AND THE CITY OF MIAMI, FLORIDA, .DATED 'DECEMBER '7o 1990, IN THE AMOUNT, OF $347,396.00t INCLUDING THE ADDENDUM TOCONTRACT AGREEMENT DATED NOVEMBER,21 1990s FOR THE DOWNTOWN SANITARY SEWER REPLACEMENT -PHASE III PROJECT, CAPITAL IMPROVEMENT PROJECT NO. 351281, WITH SAID FUNDS TO BE PROVIDED FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO. 10782, FROM FUNDS ALREADY'APPROPRIATED TO THE PROJECT; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE • VOTE OF FOUR -FIFTHS OF THE MEMBERS OF THE CITY COMMISSION. BACKGROUND:., The Department of Public Works has determined that in the best interest ` of the taxpayers of the City of Miami, it i s now. order for the Commission to authorize an increase in the contract 4 amount -for the Downtown Sanitary Sewer Replacement - Phase 'III, s Project No. 351281. r, r j During the early stages of the construction of this sanitary` sewer replacement project, the • Ci ty's contractor di scover.ed `e I previously, unknown underground conditions involving'1) a direct i conflict with an existing F1 on da Power b Light Company el ectri c< 1 duet bank and 2) direct conflicts with the footings for the, j Downtown People Mover guideway supports. j The F.P.L duct bunk is a major electric facility serving }Ft properties along North ist Street between Biscayne.Boulevard.and _^ N I E. 2nd Avenue. The _ Ci ty's replacement 'sewer was on gi na113r designed utilizing the best available as -built information for; z the F.P. L duct bank. Our contractor .was asked to dig a tesrt'hol a { to 'verify the elevation and size of the duct bank. As a: result of ` thi s excavation, staff determined that a confl ic.t with the ,7W4 duct bank could not be avoided and that the duct bank had to be -+ �xti fcx, relocated Due to the size" and importance of this FP.h faciIity, the City cannot reasonably expect F.P.L. to absorb the s entire cost of relocating his facility .
