ORDINANCE NO. 10912
AN EMERGENCY ORDINANCE ESTABLISHING A NEW SPECIAL
REVENUE FUND ENTITLED: "ASSET TRACKING";
APPROPRIATING FUNDS FOR ITS OPERATION IN AN AMOUNT NOT
TO EXCEED $40,000; AUTHORIZING THE CITY MANAGER TO
ACCEPT THE GRANT OF $40,000 FROM THE U.S. DEPAKIMENT
OF JUSTICE AND TO ENTER INTO THE NECESSARY CONTRACTS)
AND/OR AGREEMENT(S), IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR THE ACCEPTANCE AND DISBURSEMENT OF THE
AFORESAID MONIES FOR THE COMPENSATION OF PERSONNEL AND
OTHER RELATED COSTS; CONTAINING A REPEALER PROVISION
AND A SEVERA$ILITY CLAUSE.
WHEREAS, the City of Miami Police Dep
artment continues to fight against
the influx of narcotics into the Miami area; and
WHEREAS, one means of combatting narcotics trafficking is through the
seizure of assets obtained through illegal activities; and
WHEREAS, the U.S. Department of Justice, Office of Justice Programs, has
approved the award of $40,000 toward the payment of overtime and other related
expenses with no matching funds from the City of Miami to accomplish the
forfeiture of real property associated with illegal activity; and
WHEREAS, any purchases would have to comply with applicable city code
purchasing requirements;
NOW, THEREFORE, BE IT ORDAINED BY IM COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Ordinance are hereby adopted by reference thereto and incorporated herein as
if fully set forth in this Section.
Section 2. The following Special Revenue Fund is hereby established and
resources are hereby appropriated as described herein:
FUND TITLE; Asset Tracking
RESOURCES: U.S. Department of Justice $40,000
APPROPRIATIONS: Total Personnel $19,858
Total Related Costs $20,142
Section 3. The City Manager is hereby authorized to accept the grant as
set forth in the Preamble to this Ordinance and to enter into the necessary

contracts) and/or agreement(s), in a form acceptable to the City Attorney,/
for the acceptance and disbursement of the aforesaid monies for the
compensation of personnel and other related costs.
Section
4.
All ordinances
or
parts of ordinances
insofar as they are
inconsistent
or
in conflict with
the
provisions of this
Ordinance are hereby
repealed.
Section 5. If any section, part of section, paragraph, clause, phrase,
or word of this Ordinance is declared invalid, the remaining provisions of
this Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an emergency measure
on the grounds of urgent public need for the preservation of peace, health,
safety, and property of the City of Miami, and upon the further grounds of the
necessity of the City of Miami to make the required and necessary payments to
its employees and officers, payment of its debts, necessary and required
purchases of goods and supplies, and to generally carry on the functions and
duties of municipal affairs.
Section 7.. The requirement of reading this Ordinance on two separate
days is hereby dispensed with by an affirmative vote of not less than four -
fifths of the members of the Commission.
Section 8. This Ordinance shall become effective immediately upon its
adoption.

ENCLOSURES:
It is respectfully recommended that an Ordinance establishing a
Special Revenue Fund entitled: "Asset Tracking," accepting a
grant from the U.S. Department of Justice, in the amount of
$40,000 and appropriating funds for the operation of same, be
adopted.
The Miami Police Department is continuing its efforts at
combatting narcotics trafficking ;and has received ass.istance in
this endeavor from the federal government in the past: The U.S.
Department of Justice, Office of Justice Programs, has awarded
the City of Miami Police'Department a grant of $40,000 to conduct
financial investigations upon individuals and organizations
suspected of trafficking. The purpose of these investigations is
to identify assets obtained from the profit of narcotics
operations. No matching funds are required by the City.
This Ordinance is being requested on an emergency basis on the
grounds of urgent public need. for the preservation of peace,
health, safety, and property of the City of Miami, by curtailing
narcotics trafficking.
