HomeMy WebLinkAboutO-10926J-91-455 10/3/91 ORDINANCE NO. 10926 AN ORDINANCE AMENDING SECTION 53-118 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, WHICH PERTAINS TO RENTAL RATES AND ASSOCIATED CHARGES AND CONDITIONS AT THE MIAMI MARINE STADIUM BY CHANGING THE CLASSIFICATION OF EVENTS UPON WHICH STADIUM USE CHARGES ARE BASED AND INCREASING SAID CHARGES; BY INCLUDING THE COSTS OF POLICE DEPARTMENT PERSONNEL AS AN EVENT COST PAYABLE BY EVENT SPONSORS; BY INCREASING THE USER FEE FOR THE STADIUM PARKING LOT AND BY INCREASING THE PERCENTAGE OF EXTRA COMPLIMENTARY ADMISSION TICKETS WHICH MAY BE ISSUED BY EVENT SPONSORS BASED ON THE TOTAL NUMBER OF EVENT TICKETS SOLD; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, a review of the Miami Marine Stadium rate schedule indicates that changes in rates are necessary to remain competitive with other facilities and increase revenues for the City of Miami; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMT, FLORIDA: Section 1. Section 53-118 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:l/ "Sec. 53-118. Rental rates and associated charges and conditions. (A) Definitions. For the purpose of this section, the following words and phrases shall have the meanings respectively ascribed to them by this subsection: Other events: An activity or gathering other than events previously (or elsewhere in this subsection (A)) described, such as s rca by non- rof; r vi�uy z*n�a events sponsored �? en ' t,�� or conventions. (i) Except as otherwise provided in this section, charges by the city for the use of the stadium shall be assessed as followss (a) For the use of the stadium premises for other events and trade shows, there shall be assessed a fee, payable in advance, which shall be the greater of UP to i11mY4un.0 __ — hour or a city tax on each admission to the stadium of ten (10) percent of the gross price, as established by the sponsor, on each admission sold by the sponsor of the event to be held in and on the stadium premises, less any federal, state or locally imposed tax payable upon such admission price. MOWER Maw— _ .. _ - _ -2- 10926 9 L2 " - •- i-M .. - -- •- -( e-)- For the use -of the stadium premises for any concert or events including, but not limited to athletic events, boat racing events and agua:ic events. and concert_events whore no admission is charged, there shall be assessed a fee, payable in advance, which shall be the greater or two thousand five hundred dollars ($2,500.00) per day or a city tax on each admission to the stadium of twelve (12) percent of the gross price, as established by the sponsor, on each admission ticket sold by the sponsor of the event, to be held in and on the stadium premises, less any federal, state or locally imposed tax payable upon such gross price. All event costs, including but not limited to electricity used, security, electricians, cleanup l�.ice deDartmant UerSOnn�l reau; rcri f= traffic control and crowd -control, etc., shall be paid by the user. .�€a. tht For the use of the stadium premises for a combination of several types of events, the user shall pay those rates which apply to the event having the larger of the fees quoted herein. (3) Federal, state and locally imposed taxes shall be separately shown and printed upon each and every ticket printed for an event, including complimentary tickets. Complimentary tickets shall be clearly overprinted as such. Users shall be permitted to issue complimentary tickets to their event in an amount equal to a maximum of one--(+t .three __4.4 percent of the total tickets sold for the event, over and above those comolimen 3r tickAtR �o ; Y the -�Y s gna ed b use agreement ;, and, if the city's audit conducted subsequent to the event reveals that complimentary tickets were issued in an amount exceeding one—f+t three percent of the total ticket sales, then the user will be required to pay the ten--( jet twelve LL2+ percent city tax on that number of complimentary tickets which exceed the cite t+ - three ( 3 ) percent. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. Odio, REFERENCES City Manager ENCLOSURES RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Ordinance amending Section 53-118 of the City Code which pertains to rental rates and associated charges and conditions at the Miami Marine Stadium. BACKGROUND: The Department of Conferences, Conventions and Public -.Facilities has prepared the attached ordinance which will amend the City Code to refine existing provisions related to Miami Marine Stadium charges and conditions. The primary impact of this revision will be to change the classification of events upon which stadium use charges are based and to increase said charges, to include the costs of police department personnel as an event cost payable by event sponsors, to increase the user fee for the stadium parking lot and to increase the percentage of extra complimentary admission tickets which may be issued by event sponsors based on the total number of event tickets sold. 10926 7-/ MIAMI REVIEW Published Daily except Saturday, Sunday and Legal Holidays Miami, Dade County, Florida.
