ORDINANCE NO. 10923
AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 10451.
AS AMENDED, ADOPTED ON JULY 14, 1988, ESTABLISHING
RESOURCES AND APPROPRIATIONS FOR THE "MIAMI POLICE
CRACK COCAINE" FUND, INCREASING THE AMOUNT BY $990,3 25
AS A RESULT OF PROJECT INCOME AND INTEREST SUBJECT TO
A FULL DISCLOSURE OF ALL EXPENDITURES BEING SUBMITTED
TO THE CITY COMMISSION: CONTAINING A REPEALER
PROVISION AND SEVERABILITY CLAUSE.
WHEREAS, the City of Miami applied for competitive grant funds and was
awarded a grant from the United States Department of Justice, through the
Bureau of Justice Assistance, in the amount of $350,000 to focus more effort
and resources on the crack cocaine problem; and
WHEREAS, Ordinance No. 10451, adopted July 14, 1988, accepted said grant
by establishing the "Miami Police Crack Cocaine" fund; and
WHEREAS, Ordinance No. 10451, adopted on July 14, 1988, established
resources and appropriations for the "Miami Police Crack Cocaine" fund in the
amount of $350,000; and
WHEREAS, Ordinance No's. 10664 and 10740 amended Ordinance No. 10451 by
increasing appropriations to $771,883; and
WHEREAS, as a result of additional successful forfeiture actions and
interest .there is an additional $990,325 available to be deposited in the
"Miami Police Crack Cocaine" fund; and
WHEREAS, the additional funds will be used for the operational and
administrative tasks required to target crack cocaine use and distribution;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Section 1 of Ordinance No. 10451, as amended, adopted
July 14, 1988, is hereby amended in the following particulars:l/
"Section 1. The following Special Revenue Fund is hereby established
and resources are hereby appropriated as described herein:
1/ Words and/or figures stricken through shall be deleted. Underscored words
and/or figures shall be added. The remaining provisions are now in effect
and remain unchanged.

FUND TITLE: Miami Police Crack Task Force
RESOURCES: United States Department of Justice,
through the Bureau of Justice Assistance S 700,000

APPROPRIATIONS: Miami Police Crack Task Force *gg47Q-3 $1,762,208"
Section 2. The resources and appropriations for the "Miami Polio
Crack Cocaine" fund are hereby increased by $990,325 as a result of additional
monies deposited in said Fund due to project income as the result of
successful forfeiture actions and interest subject to a full disclosure of all
expenditures being submitted to the City Commission.
Section 3. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this Ordinance are hereby
repealed.
Section 4. If any section, part of section, paragraph, clause,
phrase, or word of this Ordinance is declared invalid, the remaining
provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of peace,
health, safety,and
property of the City of Miami, and upon the further
grounds of the necessity of the City of Miami to make the required and
necessary payments to its employees and officers, payment of its debts,
necessary and required purchases of goods and supplies, and to generally carry
on the functions and duties of municipal affairs.
Section 6. The requirement of reading this Ordinance on two separate
days is hereby dispensed with by an affirmative vote of not less than four -
fifths of the members of the Commission.
Section 7. This Ordinance shall become effective immediately upon
its adoption.

ENCLOSURES
It is respectfully recommended that the City Commission adopt the
attached emergency ordinance as amended, increasing the
appropriations to the "Miami Police Crack Cocaine" fund by
$990,325.
BACKGROUND•
Ordinance No. 10451 adopted on July 14, 1988 established
resources and appropriations for the "Miami Police Crack Cocaine"
fund, in the amount -of $350,000. As a result of successful
seizures and interest there are an additional $990,325 available
for deposit into this fund. These funds will be utilized to
continue the Crack Sting Operations conducted by the police
department.
This Ordinance is requested on an emergency basis on the grounds
of urgent public need for the detection and apprehension of
individuals furthering the manufacture and sale of crack cocaine
and to maintain the peace, health, safety, and property of the
City of Miami.
