HomeMy WebLinkAboutO-10916J-91-471 7/8/91 ORDINANCE NO. 0 AN ORDINANCE AMENDING THE ZONING ATLAS OF ORDINANCE NO. 11000, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION OF THE PROPERTY LOCATED AT APPROXIMATELY 1820-2010 SOUTHWEST 17TH AVENUE; 1700-1753 SOUTHWEST 19TH STREET (BOTH SIDES), MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN), FROM R-2 TWO FAMILY RESIDENTIAL TO R-3 MEDIUM DENSITY MULTI -FAMILY RESIDENTIAL AND G/I GOVERNMENT AND INSTITUTIONAL; BY MAKING FINDINGS; BY MAKING ALL NECESSARY CHANGES ON PAGE NO. 39 OF SAID ZONING ATLAS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of June 5, 1991, Item No. 11 following an advertised public hearing, adopted Resolution No. PAB 36-91, by a 6 to 0 vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend the Zoning Atlas as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended, is hereby amended by changing the zoning classification from R-2 Two Family Residential to R-3 Medium Density Multi -Family Residential and G/I Government and Institutional for the property located at approximately 1820-2010 Southwest 17th Avenue; 1700-1753 Southwest 19th Street (both sides), Miami, Florida, more particularly described as Lots 21-28 of Block 1, VENICE HEIGHTS AMEND, according to the plat thereof, as recorded in Plat Book 28 at Page 69 of the Public Records of Dade County, Florida; all of 10916 MARCELLUS DEARBORN SUB., according to the plat thereof, as recorded in Plat Book B at Page 26 of the Public Records of Dade County, Florida; and Tr. A, TELCO SUB., according to the plat thereof, as recorded in Plat Book 87 at Page 21 of the Public Records of Dade County, Florida. Section 2. It is hereby found that this zoning classification change: a. is in conformity with the adopted Miami Comprehensive Neighborhood Plan; b. is in harmony with the established land use pattern; C. is related to adjacent and nearby districts; d., is not out of scale with the needs of the neighborhood or the City; e. maintains the same or similar population density pattern and thereby does not increase or overtax the load on public facilities such as schools, utilities, streets, etc.; f. will change existing district boundaries which are illogically drawn in relation to existing conditions on the property proposed for change; g. is necessary due to changed or changing conditions; -h. positively influences living conditions in the neighborhood; i. has the same or similar impact on traffic and does not affect public safety to a greater extent than the existing classification; J. has the same or similar impact on drainage as the existing classification; k. has the same or similar impact on light and air to adjacent areas as the existing classification; 1. has the same or similar impact on property values in the adjacent areas as the existing classification; -2- 10916 M. will contribute to the improvement or development of adjacent property in accord with existing regulations; n. conveys the same treatment to the individual owner as to owners within the same classification and the immediate area and furthers the protection of the public welfare; and o. is warranted because there are substantial reasons why the use of the property is unfairly limited under existing zoning. Section 3. Page No. 39 of the Zoning Atlas, made a part of Ordinance No. 11000 by reference and description in Article 3, Section 300 thereof, is hereby amended to reflect the changes made necessary by this amendment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. Zoning Ordinance 6871 classified the property as Duplex and Medium Density Multi Family; Zoning Ordinance 9500 classified the property as Duplex.
