A RESOLUTION BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING THE CITY MANAGER'S FINDING OF THE NEED FOR THE REMOVAL OF ASBESTOS AT THE GREYHOUND BUS DEPOT PROPERTY LOCATED WITHIN THE MIAMI FEDERAL LAW ENFORCEMENT BUILDING PROJECT SITE, TO BE AN EMERGENCY AND AUTHORIZING THE ISSUANCE OF A PURCHASE ORDER FOR THIS SERVICE TO MCO ENVIRONMENTAL INC. IN THE TOTAL AMOUNT OF $ 58r500.00 FROM THE DEPARTMENT OF DEVELOPMENT AND HOUSING CONSERVATION; UTILIZING FUNDS THEREFOR ALLOCATED FROM CAPITAL PROJECT NO. 311014 ENTITLED "FEDERAL LAW ENFORCEMENT BUILDING". WHEREAS, the acquisition of an asbestos abatement contractor to remove asbestos containing material from the Greyhound Bus Depot property located within the Miami Federal Law Enforcement Building project site was done on an emergency basis; and WHEREAS, the removal of asbestos containing material had to be completed prior to the demolition of the structure scheduled for July 22, 1991, as per the requirements of Metro -Dade County of Environmental Regulations Management (DERM); and WHEREAS, on July 2, 1991, the Department of Development and Housing Conservation received three proposals in response to informal requests made to City registered minority -owned asbestos abatement contractors; and WHEREAS, the lowest bid in the amount of $58,500 was submitted by MCO Environmental Inc., a City registered Hispanic-, owned asbestos abatement contractor; and WHEREAS, the herein action was determined to be an emergency in order for the City to meet its contractual obligation to the selected developer of the Federal Law Enforcement Building to demolish the structure commencing on July 22, 1991; and CITY COMMISSION METING OF. OCT 3 10 91-- 73 Im"WIN WHEREAS, the expenditure for this service was approved by the City Manager and the U.S. General Services Administration from funds available in Capital Project No. 311014 entitled "Federal Law Enforcement Building"; and WHEREAS, findings of the Chief Procurement Officer were approved and adopted as the finding of the City Manager; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By an affirmative vote of 4/5ths of the Members of the City Commission, the City Manager's written finding that a valid emergency need existed for the performance of asbestos removal service by MCO Environmental, Inc. in an amount of $58,500.00 for the Department of Development and Housing Conservation is hereby ratified, approved and confirmed, with funds therefor hereby utilized from Capital Project No. 311014 entitled "Federal Law Enforcement Building". Section 3. The City Manager's action in authorizing the Chief Procurement Officer to issue this purchase order is hereby ratified, approved and confirmed. Section 4. RECOMMENDATION: _ It is respectfully recommended that the City Commission adopt the attached Resolution ratifying, approving, and confirming the emergency purchase in the total amount of. $58,500.00 to contract the services of MCO Environmental, Inc., a City registered Hispanic -owned asbestos abatement contractor, for the removal of asbestos in the Greyhound Bus Depot property located within the Federal Law Enforcement Building project site at 99 NF 4 Street, Miami. Funds available in Capital Project No. 311014 entitled "Federal Law Enforcement Building" were utilized for this purpose and approved by the U.S. General Services Administration and the City Manager. BACKGROUND: The City of Miami commenced construction of a Federal Law Enforcement Building on City -owned property located at the corner of N.F. lst Avenue and N.E. 4th Street on July 22, 1991. The office and court facility will be comprised of 12 stories plus a basement parking level having approximately a total of 250,000 occupiable sq.ft. This facility will house the U.S. Attorney's Office, other U.S. Law Enforcement Agencies and courtrooms. The Greyhound Bus Depot property located within the project site had to be demolished before the commencement of construction. The City of Miami through its developer, Miami Capital Facilities, Inc., applied for permits. As a requisite for the demolition permit, our Planning, Building and Zoning Department determined that an asbestos survey was necessary to determine the presence, extent and condition of asbestos containing materials in the bus depot property. The Department of Development and Housing Conservation obtained three proposals from qualified firms in the environmental engineering field. Evans Environmental & Geological Science and Management, Inc., (EF&G) provided the lowest cost for performing the required asbestos survey. N �� 0 Honorable Mayor and Members of the City Commission Page Two The asbestos survey of the Greyhound Pus Depot property conducted by EE&G concluded that 17,150 sq.ft. of asbestos containing roofing material was to be removed prior to demolition of the building. in addition, EE&G provided a scope of work and abatement plan to be used by a licensed asbestos contractor. On July 2, 1991 the Department of Development and Housing Conservation received three proposals in response to phone requests made to the four asbestos abatement contractors registered by the City as minority -owned firms. The lowest bid in the amount of $58,500.00 was submitted by MCO Environmental, Inc., a City registered Hispanic -owned asbestos abatement contractor. (Refer to attached bid security list for information on the other bid amounts.) The work was estimated to take 15 days to complete allowing just enough time for the City to meet its contractual obligation to commence construction of the building on July 22, 1991. The Department of Development and Housing Conservation obtained the City Manager's approval on July 3, 1991 for an emergency purchase order to contract the services of MCO Environmental, Inc. MCO Environmental, Inc. completed its work before the estimated time and demolition of the structure started as scheduled. It is therefore recommended that the City Commission adopt the attached Resolution ratifying the City Manager's emergency purchase of asbestos removal services.
