HomeMy WebLinkAboutR-91-075616 J-91-798 9/25/91 RESOLUTION NO. 756 A RESOLUTION WAIVING, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION AFTER A DULY ADVERTISED PUBLIC HEARING, THE PROHIBITION AGAINST THE TRANSACTION OF BUSINESS WITH A CITY EMPLOYEE, AS SUCH PROHIBITION APPLIES TO SYLVIA M. MENDOZA, WHOSE LAST SCHEDULED DAY OF CITY SERVICES AS TECHNICAL OPERATIONS LIAISON IS OCTOBER 31 1991, FOR THE PROPOSED ENGAGEMENT OF THE SERVICES OF SAID INDIVIDUAL AS AN INDEPENDENT CONTRACTOR IN MATTERS PRIMARILY RELATED TO THE ADMINISTRATION OF SPECIAL PROJECTS AND BID PROCESSES, AND RESEARCH OF THE CITY'S OFFICIAL RECORDS WHICH ARE KEPT IN THE OFFICE OF THE CITY CLERK. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a 4/5ths affirmative vote of the members of the City Commission, after a duly advertised public hearing, the following findings are hereby made upon which the herein waiver is based concerning contractual relations with the City by a City officer, official or employee while so employed or within two years after leaving City employment as the prohibition in City Code Section 2-302 may apply to Sylvia M. Mendoza, Technical Operations Liaison, whose last scheduled day of City service is October 3, 1991: (a) The services of Sylvia M. Mendoza are unique in character as they relate to the research of official records and legislation, and the special projects handled by the Office of the City Clerk. (b) The City of Miami cannot avail itself of such services without authorizing the herein proposed transaction which would be in violation of City Code Section 2-302 were there not a waiver of the prohibition contained in said Section 2-302. (c) The herein proposed transaction will be in the best interest of the City of Miami. CITY COMMON MEETING or OCT 3 1991 91- 756 ONW-M w Section 2. Based upon the findings set forth in Section 1 hereof, the prohibition contained in Section 2-302 of the City Code is hereby waived by a 4/5ths affirmative vote of the City Commission as such prohibition against transacting business with a City employee applies to Sylvia M. Mendoza, a Technical Operations Liaison with the Office of the City Clerk, for the proposed engagement of the services of said individual as an independent contractor in matters primarily related to the administration of special projects and bid processes, and research of the City's official records which are kept in the Office of the City Clerk. Section 3. This Resolution shall become effective immediately upon its adoption. REFERENCES Operations Liaison-, City_Cle Fs_Office` ENCLOSURES The purpose of this memorandum is to respectfully request of you, Mr. Mayor and Members of the City Commission, that you approve and authorize me to enter into a professional services agreement with Mrs. Sylvia Mendoza upon her retirement. Mrs. Mendoza has been with this office for the past 14 years and is presently a Technical Operations Liaison. Some of Mrs. Mendoza's basic responsibilities with this office involve research of the City Commission's official records for preparation of special research projects; special gleaning and certification of pertinent documents in connection with the City's bond validation proceedings; complete administration of the lobbying ordinance and the City's bid processes. She also acts as direct liaison with Municipal Code Corporation concerning the ongoing codification of the Charter and Code and reviews code supplements upon their arrival. She also acts as special assistant during City of Miami elections. I know how the Commission feels in connection with the necessary in-house cross training of staff so that when a senior employee leaves, there may be someone on staff fully capable of carrying on his or her responsibilities, and I agree that such should be the case. But in this instance, I beg of you to consider that this early retirement incentive program has "descended" upon us within a very short time -- practically 30 days. Mrs. Mendoza had not even mentioned the possibility of retiring, and therefore, no serious cross -training efforts had been implemented in connection with her eventual departure. Under the herein agreement, Mrs. Mendoza will be requested to work an average of 25 hours per week and the economic impact to the City would be an average of $7,800 for the first six months of her services. Her present salary with the City is $32,510 a year, therefore, if the herein professional services agreement would be approved by you, it would represent a substantial savings to the City. The necessary funds to cover the cost for said services are presently budgeted aid available in the City Clerk's budget.
