AN ORDINANCE AMENDING THE FUTURE LAND USE MAP OF ORDINANCE NO. 10544, AS AMENDED, THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN 1989-2000, FOR THE AREA BOUNDED BY NORTHWEST LOTH AND 11TH STREETS, BETWEEN I-95 RIGHT-OF-WAY AND NORTHWEST 4TH COURT, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN), BY CHANGING THE LAND USE DESIGNATION OF THE SUBJECT PROPERTY FROM MEDIUM DENSITY MULTI -FAMILY RESIDENTIAL TO MAJOR PUBLIC FACILITIES, TRANSPORTATION AND UTILITIES; MAKING FINDINGS; INSTRUCTING THE CITY CLERK TO TRANSMIT A COPY OF THIS ORDINANCE TO AFFECTED AGENCIES; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of March 6, 1991, Item No. 2, following an advertised public hearing, adopted Resolution No. PAB 16-91, by a 9 to 0 vote, RECOMMENDING APPROVAL of an amendment to the Future Land Use Map of Ordinance No. 10544, as amended, the Miami Comprehensive Neighborhood Plan 1989-2000, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this Comprehensive Plan change as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Future Land Use Map of Ordinance No. 10544, as amended, the Miami Comprehensive Neighborhood Plan 1989-2000, is hereby amended by changing the land use designation from Medium Density Multi -Family Residential to Major Public Facilities, Transportation and Utilities for the area bounded by Northwest loth and filth Streets, between I-95 Right -of -Way and Northwest 4th Court, Miami, Florida, more particularly described as Lots 1-12, less West 15 feet of Lots 1-12 and less North 5 feet of Lot 1 and less dedications, Block 13N, A.T. CARTER RE SUB, according to the plat thereof, as recorded in Plat Book B at r 10917 Page 167 of the Public Records of Dade County, Florida; all of Lot 16 and parts of Lots 4, 5, 17 and 18 less I-95 right-of-way, Block 13N, MIAMI A.L. KNOWLTON, according to the plat thereof, as recorded in Plat Book B at Page 41 of the Public Records of Dade County, Florida; and Lot 4 less South 5 feet and less I-95 right-of-way, Block 13N, PARRY DIV, according to the plat thereof, as recorded in Plat Book 1 at Page 75 of the Public Records of Dade County, Florida. Section 2. It is hereby found that this Comprehensive Plan designation change: a. is necessary due to changed or changing conditions; b. involves a residential land use of 5 acres or less and a density of 5 units per acre or less or involves other land use categories, singularly or in combination with residential use, of 3 acres or less and does not, in combination with other changes during the last year, produce a cumulative effect of having changed more than 30 acres; C. is one which involves property that has not been the specific subject of a Comprehensive Plan change within the last year; and d. is one which does not involve the same owner's property within 200 feet of property that has been the subject of a Comprehensive Plan change within the last year. Section 3. The City Clerk is hereby directed to transmit a copy of this Ordinance immediately upon approval on first reading to Bill Sadowski, Secretary, Florida Department of Community Affairs, 2740 Centerview Drive, Tallahassee, Florida 32399-2100, for 90 day review and comment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. J091'7 -2- Section 5. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. BACKGROUND Part of this triangular site is presently leased by Florida Department of Transportation as a material storage yard but is otherwise vacant. The block to the west is leased a) to the YWCA so that an existing City building can be renovated into a day care facility and b) for a proposed 10,000 square feet (footprint) health clinic, to be constructed and operated by the Dade County Department of Human Resources. Construction funding is by the State of Florida; $1.5 million has been allocated for three clinics, including this one. This triangular site will probably be needed for surface parking for the health clinic. 