HomeMy WebLinkAboutR-91-0712 J-91-785 U9/l4/91 RESOLUTION N0. A RESOLUTION RELATED TO THE 1991 MIAMI BOOK FAIR INTERNATIONAL STREET FESTIVAL TO BE CONDUCTED BY MIAMI BOOK FAIR INTERNATIONAL, INC. ON NOVEMBER 15-17, 1991; AUTHORIZING THE CLOSURE OF DESIGNATED STREETS TO THROUGH VEHICULAR TRAFFIC AND ESTABLISHING A TEMPORARY PEDESTRIAN MALL SUBJECT TO THE ISSUANCE OF PERMITS BY THE DEPARTMENTS OF POLICE AND FIRE, RESCUE AND INSPECTION SERVICES; FURTHER ESTABLISHING AN AREA PROHIBITED TO RETAIL PEDDLERS DURING THE PERIOD OF THE EVENT: CONDITIONING ALL APPROVALS AND AUTHORIZATIONS HEREIN UPON THE ORGANIZERS PAYING FOR ALL NECESSARY COSTS OF CITY SERVICES AND FEES ASSOCIATED WITH SAID EVENT AND OBTAINING INSURANCE TO PROTECT THE CITY IN THE AMOUNT PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE. WHEREAS, Miami Book Fair International, Inc. will conduct the 1991 Miami Book Fair International Street Festival on November 15-17, 1991: and WHEREAS, certain streets shall be closed to through vehicular traffic, establishing a pedestrian mall during specified dates and hours to insure the safety of the participants and pedestrians attending this event; and WHEREAS, this organization has requested that retail peddlers be restricted within the specified area of the event for a specific period of time during the event; - NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: -- Section 1. In order to effectuate safe passage and establish a temporary pedestrian mall during the 1991 Miami Book Fair International Street Festival, to be conducted by Miami Book Fair International, Inc., the following streets as specified below are hereby closed to through vehicular traffic from $:OU P.M. on Wednesday, November 13, 1991 to 12:00 Noon on Monday, November 18, 1991: crr~r ca~sto~t MEETII~~G C)F .. , 0 CT s t99i ~~.- '712 z i Northeast Second Avenue f.r_om Northeast Fifth Street: to Northeast Third Street. Northeast Fourth Street from 13iscayne Boulevard to Northeast Second Avenue. Eastern most lane of traffic of Northeast First Avenue from Northeast Third Street to Northeast Fifth Street. Included in the herein closure are all streets, avenues, alleys, ways and thoroughfares which intersect the enumerated areas delineated in this Section. Section 2. Such closing of streets is subject to state approval and issuance of permits by the Departments of Police and Fire, Rescue and Inspection Services. Said permit from the Department of Police is to be issued upon full approval of the Chief of Police after giving all due consideration to the safety and traffic needs of residents, businesses and religious institutions in the area for entering and crossing through said arterials and upon the favorable exercise of the City Manager's judgment predicated upon all factors set forth herein. Section 3. Pursuant to Section 39-13 of the City Code, all retail peddlers' occupational licenses issued under the provisions of Chapter 31 of the City Code, as amended, will not be valid on November 15-17, 1991, during the hours of 8:00 R.M. to 7:00 P.M. in the area of the public right-of-way included within and adjoining the streets and avenues described in Section 1, for two blocks in all directions. Section 4. The herein approvals and authorizations are hereby conditioned upon the organizers paying for all necessary costs of City services and applicable fees associated with said event and obtaining insurance to protect the City in the amount as prescribed by the City Manager or his designee. Section 5. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 3rd day of _Oct~3i----.~ , 1991. ENCLOSi!gc~ October. 3, 1991 RECOMMENDATION: i I+_ is respectfully recommended tha+_ the City Commission adopt the _ attached resolution authorizing street closures and the r.es+_r.ict~on of retail peddlers in the vicinity of Miami Dade Community College, Downtown Campus, in connection with +_he 1991 - Miami Book Fair. International Street Fes+_ival to be conducted by Miami Book Fair International, Inc. on November. 15-17, 1991. These author.izati.ons are conditioned upon the organizers paying for. any costs of City services and applicable fees and the requirement that the City wilt be insured against any potential liability. BACKGROUND: The Department of Community Development has prepared the appropriate legislation which authorizes the closure of certain streets and +.he restriction of retail peddlers in the vicinity of Miami Dade Community College, Downtown Campus, in connection with the 1991 Miami Book Fair International Street Festival to be conducted by Miami Book Fair International, Inc. on November. 15- 17, 1991.
