ORDINANCE NO. 10907
AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 11000, AS AMENDED, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY
CHANGING THE ZONING CLASSIFICATION FROM R-3
MULTI -FAMILY MEDIUM DENSITY RESIDENTIAL TO
G/I GOVERNMENT AND INSTITUTIONAL FOR PROPERTY
LOCATED AT APPROXIMATELY 302-312 NORTHWEST
9TH AVENUE, MIAMI, FLORIDA, ALSO DESCRIBED AS
THE SOUTH 100' OF LOTS 19 AND 20, BLOCK F,
RIVERVIEW, AS RECORDED IN PLAT BOOK 5 AT PAGE
43 OF THE PUBLIC RECORDS OF DADE COUNTY,
FLORIDA; MAKING FINDINGS; AND BY MAKING ALL
THE NECESSARY CHANGES ON PAGE NO. 35 OF SAID
ZONING ATLAS; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Miami Zoning Board, at its meeting of
December 17, 1990, Item No. 1, following an advertised hearing,
duly adopted Resolution No. ZB 116-90 by a six to zero (6-0)
vote, RECOMMENDING APPROVAL of a change of zoning classification,
as set forth herein; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as set forth herein;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The Zoning Atlas contained in Ordinance
No. 11000, as amended, the Zoning Ordinance of the City of Miami,
Florida, is hereby amended by changing the zoning classification
from R-3 Multi -Family Medium Density Residential to G/I
Government and Institutional for the property located at 302-312
Northwest 9th Avenue, Miami, Florida, also described as the South

100' of Lots 19 and 20, Block F, RIVERVIEW, as recorded in Plat
Book 5 at Page 43, of the Public Records of Dade County, Florida.
Section 3. It is hereby found that this zoning
classification change:
(a) is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) is not contrary to the established land use pattern;
(c) will not create an isolated district unrelated to
adjacent and nearby districts;
(d) is not out of scale with the needs of the neighborhood
or the City;
(e) will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) is necessary due to changed or changing conditions;
(g) will not adversely influence living conditions in the
neighborhood;
(h) will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) will not create a drainage problem;
(j) will not seriously reduce light and air to adjacent
area;
(k) will not adversely affect property values in the
adjacent area;
(1) will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; and
(m) will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare.
Section 4. Page No. 35 of the Zoning Atlas, made a part
of Ordinance No. 11000, as amended, is hereby amended to reflect
the changes made necessary by this amendment.

Section 5. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

REQUEST Change of Zoning as listed in Ordinance 11000,
as amended, the Zoning Ordinance of the City of
Miami, From R-3 Multifamily Medium Density to
G/I Government and Institutional.
RECOMMENDATIONS
PLANNING DEPARTMENT Approval. The applicant has filed a request to
seeK a Comprehensive Plan amendment to "Major
Public Facilities" land use designation, which
would enable the City to consider the requested
zoning amendment. Presently, the facilities for
Victoria Hospital occupy the major portion of
the block. Rezoning of the subject property
would make it consistent with the rest of the
block.
PUBLIC WORKS The existing concrete gravity sanitary sewers
serving this site were constructed in 1924 at a
0.1% slope (substandard) and must be replaced to
accept any increase in capacity. The extent of
replacement will vary depending on the intensity

of new development up to a maximum of three (3)
blocks.
No objection.
At its meeting of December 17, 1990, the Zoning
Board adopted Resolution ZB 116-90, by a vote of
6-0, approving the above.
Two PROPONENTS were present at the meeting.
Three replies AGAINST and two replies in FAVOR
were received by mail.
At its meeting of January 24, 19�?. the
City CZmmission -passed the above on 'first
Reading.

9. Statement explaining why present zoning designation is
inappropriate.
The Hospital has acquired Lots 19 and 20 and now owns
1001 of Block "F". The Block is zoned as 95% GI (Lots
1 through 18) and 5% R-3 (Lots 19 and 20). Lots 19 and
20 are now vacant.
10. Statesent as to why proposed designation is
appropriate.
Block "F" is surrounded by natural boundaries of N.W.
4th Street (North), N.W. 9th Avenue (Bast), N.W. 3rd
Street (South) and N.W. loth Avenue (West). The Lots
Proposed for re -zoning (Lots 19 and 20) are contiguous
to the Hospital which now owns 100% of Block "F". The
Hospital hereby requests that Lots 19 and 20 be re-
zoned to GI, to be consistent with the zoning for the
rest of the Lots owned by the Hospital (Lots 1 through
18). The entire block owned by the Hospital would then
be zoned GI.

In either case, you should disclose the conflict:
PRIOR TO THE VOTE BEING TAKEN by publicly stating to the assembly the nature of your interest in the measure on
which you are abstaining from voting; and
WITHIN 13 DAYS AFTER THE VOTE OCCURS by completing and filing this form with the person raponsible for recording
the minutes of the meeting, who should incorporate the form in the minutes.
APPOINTED OFFICERS:
A person holding appointive county. municipal, or other coal public office MUST ABSTAIN from voting on a measure which
inures to his special private gain. Each local officer also is prohibited from knowingly voting on a measure which inures to the
special pin of a principal (other than a government agency) by whom he is retained.
A person holding an appointive local office otherwise may participate in a matter in which he has a conflict of interest, but must
disclose the nature of the conflict before making, any attempt to influence the decision by oml or written communication, whether
made by the officer or at his direction.
