990 City Commission meeting, a status report on �.
the proposed housing project was presented to the City Commission,
along with the possible options to develop the site. As a result,
the City Administration was instructed to work in conjunction with
the architect and the Coconut Grove residents in finding a solution -
which would ensure the development of the proposed thirty (30)
homes. After several meetings with the residents of the Coconut
Grove neighborhood, a consensus was reached to develop the project
as a condominium, however, each unit would be individually located
and free standing.
This modification in the housing proposal planned for developing
the St. Hugh Oaks parcel resulted in a corresponding change in the
scope of services to be provided to the City by the architectural
firm of Andres Duany and Elizabeth Plater-Zyberk, Architects, Inc.,
as per the Professional Service Agreement between the City and the
said firm, dated September 15, 1989. As a result, on January 10,
1991, through Resolution No. 91-04, the City Commission approved
the execution of an Amendment to the aforementioned Agreement
between the City and the said firm, for the purpose of providing an
additional $30,000 to compensate the architectural firm for
additional professional services not previously negotiated in the
original Agreement.

At the April 23, 1991 City Commission meeting, through Resolution
NO. 91-325, the City.Commission approved in principle, a Major Use
Special Permit, pursuant to Article 17 of Ordinance No. 11000, the
City's Zoning Ordinance, as amended, in connection with the
proposed St. Hugh Oaks Village Housing Project. Moreover, at the
May 23,'1991 City Commission meeting, through Resolution No. 91-
403, the City Commission granted final approval for a Major Use
Special Permit for the project with conditions which further
reduced the number of new single family detached homes being
proposed on the St. Hugh Oaks parcel to twenty-three (23) homes.
This modification in the original housing proposal planned for
developing the St. Hugh Oaks parcel has also resulted in a
corresponding change in the scope of services to be provided to the
City, by the architectural firm of Andres Duany and Elizabeth
Plater-Zyberk, Architects, Inc. The attached resolution authorizes
the City Manager to amend the aforementioned Agreement with the
said architectural firm, in addition to increasing the contract in
an amount not to exceed $20,000 to compensate the architect for
additional and unforeseen professional services not previously
negotiated in the original Agreement.
City Commission ratification of the attached resolution is
recommended.