10917 ANALYSIS RECOMMENDATION PLANNING ADVISORY BOARD I CITY COMMISSION If approved on first reading, this small-scale amendment will be transmitted to the Florida Department of Community Affairs for 90 day review and comment. Sadowski SK,e,n The Department has completed its review of the proposed comprehensive plan amendment (Amendment 91S6) for the City of Miami which was submitted on May 9, 1991. Copies of the proposed amendment have been distributed to appropriate state, regional and local agencies for their review and their comments are enclosed. The Department has reviewed the proposed amendment for consistency with Rule 9J-5, Florida Administrative Code, Chapter 163, Part II, Florida Statutes, and the adopted City of Miami Comprehensive Plan. The Department raises no objections to the proposed amendment, and this letter serves as our Objections, Recommendations and Comment Report. This letter and the enclosed external agency comments are being issued pursuant to Rule 9J-11.010, Florida Administrative Code. Upon receipt of this letter, the City of Miami has 60 days in which to adopt; adopt with changes, or determine that the City of Miami will not adopt the proposed amendment. The process for adoption of local comprehensive plan amendments is outlined in s.163.3184, Florida Statutes, and Rule 9J-11.011, Florida Adminis- trative Code. Within five working days of the date of adoption, the City of Miami must submit the following to the Department: Five copies of the adopted comprehensive plan amendment; A copy of additional changes not previously reviewed; EMERGENCY MANAGEMENT Y HOUSING AND COMMUNITY DEVELOPMENT • RESOURCE PLANNING AND MANAGEMENT 10917 5 2 The Honorable Xavier L. As a deviation from the requirement above, you are requested to provide one of the five copies of the adopted amendment directly to the Executive Director of the South FloridaRegional Planning Council. The regional planning councils have been asked to review adopted amendments to determine local comprehensive plan compliance with the Comprehensive Regional Policy Plan. MAN PA6- ITEM#2 March 6, 1991 ANALYSIS OF PROPOSED COMPREHENSIVE PLAN AMENDMENT No.91 :2 Area bounded by NW 10th and 1 th Streets between I-95 Right of Way and gl�4th Court. DISCUSSION The subject 1.15 acre is a triangular area bounded by NW loth and llth Streets, between the I-95 Right -of -Nay and NW 4th Court, in the Overtown CD Target Area. The site is vacant. MCNP Land Use Policy 1.6.1., establishes future land use categories according to the Future Land Use Plan Map and the "Interpretation of the Future Land Use Plan Map". The subject property is currently designated "Multifamily Medium Density --Residential". Areas of the same designation are. located to the northeast and south of the subject property; in the block to the west there is a "Major Public Facilities, Transportation and Utilities" land use designation (in process), while to the east is I-95 Right -of -Way. The "Multifamily Medium Density --Residential" land use category permits multifamily structures up to low-rise apartment structures and lower density residential structures. Permissible uses include accessary commercial and office activities in the same building that are intended to serve the retailing and personal services needs of the immediately surrounding neighborhood and community -based residential facilities (14 clients or less). "Major Public Facilities, Transportation and Utilities" land use category permits major concentration of national, state and local government activities, as well as major public health or educational facilities, 10917 W Governmental, health, religious and educational activities may occur within this land use designation. Public and private cemeteries are also provided for in this land use category. A change of land use designation to "Major Public Facilities', Transportation and Utilities" for these lots together with the extension of this designation to the block to the west now separated by NW 4th Court would create two contiguous blocks in this designation. Although NW 4th Court may be violated and abandoned (by platting). KNP Land Use Goal 1, requires the City to promote the efficient use of land use and minimize land use conflicts. The change also, would be consistent with Policy 1.1-3. which requires that all areas of the City be protected from encroachment of incompatible land uses. Housing Policies 1.1-5. and 1.2.7. require the City to preserve and enhance the general appearance and character of the City neighborhoods* Together these goals and Policies argue that the existing land use pattern in this area should be changed. In addition, Land Use Policy 1.1-1. requires development or redevelopment, that results in an increase in density or intensity of land use, to be contingent upon the availability of public facilities and services that meet or exceed the minimum LOS standards adopted in the Capital Improvement Element (CIE) (CIE Policy 1.2.3.).
